I am holding 7.89 BTC in escrow from someone that offered to sell them to ruggedman_dan.

I sent out the escrow agreement, and the seller accepted the agreement and funded the escrow address.

I have not heard back from ruggedman_dan in over 48 hours and according to the seller he has not sent payment.

I have sent a message to ruggedman_dan informing him to no longer send any payment to the seller until/unless he first contacts me.

Due to the fact that the expiration time on the escrow agreement has been reached, the seller is now requesting that the funds be returned to him from escrow.

Since I'm not getting any response from ruggedman_dan, I have no way of knowing for certain if he has sent payment yet or not.

If ruggedman_dan has already sent payment, or if he sends payment in the future without noticing that the escrow agreement has expired, then I sincerely apologize. However, the terms of the escrow clearly state that he must contact me to be protected by the escrow agreement.  The agreement provides multiple methods of contact including phone number, email address, and U.S. postal mailing address.

At this time I must honor the terms of the agreement and allow the seller to request a refund of the funds from escrow.

If anyone has any contact info for ruggedman_dan, please have him contact me as soon as possible so that I can remove the negative feedback from his trust page and can get this escrow resolved.

48 hours is a relatively short amount of time. I would've have held out for a few more days (at least 2). It could be possible that a payment has already been made, I sincerely hope not however.

Could you please release who the potential seller was?

48 hours is a relatively short amount of time. I would've have held out for a few more days (at least 2).

The escrow agreement very clearly states:

Disagreement about receipt of product:
  • If redacted seller does not receive the redacted payment method funds by 04:00 CST Wednesday 2014-11-12, he can request that escrow is released back to him
  • If such a refund request is made, ruggedman_dan will have 24 hours from when the refund request is sent to state an objection.
  • If there is no objection from ruggedman_dan, then the bitcoins in escrow will be released to any bitcoin address supplied by redacted seller.
  • If ruggedman_dan does object to the refund request, the transaction will enter a phase of public conflict resolution

It is now after 04:00 CST Wednesday 2014-11-12.

The seller has not yet requested that escrow be released to him, but according to the escrow agreement he can at any time now if he wants to.  That is why I created this post.  If the seller chooses to request that escrow be released to himself, then I wanted to make sure that there was a public statement about what had happened ahead of time.

It could be possible that a payment has already been made, I sincerely hope not however.

I also hope not.  It certainly could have happened.  However, I never received a message from ruggedman_dan indicating that he accepts the escrow agreement.  I have provided multiple methods of contacting me in the original escrow agreement and have not received any contact from ruggedman_dan at all.  The agreement clearly states that if the seller requests a refund, it is ruggedman_dan's responsibility to contact me within 24 hours.

Could you please release who the potential seller was?

Not without his permission.  Why does it matter?

Odd, I've never had any issues with ruggedman_dan, and I've done a few escrow jobs for him. I did notice that he recently placed an ad wanting to sell 1.5 BTC or around that amount when previously he had been buying BTC. Whether that has anything to do with anything, who knows? He doesn't appear to have logged into his account for a couple days either, so I hope everything is ok.

Were the terms of sale to sell the 7.89 at a fixed price? If so then it would have been ruggedman_dan's best interest to continue with the sale now that the price of bitcoin has risen 10% in the last 24 hours and more over the past several days

True, which is why it was very strange that he disappeared in the middle of the transaction.

Well I would say the fact that the price has increased is the reason he has returned, now that he can sell them for what is essentially a risk free profit on an exchange. I would say that if he did not return then he could simply say that he did not accept the terms of the escrow agreement and could ask you to remove the negative trust.

It was more for if the seller received a payment. Nevermind.
