I'm back.

Recently I put a post in the Butterfly Labs  forum , asking to do something, to all users affected by the misleading and all the lies they have told us,all the lies they are saying about our deliveries... In June will be a year since they promised us in two months we would have our miners in our house doors., but that has not happened. They're just delivering Jalapeños.

It seems Butterfly Labs is worried about the post that I put on the Butterfly Labs forum, because they removed it automatically when some user began to contribute whit ideas and facts that can complicate Butterfly Labs in a lawsuit for "misleading" or other legal alternative penalty.

The largest gall not only was that they removed the post, but they created a new one, which made fun of us, and was called "Humorous lawsuit against Butterfly Labs"
 
The idea of ​​this post is to get together to think and find a legal form to compel  Butterfly Labs to respond to misleading, either a lawsuit or claim or fine or whatever... To undertake a fight against this company, they have been taking advantage of all us, they have been filling their pockets and are still asking  for pre-orders and inventing excuses to do nothing.

I also created a pool where you can vote on whether you believe if Butterfly Labs should be penalized for their poor performance,for having deceived us, and keep doing it.

I thought it was obvious that Butterfly Labs is a scam. Why people here are stupid enough to buy their crap, I'll never understand.

Ideas Please don't fill this post with bad feelings.... forgot your point of view... Ideas we need Ideas to move to a solid action, If is a scam with more reason we need to make a serious step vs BFL

If anyone who ordered lives in Massachusetts, there is a consumer protection law against misrepresentations, i.e, if they said something would ship in 2 weeks, and you ordered and didn't get it for a year, I'm pretty sure you'd have a claim against them.  You would have jurisdiction to sue them in Mass. in my opinion.  I'm pretty sure most states have some sort of consumer protection laws.

Ive never actually dealt with BFL but what did it say in their terms and conditions of sale?  or whatever contract was made between the buyers and BFL?  Im sure some sort of breach of contract must have occurred somewhere. 

On the other hand, if you gave them your money and then never asked for it back do you really have much to complain about? It would be different if they had refused to give you a refund after they missed the expected shipping date, but by sitting waiting for them to ship and not demanding any money back you're basically saying that what they are doing is ok.

either get a lawyer which won't be cheap or just file with your state's attorney general and maybe the FTC or whoever it is that regulates interstate commerce... doubt any of them would actually do anything this is small potatoes, then again I'm sure some in the US gov't would love to have another btc related company to go after (doesn't help the cause that the CEO is a felon lmoa...)

fwiw, they give refunds if you ask, if you paid cash - no so desirable, but if you paid in BTC - you will want it back and they even offered everyone this (via mass mailing, two friends who wanted refunds got their BTC back).

If your financial circumstances have been affected by promises made by a company, you may have redress.

It seems to me that everyone that ordered and didn't receive their product within the timeframe promised have had an opportunity cost.

They could have purchased elsewhere instead but didn't do so because of continued promises of delivery that were not met.

Had you been provided information at the earliest possible opportunity, you might have been able to reassess your situation but that doesn't appear to be the case.

It looks like you've been given multiple promises of delivery but they have never been met and on and on it goes.

It doesn't matter what laws they broke wherever you're from. It only matters what laws they broke in the state in which they do business (or in the case of Internet-only businesses, they are registered in).

Good luck getting your money back. I think the painful lesson we should all learn is that when dealing with a deflationary, always preorder using fiat.
