if the actor is prepared to pay the fee the transaction is legit, not spam.

There can never be "spam".

A "bad actors" choices an no less legitimate than yours. Also everyone is a mixed actor at best.

I agree. However, attempts to deliberately hinder the blockchain in some way should be considered nefarious. So if the so called "spam attacks" really happened, it fits this category...
