If it was a class action, it would be different, however the only person who will get paid in a class action is the lawyer.
this is very tru.. only the lawyers win with a class action.. this new development is disturbing to say the least... I was really holding out hope that HF was legit and moral, just late.. If indeed they do not send me my baby jets by tue. I will be requesting a refund of my btc. Just to get the ball rolling on the trollfest that is about to ensue here.. this is the quote from my email Hi Jim, Thank you so much for your patience while I got the answer for you, I greatly appreciate it.
The answer is if you buy Baby Jet for 51 BitCoins today and it does not ship, you will be refunded the 51 BitCoins you paid.

Each block is stacked on top of the previous one. Adding another block to the top makes all lower blocks more difficult to remove: there is more "weight" above each block. A transaction in a block 6 blocks deep (6 confirmations) will be very difficult to remove.

Excellent precedent for all the lawsuits that hashfast will be getting into. The order amounts should be small enough for small claims court, easy for anyone to do. I would hope you can provide the entire email for verification in the future by other peoples lawyers etc. Get your complaints written up people, submit them to the FTC, AG, FBI Internet crime center, etc. don't bother with bbb, they don't do anything to help but pester. Edit thanks for the edit. Discovery in a lawsuit will reveal that they sent that email, deleting or altering their records will end the case for them quickly, if they are stupid enough to destroy evidence.

Now that you guys who paid with BTC are (predictably) in the same boat as us guys who paid in USD (i.e. at best you can hope for USD value back), is there more willingness to cooperate in making demands of Hashfast?
It seems to me that you can:
a) stomp and rage and try to get the same BTC back, probably just huffing and puffing here or, at best, winding up in court, or;
b) accept whatever deal Hashfast decides to impose on you (i.e. keep bending over and taking it), or;
c) all of us work together to force the bastards to release more and faster hashpower under the MPP to all of us.
I have been advocating greater cooperation for a while. But this BTC refund issue has gotten in the way.
I vote for "C". And I think we should contact all of the customers (we have their e-mails), and as many of us as will join should collectively go to Hashfast and make demands. Agree among ourselves on a position (say, 8x MPP by 1 March), sign a letter together, and then send a delegation to San Francisco (maybe D&T, if he would volunteer, to head it) to sit down the management and have a little chat.
I think "C" is really the only option for those who don't want to bend over and who are not truly prepared to sue for BTC refunds. And, of note, I see no reason why engaging with Hashfast in this manner now would impede anyone's potential ability to allege fraud in a court of law with regard to to October delivery or the terms of the MPP at a later date (well, reasonably close later date).

My little point of view: This company is made of scammers that are there to scam. Full point. You won't be able to get anything out of them using good manners. You need to get a lawyer and go to litigation against them. We can't even get a sincere information about the performance of the chips, hell.
People who paid in USD paid in USD, i think that they are lucky because now they can decide whatever to get a full USD refund or the miners. People who paid in BTC will have to go trough endless pain to get their BTC back. And from what i understand, not many are ready for that.
I think that i will go on against them legally with a tiny group of trusted persons. It will be 1 guy that i trust and i've know for a long time and maybe another user of this forum, if he is willed to accept it (i don't think so).
I also think that WE need to find a lawyer willed to take individual actions for every customer. It will be a lot of work, but worth it. We need to defend everyone with small orders, they can't be left on their own against the Giant (David and Goliath, you know the story, right?).
WE need to cooperate. But we also need to proceed individually AND in group if we can't individually against this HF.

first off all! to everybody! DO NOT accept the procedure according the HF email! Confirmation that you understand USD order totals that were originally paid with BTC can be refunded in BTC at the USD to BTC market exchange rate on the date of refund.
it is a agreement and if you sign it HF is on the save side! the only goal of HF ist to get as many customers as they can to sign this. request a full refund in BTC with market exchange rate on the date of order if you paid in BTC! do this immeditaly after 31 Dec if they fail to deliver. accept NO OTHER agreement and let them know this fact!
