i don't know who or what has jurisdiction over this type of stuff, but there is a precedent with erik vorhees http://www.coindesk.com/sec-voorhees-deal-unauthorized-securities-sales/

and now the whole ico token madness has started to cross the SEC's radar.

i'll bet that most of them haven't paid the slightest attention to the fact they might be subject to actual laws and consider themselves above this type of stuff because they're special somehow.

what would be the ramifications if they got serious? there must be hundreds of them by now.
