Did you order from KNC Avenger?
No, I ordered from KFC?  Huh

Mega bucket meal, super sized hash browns.

Am I in the wrong place?

(N.B. Silly question gets silly answer)

If my order is still "In Progress" on the 16th, I'm demanding a refund. As far as I'm concerned, they've violated the terms of the agreement they set forth. Difficulty is going to explode as other companies start shipping units. If they're confident in the profitability of their units, they can mine with them themselves.

So KNC would need to have produced about 350 units since I started this thread yesterday if they are going to meet their 15th October shipping pledge.

Care to share how many you did produce today KNC? Care to update your customers? Care to give us a revised schedule, based on the fact there is no fucking way you will ship all units by the 15th?

Or based on your how you've treated your customers up to now, let me guess - this is how it will work:

13th rolls around, no updates and you ignore all your customers (as usual).
14th rolls around, no updates and you ignore all your customers (as usual).
15th rolls around, no updates and you ignore all your customers (as usual) and they start to get angry.
16th rolls around, no updates and you ignore all your customers (as usual) and they get angrier.
17th rolls around, no updates and you ignore all your customers (as usual) and they get even angrier.
18th rolls around, no updates and you ignore all your customers (as usual) and all hell breaks loose?

Still nothing from KNC.

Let's talk about compensation. KNC have a legal contract, to ship ALL units by 15th.

If they fail to do so, then it's only fair they compensate their customers who are not mining because KNC made a promise they couldn't keep. Put your money where your mouth is KNC.

The data centre people got BTC for delays, so miners who get their unit shipped late deserve BTC to compensate for the delays in getting started mining.

We are losing BTC = compensation in BTC.

They claim on their website the Jupiter is 550GH/s machine, so at that speed, can currently mine 1.5BTC per day.

I think 1.5BTC per day late is fair compensation, until the next difficulty change and that figure can be adjusted.

Not long now KNC. I like the idea of another form of compensation rather than a refund, because I would still like to get the machine.

I think they have no choice but to offer BTC compensation. The Sept/Oct orders cost more than the November orders, but November is getting very close.

So those peeps with a November order, when are they going to Jump in and cancel their orders because it could be December delivery for them.

I'm sort of confident I could request a refund under Distance Selling and the EU Consumer rights Directive (up to and including 7 Days after receiving the goods), but don't intend to play that card until I see how the Next 24 Hours play out.

It seems a very exciting news. But it's still the shipping day, and the days it takes to arrive is another thing. Difficulty is ever rising. Hope this gets a good ROI.

They will never ship all the orders before the 15h of October : https://bitcointalk.org/index.php?topic=249065.0
Those with no shipping day are, only now, having their order status changed to "In progress".

Agreed!

"In progress" is not delivered. Not even shipped!
I will ask for refund if I don't get my "2nd day" order before 15th.

FYI  it doesn't switch to shipped until you get it in your hands.   Check your inbox for UPS email more than KNC website... you'll get tracking number next

Well I have emailed them as of 11:00 am UK time.

My order has been sitting at in-progress for a full 7 days.

I have requested the following.

An accurate indication on shipping.

Compensation for the delay (as they have already set a precedence for hosting customers).

I also informed them of my rights to request a full refund under Distance Selling and the EU Consumer Rights Directive.

Will post their reply (if and when they do).

Excellent. They need to be held to account for all the promises they made to drive sales.

Please report back with updates.

14th October, KNC Customer Service still sending this message (from main KNC thread):

I just received this as a response to a enquiry:

We are still on track with mid-October production and you will receive a UPS tracking number as soon as your order is ready.

Should you have any further questions please do not hesitate to contact us.

Thanks
Emilia

Also, very interesting, from main KNC thread:

It is really easy for anyone to prove that the DETERMINING FACTOR into their purchase was the KNC statement posted on frontpage on their website that the orders will be delivered until Oct 15th. If KNC knew they would be late, that would mean they intentionally used false information in order to increase sells, which could probably incur really high fines or other penalties, going to criminal charges against company execs and their business licence being revoked. If they can prove they were really expecting to complete deliveries by Oct 15th and did all due diligence to accomplish that, they'd still have to compensate customers and/or fully refund their orders.
KNC is in no position to play fool now and they better choose their words VERY carefully when communicating next time with their customers.
