Tom used bitpay .. I think, for the btc tx .. Doesnt that convert it to USD for the vendor?

No, the receiver can choose if he want's the payment in BTC or pay a higher fee and receive the amount exchanged into fiat.

I bet in case of a lower BTC price the message would be, that he held the bitcoins in escrow and do the refund in BTC. However, chances are good that there will be no BTC refund at all.

But the lesson is learned: I never will do any BTC pre-payment with a noticeable amount again. None of my bitcoins will be stored under third party control (web wallet, online service) and exchange amounts will be very limited and immediately transferred to accounts that are completely under my control. Way too many crooks in the bitcoin world.

I think if we *dug* about.. we may find out it was Tom who accessed Daves email address and sent the "virus redirect' to users.
Purely so he could build up the whole fantasists "out" of "the accounts have been hacked", then turn round and blame the community for recking his plans.

We enable all these scammers.....it creates an enviroment where scamming is accepted

Fucked if I know why he's telling people to call the police.  Here in Australia it's a breach of contract issue rather than a criminal matter.  It's typically not worth the cost of taking civil action internationally for small claims.

All I can say is that this is Bitcoin. I don't believe it until I see six confirmations.

It's got nothing to do with being nice, it's about legal realities.  You can make a report to the computer crime unit of your state police - they'll then forward it to their counterparts in New York.  Nobody from NSW Police is going to hop on a plane to investigate or try to extradite Tom to Australia. Because the AFP has limited resources, they have very strict guidelines about what they investigate and the amount Australians have lost is likely to fall well below their threshold.  If grounds for fraud prosecution did exist - and failure to pay refunds alone does not prove fraud - then the best case could be made in Tom's own jurisdiction based on complaints made by customers in the US.

Yeah, if it can be proved that the chips were never ordered, that a deposit was never paid for the chips and that Tom has been spending pre-order money on hookers and blow then you have a shot at establishing fraud - but business failure due to incompetence, unforeseen circumstance, under-capitalisation, etc isn't fraud.  90% of new businesses fail.  That's something people need to remember every single time they hand over their BTC to a Bitcoin enterprise and don't immediately get something in return.  Your Bitcoins are safest when they are under your direct control.

All I can say is that this is Bitcoin. I don't believe it until I see six confirmations.

Any positive sightings of Bitcoin refunds? I'm holding on to faith that those of us who have put our trust fully in this new currency by attempting to purchase mining equipment with Bitcoin (thereby completing a theoretical loop) will not be left in the cold.

People who have received their refunds still paid a cost, an actual monetary one if they paid with anything other than USD (BTC, Euro etc) due to exchange rates.  In any case they lost due to opportunity cost by placing orders with bASIC in all cases they made a choice to not deal with one of the alternative manufacturers and lost out on earlier delivery.
Just to confirm, my order was 25 units, I requested a refund for the credit card transactions around the 11th Jan from Dave and I got the money back this morning in my online statements, I did loose a few percent on the $USD vs EUR exchange rate. But that could have had gone the other way, it just sucks to see the EUR gain so much in the last few weeks :-) And for 4 months my money was tied up and I could not use it for normal business, which could have gained me a lot more.

But at least they are keeping their word on the refunds.

My personal cost in this unfolding drama (comedy) is that I gave away 6 Avalon reservations (have fun Maurilio!) that in hindsight I should have kept. But the optimistic estimated delivery projected by BFL and bASIC made me place orders at them instead, so now I have the queue again to try and get more Avalon units...
