Sure - you can try to hit them with standard fraud charges/lawsuit like any other Internet site that defrauds folks - but proof is a lot more difficult when "the net" in involved.

If you can find a private investigator or someone who can get information on people, there's a chance you can track them down. Kevin Mitnick who is known to be one of the "most experienced" hackers in history worked as a PI for a time.
There is a question of whether information acquired without going through the legal process can be used in a court of law. Depending on how much was stolen, the best method could be to offer a bounty on a percentage of funds that are recovered. Like say if someone steals $20,000. A bounty could be offered for 10% of whatever is recovered. If $20,000 is recovered the person might be paid $2,000 of that. If nothing is recovered they don't get paid anything.
Lawyers work on that basis sometimes with financial cases where a good amount of money is at stake with no guarantee of it being retrieved. Its a good format to ensure that the only people who take the job are the ones who are confident they will be successful.

Scammers are committing a crime so they are liable to be charged in almost any jurisdiction, the problem is going to be to put an identity behind the crimes, you will need to make a research and try to find clues yourself, while there is probably a cyber crime unit in your country most of the time they concentrate in crimes that can harm people, like drugs, so you may not find a lot of support from them if the only thing you lost was some money.

Yes but it’s hard than any ordinary cases in a real word regarding scamming as the user might used anonymity tools to hide or used other bitcoin users information to be the pawn. But it’s better to asked legal experts that I’ve even know that they’re are making threads on Legal Section that you asked for advices at this matter. This might not sounds good “prevention is better than cure”, so take necessary step to avoid this kind of unfortunate crimes and to be careful.

There's a way but it's not going to be an easy journey finding out the real identity of those scammers. Are you referring to those HYIP's, doublers? You can use whois them and find the real identity of the people behind their domain. And once you find it out, you can suit them with any illegal charges and if you are lucky that they are living in a country that supports or does have law against cyber scams they'll be in jail.

I would say that this stuff would really be nearly impossible since scammers are using bitcoin we cant directly point out whose the one behind on that wallet address.If you are really serious on tracing them then hire your own investigator just like been said above and do the job on tracing but i would bet that he would really have a hard time on tracing out.This is why bitcoin is the best way to scam people because of its anonymity feature.

It is somewhat possible to track the information of scam website owners by checking whois reports or taking legal actions agains them so that legal parties can contact their domain registrars. However, cheators do not put their real info, neither they user real ip at registrations. May be there is still a way for experts to read their background info using smart techniques.

You can sue them up if you find on who are the person behind on those scam programs, but I don't see anyone has been sued yet since its near to impossible to track them up since bitcoins are anonymous and people can hide their identity easily on online scene.

If you want to file charges to those who you suspects cheating in the bitcoin industry then you should backed it up with evidence. I think they can be categorize under the cyber crime since the activities were done in the internet or online. But it would be difficult to track them since they would think ahead of it and already planned some countermeasures before they do such things.

Even if so, it will still be a near-impossible task to actually make the scammer pay for its malicious deeds. If you report anything having to do with being scammed on internet (doesn't even need to be crypto related), it's most of the times a waste of time since police departments don't tend to take anything seriously, the government itself is severely lagging behind in terms of IT, etc. It's not for nothing that internet scammers till this day still have more or less enough free space to operate in. It has even gone so far, that people don't even tend to report anything anymore when it comes to relatively smaller amounts, because it results most of the times in absolutely nothing. It's sad if you think about it, but that's the reality unfortunately.

Yes, you can report scam sites to FBI and maybe they can do something about it but it is long shot. Or if you have information about who they are you can put legal charges against them, and frankly that is impossible in most cases because you probably won't find any information about them.

In some countries it's illegal to invest in HYIP and Ponzi schemes, everyone can be arrested: investors, owners, promoters... If you have enough proof about someone you can tell the authorities. Anyway it's a hard task as scammers use fake names, addresses and even countries. In other situations the criminals find gaps on the laws that help them to avoid the punishment, like saying these scam schemes are mutual donation programs.

Its a cyber crime.I think that its very hard to take actions against such internet scammers since its very hard to find their identity.Even bitcoin which is pseudo anonymous has made it more difficult to find scammers.
We even recently saw Wannacry ramsomware issue,but still now the culprit has not been identified or punished.
Bitcoin not legalized or regulated in many countries would make it much more difficult to solve this issue.
Bitcoin being a decentralized currency has no central authority to take actions against bitcoin cheaters.
Bitcoin users should be more careful about their wallets,new websites and new offers.

