Ive asked around where best to start discussion on an ongoing payment failure by an otherwise seemingly successful ICO: https://www.herocoin.io/
 This thread is for the discussion of missing tokens from a ETH token ICO fund raising that occurred.

Partipants were promised payment and after the ICO had closed, terms were introduced to exclude some.    No tokens were paid and no ability to resolve the problem after 14 days was allowed for.     Suggestions have been made such as Bitcointalk forum itself be paid these tokens as a charitable donation if KYC legislation prevents proper payment to individuals as was scheduled.    

Iam a legally valid individual, registered to vote and able to prove my identity.   Shortly after the blog posted below I passed KYC at Bittrex and can easily do so with any financial institution yet HEROcoin refuses to pay what it had promised during the ICO.


I'll do what the ICO failed to do and update this opening post and thread title as more participants are able to contribute their information on the ongoing failure https://www.herocoin.io/

Missing publicity payments outstanding debt:

           
  Hanif2020 - 30,090 PLAY tokens  - unknown reason for non payment
  Rabbot - 4850 PLAY tokens   - company refuses to pay anything based off KYC  
  Bravetheheat  - Unknown amount - was asked to wait for payment before being told deadline for payment had been passed
  STT   - 21000 PLAY tokens - told payment would be made, checked spreadsheet details and OP for any progress in payment.  Exchanged messages with campaign manager without being told of a new deadline. T&C left unchanged
    
                                                                               



I'll update this for everyone and keep a ledger on the 2nd post ok.   Add the main excuse you received for non payment by HEROCoin.io






Please post information more then anything negative or insulting, obviously we are disputing that KYC can be used to permanently excuse a company from paying tokens allocated.   I will be raising this as a general issue in the industry to show it as poor practise and exploitative action by HEROcoin.  I do own this Token and do not think this was a positive move by the company and this is the point of view I start this thread, I only want reasonable discussion and information on the missing allocated HEROcoin (PLAY) Tokens please.

       Post up screenshots, as much details as possible.  Literally I want a public record of allocated tokens going missing, so its self evident what occurred.

Bounty ended, the final spreadsheets were calculated.
When it's time to pay, the team announced: in order to get paid, you must agree to the new rules. They are: you will receive less than we promised and give us your name and address.

I sent them required personal data (name and address) and got an answer that they are not eligible. I suggested to update them, but they refused.

I declare these people scammers.

We got to post as many details as possible to make this completely clear what happened here.  The main thing for this thread is to keep the wider crypto community updated on the failure to pay and ongoing negative policy by this company towards normal community members.    Value could have been resolved charitably and/or towards this forums costs but that option has so far been ignored, that alone says alot and I want it to be recognised more widely.


Post up screenshots, as much details as possible.  Literally I want a public record of allocated tokens going missing, so its self evident what occurred.   I'll be putting in my own details of course, any suggestions for organising this campaign for justice would be fine also.     No other company runs their KYC as HEROcoin have done, anything relevant regulatory or legislation wise, accounting or anything regards to ICO failing to respect participants you spot in the news is good also for context to the argument.    I appreciate you staying active on this Rabbot and anyone else who had their tokens go missing would be good also

Then herocoin.io announced here https://bitcointalk.org/index.php?topic=2141510.msg24042823#msg24042823 [1] that you can claim bounties.

You complained after 20 days: https://bitcointalk.org/index.php?topic=2141510.msg25114691#msg25114691 about it.

Bon3s90(herocoin team member?) told you that you are 2 weeks late to claim bounty https://bitcointalk.org/index.php?topic=2141510.msg25130340#msg25130340
And then you asked where it was stated that you need to do KYC https://bitcointalk.org/index.php?topic=2141510.msg25181246#msg25181246 and it was stated in [1] link.

