I think the only ground for being sued over a Facebook page if you abuse the Terms in some from. Did you write anything bad about their page or trying to scam People?

No i didn't write anything against them in fact i still promote their products which i earn thru commission.
I'm from Philippines by the way and the company is from Singapore.

I was part of their team back when i started but then i quit since i got my full time job months later. and so a team member emailed me telling the marketing department of the company wants to access the FB page, they want to change the url of this page else they will have to file legal actions.

It's a bluff, nothing more. You might stop promoting their products just to get them off your back, but technically it's a free world.

Anyone can give his facebook page any name that is not already taken.

You may feel calm, they may be able to get Facebook to remove the page but it feels not as likely if you're not doing anything illegal

Most people who threaten legal action tend to just hope you get scared by the mere threat and immediately acquiesce to their demands but they probably won't follow through with it but that's not to say they can't or won't so it's up to you whether you think the risk is worth it but if you're worried you should consult proper legal advice not just ask randomers on a message board who wont know the laws in either country.

They can sue you if:
- you use their registered trademark on your page/site pretending to be them;
- the name you choose can easily be confounded with theirs (like Adidas and Adadas).

Creating a Facebook page with a name which is clearly different, though resembles another ain't no reason for a lawsuit.

there are about 4 facebook page similar to what i have, also from another team who also promoted their products.

We don't pretend we are the official page but then a lot of user end up visiting the page since it ranked on the first page of search results to which my previous team get to earn the top seller of their products.  Not sure if its the company that offers to buy the page from me but one of my colleague says i should give a price to it. how should i go about doing this that won't end up like they'd extort me for selling? i know its illegal according to facebook TOS.

If you are an agent for them, you must follow your agreement with them. Anybody can sue anybody for anything. The important part is who wins the suit.

It seem like this big company is pursuing the issues and they want to confiscate my fb page. they offer money to buy the fb page.

The facebook page guidelines says: https://www.facebook.com/page_guidelines.php

Quote
I.    General
A.    A Page for a brand, entity (place or organization), or public figure may be administered only by an authorized representative of that brand, entity (place or organization) or public figure (an “official Page”).
B.    Any user may create a Page to express support for or interest in a brand, entity (place or organization), or public figure, provided that it does not mislead others into thinking it is an official Page, or violate someone's rights. If your Page is not the official Page of a brand, entity (place or organization) or public figure, you must:
i.    not speak in the voice of, or post content as though it was coming from, the authorized representative of the Page’s subject matter; and
ii.    make clear that the Page is not the official Page of the brand, entity (place or organization) or public figure.
C.    Content posted to a Page is public and viewable by everyone who can see the Page.

If i put the word unofficial page right on the page. this means its going to be safe, is it?

Thanks moved the thread.

I'm not anymore connected to them but still the team i'm with when i created the facebook page are still active and i let them use this page. should this be okay?

i feel like they will be deprive of the future sales if i do give it to the company. besides the agent name TOM is a friend of mine and he gets to have sales thru this fb page. i even added him as moderator.

Of course not.The two names are quite different and the dont have ownership of brand "bitcoin" so they can't sue you.Even if your page name was same as their registered brand name, they could have asked facebook to bring down your page without moving to court of law

a company threatens me that they will file a case against me for creating facebook page competing them but i did created that page when i was still their agent. can they sue me?

Lets say for example their company is bitcoinadgame.com and their official facebook page is facebook.com/bitcoinadgame
and mine is facebook.com/bitcoinadnetworkgame

is this something subjected to being sued?

I see the point of your company basis of sueing you.  First, you have a contract there that if you are still with them you are not allowed to tell anyone about the procedures, the transactions, anything and everything about your company.  There are also rules like you cannot have a job unless they are not likely the same.  And when you are terminated or separated with that company, all the knowledge you gain will be forgotten something like that.  So maybe they will charge you for like copying the idea of the company.  Maybe the whole thing about your facebook is the same with the facebook of that company is just that it differs with the name.

I think so because you are previously employed to them.  You know certain things, methods, rules, regulations, how things work in your company before that you could apply to your business.  Maybe it is like copying the format of your previous company.  Maybe you are earning a right amount right now and you are becoming a threat to them.  Regarding the name of your facebook and their facebook their is nothing wrong with it I guess.  It is just some personal issue with you and your company before.

He said he was their agent, this doesn't have to mean he was employed.

@OP, have you created that FB page on your own initiative, or have they instructed you to create/maintain it as part of contractual agreement? Have you signed a contract with them at all? If so, are matters like this specified in it?

I'd say you likely got nothing to worry about, the fact that you're in different country makes it extra complicated for them, even if they had a good grounds to sue, which I think they don't.

Plus, if it was a case of trademark infringement, they could talk directly to Facebook and get that sorted.

I'm sure they're just bluffing. Thats too much resources, gathering their legal team to peruse a lawsuit. I don't think you did anything illegal.

If it is diverting sales, it makes sense to use your legal resources to sort it out.
You will be surprised at the extent to which companies will go to make sure their profits are not impacted.

Scare tactics. I recommend that you ignore anymore emails from them.

This is a huge company really, its scary. so huge i can't imagine what will happen. just to give you a hint, its a Singapore Real Estate Developer.

You should crosspost this to get better answers here https://bitcointalk.org/index.php?board=74.0

Thanks moved the thread.

If you are an agent for them, you must follow your agreement with them. Anybody can sue anybody for anything. The important part is who wins the suit.

Cool

i agree with this, you should follow their agreement but if you are not their agent anymore, then you don't have to be worried. i think its different situations. its like oh yeah i did this in the past, but now i am in present.

^^^ Just to let you know that I bet I can name the company. Took me almost two minutes of research to accomplish the feat.

Wait one goddamn motherfuckin' minute! Below, you claimed to not have enough money to purchase a domain name, but I can easily site various posts you've made on other corners of the Internet where you're helping folks to become successful prior, during and after the timestamped timeframe. What gives, Allen?

You need to come up with something unique, unless you want your blog to be dead.

Yes I do have a unique idea for bitcoin blog but I just don't have the amount to buy a domain. I do however have a blogger page as an alternative but I'm not sure if its going to help visitors trust. And i wanted advertisers on my blog as well so a domain may something i indeed need.

is it going to be fine to just have blogspot page?

oh you no no you got it all wrong. I'm not Allen of Trafficbroker. you must have read adzcoin thread to which I've investigated about thier scam and they dig the twitter post about trafficbroker. I bought this twitter account from seoclerks and it has all the post of it to which the user I've bought the account is from gfy.com. Trafficbroker is an adult adnetwork and has its own page as far as i know and i guess they own it themselves. Allen must have money, i can imagine a top adult adnetwork can pay more than $2K for its rep a month. and with such i can definitely buy a premium domain if i wanted to unfortunately i'm not allen.

Anyway, i didn't receive any email from the Singaporean company though but they did send one marketing staff to my office last August offering to buy the page. I responded that i will be taking the team's advice and i will soon reply to them. I was thinking of making them wait until they approach me again but seem like they stopped already.

I think the company can sue. After all, you're creating when he worked in the company belongs to her. And when you create a page you have used the company's name