Even there is a law against bitcoin cheaters or scammers, we can't take a legal action on it because it is hard to identify who is that person since the information you can get is not real because scammer always use different identity. And it is also difficult to get an evidence to prove the allegations. We just be very careful so that we will not become a victim of those scammers.

These scammers are most probably hiding behind proxies and using stolen Wi-Fi and registered domains with fake documents. It is not easy to find them and even if you do, they might be operating on the other side of the world. I exposed a scam in the Ukraine once and communicating with law enforcement on that side, were very difficult. {Language barrier} So good luck finding them and then getting them prosecuted.

This is how its just like to have some pointless actions if you did try to make such step because they wont really easily believe you if you don't have proper or enough evidence into a certain scammer which isn't know yet. You cant just give them a bitcoin address since it wont really be a valid thing.This is why bitcoin is a good vessel to scam people because of its untraceable behavior if you can able to trace out then your lucky but most of the time I do strongly believe and I'm 100% sure that you will surely fail. This is why once your coins are gone then don't hope that you would able to recover it back.

If you check the people who using vpn plugs that will some companies IP usually.

By the way, for those interested in going the legal route on this. In the USA last I heard the minimum requirement to have the FBI be involved is a minimum $15,000 in damages. The FBI and other IT cybercrime units are so backlogged with work I don't think they bother with cases under $50,000 to $100,000 in damages. More than 80% of businesses with an internet presence are breached. A good percentage of the time its an inside job. If its not an inside job the crime is often committed by someone living in a country that does not extradite nor cooperate with law enforcement of foreign nations. This makes it virtually impossible for them to be held accountable from a legal standpoint.
The success rate in recovering stolen funds through legal means is probably exceedingly low. Part of the issue is high cost of lawyer fees and other liabilities a person must take on to prosecute a case. I would be interested to know if anyone has successfully taken action against scammers. I remember there being scammers like "Moriarty" who were known on this forum who never seemed to be brought to justice.

I think all countries has a law for the scammers, here in my country many agencies are caught by doing scamming people and their business was forcing to closed and the owner got in jail. But in bitcoin there is no news yet that theres scammer got personally caught because bitcoin transaction is not yet tracable.

Of course you can charge that site with for scamming or fraud there are lots of bitcoin like that and most of them is cloud mining and hyip this are types of ponzi schemes the question is how to get an evidence in order to report that site. The solution is invest first a little amount of money of thst site and documents everything you do and present as proof when the site turns scam.

All countries in this world have laws against cheating that makes it illegal and you can of course take legal action if you were cheaten at a website. But your problem is that most of the bitcoin website cheaters operate anonymous and while you can also file a complaint against anonymous persons, in most cases this will simply not lead to anything!
That's true we can't take any action on the hackers and scammers because they know how to hide in the internet and the IP addresses of them also cannot be traced so if we complain also there is no use with that.So we have to take care of our money.So be aware of who you are paying make sure he is a trustworthy person,and in trades only trade with who use an escrow service because they are responsible for our bitcoin.Don't get cheated by the scammers there are many websites on the internet which most of them are scams so don't get attracted by the big offers.

If bitcoin is known to your country, you can still ask someone from the cyber crime division of the police or you can directly go with the FBI. I have always heard that scammers using BTC can be traced. Though someone once asked me what if they are making use of a VPN Security to hide their location and everything about them would it be possible to trace them? I still said YES, cause according to the stories I’ve heard they were caught by tracing the BTC address they used to carry out the operation. But if that’s not the way it’s been done, I believe experts has their ways of dealing with these kind of things.

Have you seen a needle in a garden?, that’s how hard to find someone making crimes in the internet(depends on what kind of scammers) because they’re are two kinds, the amateur (the wannabe hackers) and the professional (hackers/anonymous). But before tackling that the most important thing to do is avoiding them. The wannabes are the most easy to trace and can be lure to come out. But if that are the professionals, there is 50% chance of solving it but you need a much level professionals than the scammers to track him.

Yes we can take action, But it is not that easy to find Proof, Court will only justify if the evidence is correct and is Proven. Cheaters are always Their to harm and scam people. They are Known as Greedy Person. Taking Legal action also Needs legal Evidence and if they are Guilty plea. and most Important is to trace cheaters where is there Location and Identity must be known. I remember there was a thread in the Legal section, he claims to be a bitcoin attorney, maybe you can ask him, https://bitcointalk.org/index.php?topic=1724798.0There are already several discussions on that thread, maybe you can chime in or read the whole thread because it can be helpful to you if you really wants to pursue those scammers. However, I think it really depends on how much money the scammers took from you, if you think its really worth to chase them so by all means, get your money back and hire some online detectives and a attorney.