It was announced here https://bitcointalk.org/index.php?topic=2116864.msg21664642#msg21664642 that all unsold tokens will be burned, and bon3s90 said here https://bitcointalk.org/index.php?topic=2116864.900 that unsold tokens were burned and also here it was stated that you can claim your bounty https://bitcointalk.org/index.php?topic=2116864.msg24181122#msg24181122
And somewhere it is stated that 99% participants claimed bounty rewards.

So, how did you miss this announcement? You were waiting for tokens and you didn't read 1)bounty thread and 2)ICO thread?

But in case you missed it bounty manager should have contacted you, like my signature manager contacted me because I never read bounty thread and if he hasn't contacted me I would have been kicked out of FJ campaign. SO I understand.

I agree that this information should have been written in bounty topic but there is nothing you can do now.
Tokens were burned, at least they claim that they burned tokens. You were late to do KYC, that's it. Nothing much you can do here.

The debt is ongoing and unresolved, internal accounting doesnt exclude Tokens that are still owed.  There is no company that can excuse itself in this way, either they are being very careful to be lawful or they are disregarding payments so which is it
The company could have paid a recognised body like Bitcointalk if they denied individuals, thats what makes this especially negative action by the company.   There was a payment due and it was disappeared within 14 days without proper warning of disclosure.  
There is a reasonable expectation of payment that has not been met or even addressed.


This post was the 6th with actual details not available till later and I asked on the 24th and was told by the COO I had failed to apply more then a month ago, but those dates dont match.   So even the company itself didnt realise the correct dates.

How hard is it to go back and fix a mistake made, are we to believe all matters were done in perfection on this ICO or that in a rush some miscommunication occurred.   I'm only asking that it be resolved reasonably


The announcement of new terms for payment was made within a 170 page thread.   At the deadline approached, no update or attempt to communicate at all was made to the bounty thread.  No changes to the OP  opening post, thread title, payment and contact details sheet were made to reflect a serious requirement had been introduced.
  I asked why they could not use their company forum members to contact people on the forum but the response was the forum itself would ban them for trying to contact people via PM.    Only if 1 person alone sent all the PM do I imagine that is true, I do think the company has failed to be reasonable and is callous with regard to this crypto forum and the community in general.

The problem is not that I think they set out to not pay participants but they are callous about the consequences of the fast ICO launch and have no interest in that tokens were allocated and not paid.    Bittrex introduced KYC and I didnt realise as again they didnt contact individuals, they had my contact email but never let me know.    However the difference is Bittrex later allowed KYC to be passed, they didnt set a blind hurdle people couldnt pass in time or disappear my claim.

How hard is it to edit the Opening post of the HEROcoin ICO or the Bounty thread, I did check these regularly.   This is how forums work but HEROcoin have treated the crypto community with disregard I think, they dont consider proper use of a forum a valid point.      The reason I wont let this drop is because the forum itself deserves a donation and there is no KYC that excludes them even if I dont get anything there is a basic requirement that the ICO pay back those who helped.
Also the crypto community overall has some oversight of misallocated tokens like this,  no other company operates KYC measures to confiscate in such a short term time without ability to resolve problems.  
Also if HEROcoin is going to keep treating people like this, with a bad attitude towards fair payment and resolution.   This thread should be a record of failure to communicate, to distribute allocated tokens and a warning if nothing else.

I believe KYC here is just an excuse to pay less. They left undistributed tokens to themselves. This is the motive to exclude more participants.
Their questionary is not the real KYC, it's a fake KYC.

I ask a question about when can we get the bounty, some dev team member just said to me that I need to wait for further info. After a long time waiting, they said I have already missed the bounty since I haven't claimed, the problem is that there is no entrance for claiming token on the main thread. That's an obvious excuse for a scam project I think. I see a lot of people haven't received bounty too, dev team intends to skip bounty.

I know very well from the Austrian community that HeroCoin did all important steps as a company to have a token that fulfills all Austrian laws. Furthermore they have been the first „big“ Austrian ICO and they worked together with several tax and general lawers.
The KYC part is important according the law.
Do some deeper research and you will find out, that this more legit than several others.

