Seems like your coins are gone... this has happened to me once on BTC-e before.  

Just learn from your mistakes and don't do it again. They aren't really scamming you if it's stated in their website.

Well, it happened to me too as you can read here https://bitcointalk.org/index.php?topic=518342.msg5730740#msg5730740. Although it is stated on their website I still think this is a scam. You shouldn't loose any money using an exchange service (well, unless you do bad trades ofc).

How hard would it be to automatically return the funds if the amount is too low? Considering all the bragging about his coding skills that should be a piece of cake for him. And it wouldn't feel like you were just ripped off. No matter the amount.