Apart from being cautious with our BTC we must take into account that if we want to punish these scammers, we can not be governed by centralized laws, since we are talking about a decentralized and global system, and therefore, the same network of cryptocurrencies should take their own laws and sanctions; It is something that should be implemented not only in each web page, but throughout the web, have sites to report these scammers and proceed to perform the relevant actions.

I'd like to ask: Was any action taken against Master-P for that big scam that he pulled? If any legal action was ever going to be taken against a scammer, it would be him. And to the best of my recollection, he wasn't prosecuted for anything.
I got scammed out of 0.3BTC last year and let it go. Not many people pursue scammers, unfortunately, but I'm not of the belief that nothing can be done. It's just that it takes a lot of work, and cyberscamming, I suppose, is hard to prosecute. But if the scam is big enough, they sure as hell are going to get caught. Remember Trendon Shavers and that big BST scam? He went to jail for that, as did Mark Karepeles for the Mt. Gox disaster. But these little scams? Nah, those assholes all get away with it scot-free.

For Millions amounts then it is possible for government to take action just like on what you are telling here about those past big time scams.They are able to be traced out.I dont know actually on how they did it but presuming that we can really take legal actions but for small time scams then they wont really waste up their effort.

Now all the wallets change the dynamic wallet address so identifying the btc is harder than before now.

Yes its possible and suing them will be a long way to do because they might be domiciled in another country and the cost of suing with the legal charges might even outweigh the damages you seek to claim. Instead of going the long route, the best is just to dentify where they are licensed, if its a legit site and take the following steps; 1. Write to their support to let them know your intention to go through the next step. If they didnt not respond, then move to step 2 2. Write a strong worded email to the licensing body and attach all correspondence that happened in step 1 and every other evidence that you have to show you have been cheated. 3. Wait for someone to fight your case for you. If response is not forthcoming, write another mail and copy every organisation that have to do with international activities then go to Twitter to call them out...

There is no control to takes part on the bitcoin users if they do any scam or cheating works. You have to check the moderators if you find issues from the forum people. For transaction related issues we cannot do anything still we are working in the decentralized currency. Most of them know how to cover their tracks and a scammer would be so stupid enough to let you know his or her real identity when he or she knows the plan of defrauding has been his plan in the first place. If anyone is greedy enough to fall for a site that no one is showing himself to be responsible for their funds, then they should be the ones to be blamed and there is no amount of lawsuit you can file except you know the person behind the scheme. Yes bitcoin cheaters were need to punish, but the questions is how can you do this? Because even how many people cheat in bitcoin it's hard to define those people do that. For example some people tricks in gambling do you have idea how they caught them? Also those people who have multiple accounts in bitcoin talk, do we define whose that people? It's hard to accused people especially if they have lack of evidences.

Is there any legal background against bit coin cheaters,who using scam sites for cheats people..
I guess there will be a system regulation on this matter in the future specially to those centralized cryptos!  In our country there is already case being filed for such scammer/cheaters who take away the btc and do not make payment etc. The case is going on and many people after hearing this are now coming forward and registering the case if they have being cheated . You can take legal action against such cheaters. It means legalization of bitcoin in your country is allowed? because in our country since bitcoin are not totally legalize, even you hacked or scammed if you have no proofs shown in the court. The judge will not go on your side, also if you have a little people and no influence justice is not going on your side too.

It is somewhat possible to track the information of scam website owners by checking whois reports or taking legal actions agains them so that legal parties can contact their domain registrars. However, cheators do not put their real info, neither they user real ip at registrations. May be there is still a way for experts to read their background info using smart techniques.
It would be an impossible task even for experts. If it was that easy, most of them would have been nabbed a long time ago. They know how to hide themselves from the public and since it has been in their blood to always scam, they would have studied how to always stay anonymous, no matter the trick anyone wants to use and that is what bothers me, if they can use all that time to always plan schemes like this, why can't they use it to do something better?

There are so many cases in digital world that are victims of scams, and fraud, but i don't hear somebody recovers all their stolen money. This is a big threat in bitcoins business. Because all of the victims has no assurance for recovery and to avoid the same scenario. We should be cautious in transacting huge amount of money.. Never entrust your account to anybody. Or visit unprotected sites.

To me in such scenarios taking a legal action requires a strong and proof evidence.. and do we know the IP's of those scammers because it's really a big threat (inevitable) to bitcoin, because is very difficult to recover all stolen coin and this will make people to self conscious.