In other words, you say that they hired people and when the work was done they said that it is impossible to pay because of Austrian laws.

Yep I understand the company wanted to field KYC on participants.   The main problem is the amounts due disappeared during this process, KYC legislation doesnt require this.  It was a self made company policy.    The legal part is justifiable but not that the ICO failed to pay out allocated amounts due.

If individuals cannot be paid for whatever reason they could have helped pay this forums cost, a variety of charties could have been credited as recognised institutions, any number of options besides disappearing allocated tokens could have been taken.   Bitcointalk as a host to the companys campaigns provided services and with a successful ICO a payment could have been justified.

   Instead they used participants to gain free advertising on this forum and elsewhere and value promised in payment for this disappeared. There is an ongoing reasonable expectation to payment that will not be resolved until HEROcoin addresses it.

  No company can permanently excuse itself from debts using KYC legislation in this self appointed way, I'd like to see an example of that legally occurring in Austria, USA or anywhere.   If the company wants to operate legally then thats great, I'm glad to hear it and I look forward to this issue being resolved.

If the company continues to be unreasonable in its operation of KYC legislation then I ask participants on this thread state their case in a better way then the company managed.   Maybe HEROcoin was rushed, I can understand mistakes but so far no attempt has been made to correct any mistake.

Thats similar to what happened with myself.  I was in contact with the campaign manager for Bitcointalk HEROCoin's operations but did not hear of the newly fielded KYC documentation requirements until they had decided to stop answering requests.  No attempt was made to communicate via the manager, surely a basic point to any company operation.  I checked the forum, the thread regularly but unfortunately the Bounty thread was not updated in the week before the deadline.
  There was a failure in communication, again I think it was rushed and people did not get paid because of that rush.  I dont believe thats ok to forget any ongoing debt.  I put a screenshot below:

If you can post your own information of the Tokens amount due and you're participation similar to what you already posted during the Bounty we can bring this debt to bare so long as everyone updates this thread regular, it will improve the ongoing case with HEROCoin ICO Token allocations.
Please stay reasonable in discussion, I dont believe any of this was malicious and this kind of mix-up is one I've seen previously

After they published the results, I found no accruals for the signature.  I tried to figure it out and wrote a second letter asking them to review the charges and add my earned tokens for the signature there. As a result, they did not understand me and excluded me from generosity.

TL;DR
HEROCoin.io allocated ICO publicity participants PLAY Tokens for various bountys set.    After ICO closes a new rule for KYC information is now required within 14 days of 6th November or they refuse to ever pay.   Thread rules not updated to show KYC






The ICO campaign finished in October and in November 6th onwards they decided in order to get payment people should pass KYC regulations.   The payment spreadsheet never showed KYC was now being required of everyone listed, I double checked I had entered my correct ETH wallet address.   Maybe it was forced on HEROCoin.io by their government  but my complaint is they failed to pay anything to members allocated tokens after just 14 days of allowing people to submit details.   They didnt even update the OP or thread title to tell people.   I had no clue I must submit my ID or whatever and others were caught up trying to pass when a deadline passed meaning over a hundred didnt get paid I estimate.   HEROCoin.io dont answer their emails now

I asked them to consider paying Bitcointalk the forum.   This place costs money to run, give them my tokens.  Its a recognised KYC passed establishment but they refuse to pay the tokens allocated and continue to consider their own actions just the law requirements.  I can pass KYC no problem so its nonsense either way.  I'm not going to let them use forum members like this and I'm part of their customer base also, I bet on the Esports games they talk about for many years.
I'm signed upto HEROsphere.gg as of October, they have my email that way or its on my forum profile.   The company just after the deadline when asked why they do not use the forum responded this forum would ban them for using the PM system to ask for KYC information so nobody on this forum was told directly they would not be paid.    They have multiple accounts and managers on this forum to send PM if they wanted.

