We know from here: https://www.blockchain.com/btc/tx/f4184fc596403b9d638783cf57adfe4c75c605f6356fbc91338530e9831e9e16 that the address 1Q2TWHE3GMdB6BZKafqwxXtWAWgFt5Jvm3 belongs to Hal Finney.
From this transaction: https://www.blockchain.com/btc/tx/70ec308460a38f6de25f89c6ed84bf68160c27834f13d17d5a713602e3a4786b we see that the bitcoins owned by Hal Finney are being used.
What are the possibilities on how this can happen?

His family has access to them.  Specially his daugther and son.
He said in the forum.

That's my story. I'm pretty lucky overall. Even with the ALS, my life is very satisfying. But my life expectancy is limited. Those discussions about inheriting your bitcoins are of more than academic interest. My bitcoins are stored in our safe deposit box, and my son and daughter are tech savvy. I think they're safe enough. I'm comfortable with my legacy.
[edited slightly]

And this is what everyone who has any family  should do.

Don't let your bitcoins die with you. Tell your family how to recover them if you pass away

What happens when someone dies? ...Answer: Someone or an organization inherit his coins... so it is just natural that it might be used.  Roll Eyes  He was not Satoshi Nakamoto.... so I do not know why people have this obsession to monitor other people's wealth.

He was cryopreserved by the Alcor Life Extension Foundation, so I guess this foundation has to be paid to do this? I do not know if you pay for this before you die... or do they put money into a trust to pay for this?

Is it not better to begin to plan ahead in preparation for how you will ever wanted to use your own bitcoin now and thereafter than asking around for Hal Finney's bitcoin has nothing to add a dime into you pocket, we are better off some things that are less concerned to us.