Bitcoin is not fully anonymous so if you don't know how to properly use it, one mistake can give someone hints regarding your transaction and might eventually trace you. Did you know that coinbase helped the authorities tracked the alleged founder of kickass torrents? Apparently, It was discovered that one of their donation address is on coinbase. We're talking about legal action here so the forum's trust system is not enough to be able to raise something like that. Furthermore not all scammers has an account here as well as its impossible for us to confirm if a certain account really belongs to them. An account here doesn't matter if they're earning huge sums of money for scamming. The possibility is there but its honestly plainly low because: 1. Most local authorities doesn't even know cryptocurrencies the odds are they will not give a single care 2. Who will investigate it? How will they even trace it? Even if they pass it on FBI, the case should be huge enough for them to make a significant action. 3. Investigation will take a lot of time probably a few years or more and it doesn't guarantee a good outcome

In what country do you live? If people can take action through bitcoin cheaters, hackers and other criminals on the web. There is no single news about the stolen bitcoins from bitfinex and other exchange that has been hack. But with piracy there's a big support from the government and when it comes to bitcoin, forget about it since there's no information involved.

If you are willing to spend that much to hire professionals then yes, you can start by finding a good lawyer and from there they will advice you what to do and tell you how much you will be spending. If the payment to hire for this professionals is greater than the award or money you lost on the scam site don't bother. Just think of it as a donation to the scammer's family when karma hits them.

It can be done in two cases,first if the government see bitcoin as a currency , currently limited to few countries .so then you can hire lawyer and take bitcoin as capital gain asset claims.second if you know the the cheated party and have proof of it then also it is quite difficult as Bitcoin is anonymous and no direct link to its user unless it is held by third parties and kyc is done for holding.

This is one drawback of bitcoin, but I'm sure its just a small percentage of the total people who are using bitcoin in a good way. And unless you hire a private firm to track those suspected scammers, I would assume that there's no way to get back at them.

If Bitcoin is legalized in your country, you can call the police to report if you're scammed but you can't when it's not legalized yet. Beside Bitcoin is very secure and the transaction is almost anonymous so it's not easy to find out the scammer, the only way to find out their identity is their IP address.

Exactly! There is no way that we can take any kind of legal action and that too against bitcoin cheaters. It is because of the reason that bitcoin has not been declared as legal in most of the countries. There is no way that we can report to any government official regarding this. We have to be very careful by ourselves. There are number of scammers around us. Knowledge is the only thing which can save us. Yes, when someone hacked or we made a mistake leading to loss. It's lost forever, we cannot claim it somewhere or can take legal action against it. It's possible but it's pretty hard to do. I mean bitcoin is anonymous, it's hard to take legal action into it. If the amount that get scammed is over $100.000 it's worth to try though, get a lawyer on it. With all these been said, it doesn't work in some of these third world countries So they do get away with it
Loled at this but it's 100% true, here in my country even the casual case you can pay the police here to not taking you to the jail/court, against bitcoin scammers? it's like impossible to take legal action.

Straight forward and simple answer is a Big NO, as in normal financial issue itself very difficult to trace and punish. So to bitcoin users who ever cheated by others should not waste your time on chasing and finding also punishing him. Your bitcoin wallet has to be protected by your self.
There is lot of practical difficulties to take legal action against the bitcoin cheaters.

Exactly. Here in our country there are existing law addressing online legal issues but in btc cheaters i think there is no way to penalize them because you cant trace it as bitcoin is anonymous, didnt know the particular person and you must also have proof. Unfortunately with all that have been said its not possible.

You can only take legal action against a scammer if you have their real information, and a person trying to do something fishy would never use their real information as they know it can lead everyone to them. So it is quite not easy to reach out the ones who scam people in Bitcoin. But they can be found if someone tries really hard like tracking everything they used which might lead him to the ones behind the scam. But it doesn't really happen a lot in the community, and people forget and move on.

In our country there is already case being filed for such scammer/cheaters who take away the btc and do not make payment etc. The case is going on and many people after hearing this are now coming forward and registering the case if they have being cheated . You can take legal action against such cheaters. I don’t really get your point, so you mean even those that were scammed like many months (possibly a year)? How are they going to find those people?Though I do hear that scammers can be traced with the address they used to steal the money, but I don’t really see how that’s possible, I keep on asking myself how… it’s possible that they can sell/shift the Bitcoin after stealing, so if that happens, how do you then find them, by going on to catch the exchanger they sold to or what? Well, if your country is actually able to figure out how to catch scammers using Bitcoin, then it’s quite amazing.

