Just a warning to the OP.
Quote
Can you provide a business invoice?
Sorry, we can’t. We do not charge VAT and moreover, we are not a registered business. In fact, this is just a “one man show”, i.e. one guy selling to another.
This is illegal in the Netherlands and could give you big problems. (Not to mention it is unfair competition towards registered companies)

Hi,

Thanks for the warning and concerns.
Well, I’m just selling to you as a private person, not as a company. Just like I would do on eBay and I don’t have to pay VAT over there either. Or am I missing something?

Thanks.

Yeah unfortunatly the rules are different, as you are selling on a webshop that you created, you are an 'ondernemer', and not a 'particulier'.

There is a reason why the dutch webshops are more expensive then buying on marktplaats.nl.

Take a look at
http://www.belastingdienst.nl/wps/wcm/connect/bldcontentnl/belastingdienst/zakelijk/ondernemen/internetondernemers/hobby_of_onderneming/uw_activiteiten_op_internet_hobby_of_ondeneming

I can tell you, when you start a webshop like this, you are an ondernemer, and you are taking risks as you dont have proper insurances like you would have as a company.

If you want more information/questions, give me a PM as I've done extensive research on this subject.

Hi there. Sorry for asking. Is crypto currency regulated in NL ?

Because, if it is not, you can not describe what he does as an act of commerce.

Later edit. Sorry, I got bussy reading, and I totaly missed this part :

He is not selling Cryptocurrency, he is selling equipement, electronic equipement, and yes, even for cryptocurrencies there is a lot of regulation in holland. The AFM is all over it, all websites that sell bitcoins in Holland (bitonic.nl / bitmymoney.nl / all others) got a nice letter from the AFM they needed to comply with new guidelines.

What if he only takes crypto as payment?

Did the gov cover even this part? Or only the exchanges have to follow regulations?

One of the conditions for being a company is:
- accepting payments

When you consider the dutch government has given value to cryptocurrencies. The minister of finance has given a few examples for consumers that hold bitcoins, that they have to declare them at the annual tax return, it is even in the tax program as an example of value.

I do not know if there is a precedent yet for taking payments in crypto's like you said. But if you extend that for consumers the government acknowledges that crypto's have value, that for pseudo-companies like this, he is accepting payment even if he accept only in crypto's.

After some reading, I guess you’re right. Thanks for pointing it out.
Luckily, I also own a company registered at the chamber of commerce so this is not a big issue. I’ll get things changed Smiley

I don't understand why selling gridseeds would be illegal without being a registered company.
You are allowed to turnover ~5k a year without paying taxex in the NL.
And how about marktplaats, that is legal right.

As an entrepreneur I can confirm that this is correct.

PS: your price is too high..
