Once that all of this is over i will do a few frames with some of the posts in here.

I am batch 2.  They told me I can get a refund Feb 1. I posted this back a few pages but as the deadline gets closer I would rather just have my funds back.   

We have received your request for a refund. You are batch 2 customer with guarantee date of January 31st. If you dont have your order with you by that day you are completely entitled to request a refund.

I think they're waiting until they've mined enough coins to profit before paying any refunds out.

did they use pre-orders to buy KNC miners?   with what are they mining with?

Not quite - you can sign that right away, and you often do when you build a house on spec, buy a high-end car, get something custom manufactured etc.

It ultimately comes down to a contract dispute in such a case.

Not on  a retail sale preorder. Also, nobody signed that right away. They had an obligation to notify customers of the delay and offer refunds if requested, not put their own limits on those refunds. Read the FTC rules quoted oh so many times in this thread.

I agree that nobody signed that right away in the HashFast Batch 1 case. They introduced a TOS after the fact etc., so not even a question. However, Batch 2/3/4 may be less clear because there was actually a TOS with specific delivery dates that people agreed to.

I'm just saying that the law doesn't blanketly overrule a specifically signed contract to which both parties agree (again - NOT the case here).

I am sorry to  inform you that "a company" may have abandoned their customers and the requested refunds (on your terms) after their acknowledged failure to deliver (in writting). It is regrettable.

There will be no refunds, now disperse. You signed away all rights to a proper BTC refund.  <fires tear gas into the huddled customers>

yep you are right...the law is on your side ...no way to enforce it though with bfl as an example

 and I know of 3 people off hand in forums and chat who have WON against BFL in small claims court and got nowhere as an example...
also others and myself have tried class action suit etc..paypal fraud division executive committee...etc etc

the common response form attorney general of Kansas and county attorney county bfl is in Kansas and FTC and BBB (no power BBB) etc to
folks who waited 1 year for their stuff is...(wait for it...)

"well you got your product late in 9 months or 1 year so why complain to us about it?" "you got your product go away"

also the class action suit with a lawyer was the same thing...."you got the product eventually right ...we don't want to do a class action with you"

so BFL and now Hashfast can play the system easy......if they won't enforce because you EVENTUALLY SHIP SOMETHING ..then ...well BFL anyway you are off the hook

HOPEFULLY you will not see this soap opera played out with Hashfast...but looking more and more like same  record playing different song...

I expect to see this same game played with BFL's monarch card probably next oct 2014 at best imho

The only exception I've heard of is some folks in Europe using EU law ..but they may have won not sure if they ever got paid....

also heard from folks that as soon as they sued...they got something sent from BFL if they accepted it.....well then your stuck

some who sent BFL stuff back in usa  who refused to accept from UPS...later..had to contact bfl months later to ask for it shipped again because of ftc/etc above not working out (they we're further humiliated to do so)..so better to get the doorstop then nothing in that they could not get a refund

anyway .I and others have beat this dead horse if you find someone with better results let me know (and yes mine went to the paypal exec committee that looks at fraud and was turned down the paypal rep I talked to said it was a flood so after 45 days paypal washed hands of bfl and such ..too messy imho)

anyway what do I know waiting for my 8k of 'forced to upgrade' to my 'unwanted" 900gh of monarch bricks arriving sometime oct 2014 I would imagine...but it was better then 90gh arriving about thanksgiving ..brick then brick later for the monarhs I'd imagine


so hashfast COULD get away with all of the above....BFL sure did....as to not to watch a repeat of this with you guys wish you the best...just saying what the law says on asic miner don't really apply if they can treat you getting the miner 9 to 12 months late like a regular consumer product.....

I can give you guys a quick update.
We have received several test units that worked well, so we know that HF has the tech ready to go.
Q.E.D., i'm probably right about who the last 4PH are from.

AFAIK they first publicly announced that they had an actual hashing chip over two weeks ago now.  They could have been lying to get more pre-orders in.  Or they could have thousands of chips hashing by now.

So they've assembled a handful of test units? What happened to their ability to ship thousands of boxes right away? KnC didn't have any trouble assembling and shipping all of their orders within a few weeks of receiving their final silicon.

These guys obviously knew they wouldn't be able to ship on time. That's clearly why their TOS said they didn't have to ship until the end of December (or whenever) Now they've blown passed their own self-imposed deadline for refunds and they're just ignoring their own requirements.

It seemed pretty obvious these guys were super shady when they started trying to get people to send them $500k without even giving them the specs. Too bad scammers like these guys and BFL soaked up so much of the bitcoin from early miners. If they refuse to pay refunds in btc they'll essentially be stealing about $50k from people.

Dont suppose anyone has any home addresses for hashfast staff, castro and john's would be good id even take erin's, dildo chicks (amy). they will be helpful for the police reports im filling.

So permit me to speculate a bit...

Batch 1: Approx 500 Baby jets @ about 500GH/s ea... (Assuming 1 GN/ea)
Batch 1: Approx 500 Sierras?? @ about 1500GH/s ea... (Assuming 3 GN/ea)

That would be a lot of roughly 2000 Batch 1 GN's @ roughly 500GH/ea= 250TH/s...  HMMMMM!!!