I guess we couldnt track a person behind a profile whos primary purpose is to steal Bitcoin from others. Because Bitcoin transactions arent transparent, like we can do business without giving away a single information. But, maybe those computer wizard guys can track down the IP address of that scammer and provide evidence, then we could file a lawsuit against this cyber criminals under the cybercrime division. Still the best thing to do is be careful and secure and store your wallet safely.

Yes but that is a little difficult. Bitcoin is somehow being anonymous. Im sure the one who scams cover themselves onto fake ip addresses or codenames etc. Its a lot of investigation, but i know you can report them unto cyber crime police. Just be carefull whom you transact for.

Good thing is theinternet if full of information to how to check websites security or to just track websites that offer high yield investment return
Who would even want to go through all those stress when they cannot even know the identity of such scammers in the first place. It would require a whole lot of resources to even be able to pull that off and at the end may not even give a good or expected result. The best is for everyone to just stay secured and know what is legit or not. First of all who is he or she is the accused about Bitcoin cheaters..should to identity their and sacked from forum. But it is difficult to identify them. You can sue them up if you find on who are the person behind on those scam programs, but I don't see anyone has been sued yet since its near to impossible to track them up since bitcoins are anonymous and people can hide their identity easily on online scene. Who is lost him/her something, only he/she knows what it is. Please protect them.

They do everything to look as legit as possible, so unless you're going face to face with people when it comes to sealing deals, you'll always be exposed to the risk of getting scammed, and there is nothing that you can do about it aside from using an escrow when possible. The internet is a massive pool of opportunities to exploit for scammers, which gives them quite a bit of freedom to utilize their scammy behavior....

The answer to your question depends on the country of jurisdiction of the scammer. If the scammer lives in a country where cryptocurrency or any form of digital currency is not yet regulated or has no laws governing it, then there is nothing you can do to prosecute them. The only chance you can file a case against scammers is when they starts converting the digital assets they stole into fiat or any form of national currency and withdraws it.
Now, in addition to not having regulations as a hindrance, finding a scammer's location and identity could also pose a problem. As other members already pointed out here, scammers may hide using different IP addresses and make use of fake identities. If you have no idea of who they really are, then it becomes an impediment to the opportunity for you to file a legal action against them.

I was scammed once here and it wasn't nice at all, what could I do? Nothing, I just opened a scam accusation against that member, others supported me and marked this guy with red trust and that was it. People can hide behind bitcoin, making new wallets, mixers, exchangers, all of then helps scammers to stay hidden. I didn't use escrow and that fucked me up, so protect yourself as much as you can, I don't think there will be some regulations in close future.

The judge will not go on your side, also if you have a little people and no influence justice is not going on your side too. Not only in a lot of the countries the bitcoin Is now being legal and I wish if I could see how fast the bitcoin is being legal in a lot of the countries and this is the reason why the bitcoin is getting the value and the bitcoin is now being famous I hope the bitcoin will give all the people the real value and the valuable price on the other hand the bitcoin is getting famous day by day so soon it will become the legal currency. It all depends on the country in which you are living. If your country has declared bitcoin as legal currency, then there are chances of this thing that you can take some kind of legal actions against the one who is using bitcoin for some kind of illegal activities or anything like that. You can always take legal actions against cheaters or when you were scammed but that depends on the country you live at. If you are talking about something that is done in an online transaction you will need a lot of evidence. Stealing is another case if you want to retrieve what has been stolen from you the best and faster way is to get help from someone who can retrieve it for you without going through any lawsuits.

Yes there is, and every country have their own cyber crime control units which takes action against those scammers after you file a case or complain against them. But you should have any valid evidence to prove it. In most of the underdeveloped countries cyber crime control units are not much efficient that's why many scammers and cheaters are stealing users money easily through fraud.

Agreed, The most important thing which will help you in understanding this thing in a better way is the role of government. If the government has declared this bitcoin as legal across their country, then there are likely chances that you can take some kind of legal actions against the one who is cheating in the world of bitcoin. Otherwise, it is not possible as bitcoin is not recognized as legal currency by most of countries by now.

For the countries that has really regulating bitcoin, it may already be legally enforced and applied for onward, and we can report it to the government. But for the countries that hasn't really regulating bitcoin, of course to take legal action for the perpetrators (scammers), I think it will be stuck and hasn't been entitled to report it to the government. To report it, I think it takes cooperation between one citizen to another citizen who has really regulating bitcoin.

No, there is 0% probability for cheaters to be tracked down in bitcoin network until you have right proof their identity. Keeping in mind that bitcoin is still anonymous, thus its highest degree of anonymity doesn't leave any private info behind transactions. Although, i like these features in bitcoin as bitcoin wouldn't have such a huge value if obviated decentralization.
