It does! If you do any amount under $100 currently, the fee is 3.99%. If the amount is over its 4.49% because we incur more costs.

Also, by default the "Total commission and fees" text box shows "3.99%%" and only changes when you enter an amount to send.

Yes, this is because the rate reflects the lowest fee, which is 3.99%

I really think that should be fixed.

I think I see where I was confused.  The minimum fee reflects the fee if you were to send the minimum while the maximum fee reflects the fee if you were to send the maximum?

The whole min fee being higher than the max fee didn't make sense to me.

EDIT:  The title is also misleading (at least to me) "Re: [PRICES LOWERED] ALL CASH Deposits are 3.99% | BitInstant.com"  The part where it says ALL cash deposits.

EDIT #2:  I only bring up all of this because I plan on using the service again in the near future.

Yes, when we originally lowered the fee for a limited time, all was lowered to 3.99%

That limited time is now over, and only $100 is 3.99%