When you add details, can you PM any personal contact detail you feel comfortable with.  I will keep that offline in my HEROCoin case details.   Just so this forum isnt our only point of contact, to get solutions this is going to take alot of leverage and time but I'm confident we will have an ongoing debt to collect.

Of course we want a solution ASAP.  This is going to be the case of the tortoise and the hare.   The company drew a fast conclusion in 14 days to not pay us for not passing KYC.    I'am not a criminal nor will any democratic country and its laws support that presumption and confiscation of tokens.      
We are going to have to assemble a slow case why this company was wrong in its actions.    Then show the use of KYC against participants was unreasonable and not in line with legislation, that is the current excuse.

I'm sorry I dont have an immediate or fast solution, the company wont be reasonable and does not respect our right to argue currently.    Many companies act like this, I have seen many companies fail to realise they hadnt followed guidelines or respected individuals and refuse right to the end.   Thats how its going to be.


I want to start a Petition,  I'm going to keep it really simple if thats ok.   If forum members can suggest wording they think best and then we can start to gather signatures from around the crypto community to show support in this case of missing ICO tokens.    

At the very least I expected HEROCOIN.io to pay a charity or this forums costs, if you disagree at all with that say now because I would settle if I saw the company make any attempt to resolve the problem.   Right now HEROCoin/HEROSphere.gg think we are of no importance, I dont think they respect crypto community overall and KYC is a common reoccurring issue so it should be possible to garner support.
  KYC problems arent going to go away so we might as well stand our ground and make sure no other company tries to disappear debts after 14 days.   If the community doesnt disagree now it will be presumed consent to repeat this incident

Tokens were burned, at least they claim that they burned tokens. You were late to do KYC, that's it. Nothing much you can do here.
Unpaid tokens were not burned. HEROcoin team appropriated them.

HEROCoin is quite capable of paying, they have plenty PLAY in reserve but are just choosing not to pay at the moment.     The main fear stated is of violating KYC legislation, if this was genuine then value could be directed to a recognised body.   However this option was never considered.  I respect the company operates in EU and must deal with regulators, we may have to appeal to those regulators in due course regarding this failed debt so this will not be a negative I hope but makes payment long term more likely.
Alot of time has passed but since PLAY isnt even in proper operation yet so its still very good reason to pursue the missing tokens.   I even hold some PLAY myself and I believe apart from this 14 day rush the company is likely to do well.    I've held similar royalty type tokens back in 2014.

I do need more names and details of non payment of ICO tokens.   Its possible action to recover lost tokens can be taken and certainly I dont think the law supports a company wiping a debt clear forever using KYC as the reason.   Its too open to exploitation and profiteering to allow honest business to operate in this way.

I have updated the 2nd post with various peoples lost tokens but really I would like to see far more register.  Over 100,000 PLAY tokens owed I think would be a good target and make collection for all of us more feasible.
In any case I will not allow this failure to go ignored and I think it is a mistake by the company to treat people like this and believe the law would support wiping out a debt in 14 days without ever altering the original Terms and conditions stated.   Any company could make an easy profit if it were allowed to just forget a bill due.

I will also open a wider campaign for proper operation of KYC.    I'll follow up with this once I have a petition ready to sign

I believe KYC here is just an excuse to pay less. They left undistributed tokens to themselves. This is the motive to exclude more participants.
Their questionary is not the real KYC, it's a fake KYC.

I know very well from the Austrian community that HeroCoin did all important steps as a company to have a token that fulfills all Austrian laws. Furthermore they have been the first „big“ Austrian ICO and they worked together with several tax and general lawers.
The KYC part is important according the law.
Do some deeper research and you will find out, that this more legit than several others.


I hope it is more legit and we can find they pay their debts like every other company.    Not allowing people to pass KYC after just 14 days is not part of any wider law but just a decision made by the company unilaterally.   There is an ongoing debt standing by any rational process, unfortunately so far they are unable to deal with people left unpaid.
