they sure can, it could be considered a breach of contract, that and your using system resources for your own personal gain while affecting other people using resources on the same server

Check on your terms and conditions when you signed up for the dedicated server. There may a specific clause there against mining.

it also may not tell you in black in white, it may be worded in such a way that you might not catch it. there not going to just step out and say hey this is not for mining etc, its more of due diligence and respect for other users that are also using the server which would be more than enough of a reason for them to shutter an account. even a dedicated server that you pay for is only soo dedicated, most of the time your using resources on a yes dedicated server that's also got other users doing things too

Most of the providers allow it for a dedicated server just not for shared OpenVZ style server's as it will impact other users. It might be breaking the terms of service (ToS) but there's really no reason why any dedicated server hosting provider wouldn't allow you to max out the CPU. I wouldn't do business with them if they limited that. However, you need to read your hosting provider's ToS. They might forbid certain applications like IRC servers, BitTorrent, Tor, etc. If they don't list Bitcoin then you are good to go.

Many hosts do have a vague TOS clause about running processes that occupy too much of the server's overhead. Often they will automatically throttle or even kill your processes. For example, godaddy.com has limits on how much CPU time and power a process can use on their shared hosts. They will automatically kill it if it runs past their limits.

No, Dedicated servers are owned by you for the time period you pay and you can use them 100% .
If any provider ban you, ask them to read their terms back.

If you got a dedicated one and not a virtual one there will be no issues at Hetzner.
