i ve saved the old News form AT - and the discussion into the Forum too while im banned - but to this point more at an other time

we think we know there are at this time 2 different types of vipers - perhaps a 50mhs and perhaps a 250 mhs - formally known as 90mhs and 18 mhs (?)

no today Comes the News that Shocks the whole customers - a part of it is Manual like a how to use - its opening as pdf-file but made with MS Office 2007

the Advantage of MS is that to every file ever made there will be some data left at the file if you are not looking at it (it can be an advantge - but this i wont discuss here)

A further point on alpha being legit or not...and I did have this conversation with alpha 2 months ago or so

IF alpha really gave a damn about customers they would allow you to apply their "non-refundable" 30% down ..due to their
actions/problems to a 'future device' ....it would suck but from their point of view (if they believe they will survive as a mnfg)
why not....it would free the funds up with less controversy for their current units (company is able to survive) and
as such that $$$ could be applied to next product

but they too think it is all gonna go belly up....can't even give us something as weak wristed as that .....as a PR stunt

nope they are circling the wagons for the lawsuits that is where our 30% of the product payment is going ..er that
and making at least a few products before having alpha corp take the fall in bankruptcy to protect their personal assets
and fight the 'scam/vaporware allegations"

they don't even believe in themselves enough to offer even the above lame option as a 'toss back' to customers

you sir are likely correct

but just to be difficult and show the wishy/washyness of where to hop??? on all this?Huh


 (or at least buy only pre-orders for the newbie "hungry' ones)

as an example GAWminers for NOW anyway .takes DIRECT cc orders (no paypal) and offers full refunds up to 14 days before shipping AT THE MOMENT

then again KNC etc all start out OK customer service wise..but give them a FARM and it all goes to pot

but yeah some pre-orders like above AT THE PRESENT TIME may have enough protections...but imho

likely at this late date as miners....we all likely should just punt

www.coinbase.com and just buy coin...I mean with elec use vs price/return in btc or alts for the equip

price for alts/bitcoin better go up proportionally to mining difficulty or we are all screwed anyway

Their current terms as of July 28th they have changed the miners specifications back down to 18MH/s and 90MH/s, as well as reintroduced negative clauses.

This is the good one, they left the doors open. If power consumption will be to high they may downgrade the devices. Please remember that Innosilicon 28 nm chips use a bit more power per Mh than Alpha 40 nm chips. One could say, genius design of Alpha-T. But wait, they even couldn't pass the tape-out.  Undecided

People quarrel about this September delivery in context of T&C but what can we read there? We HOPE to deliver Q2/Q3. Not we will. We f..... HOPE. This is a joke not T&C. One could say these are words only... but hey, they played that card before. Should, hope, expect, suppose.... blah, blah, blah.

As they have shown some old pictures and data in the update I think their course is following currently. Do nothing, produce nothing. In October refund few people that are still on board and paid 100%. Keep the change from those that "didn't qualify" for the refund along the way.

You have a copy of the original TC?

I really wish I did, but I don't. I do remember along the way though that they told us that we could get a refund at any time before shipment date, and my friend here seemed to save the Terms at the correct moment when it did indeed say that exact statement for their terms. As we all know it has been constantly changed and modified for the past 9 months, and it seems as if they did some bad copy pasting or older file pasting in certain sections, because the pdf my friend created and the screenshot he took is when he lawyered up initiated full refund requests and everything else.

With the proposed new delivery date these units will never ROI.

At that rate : You're looking at 380 days... but we all know that in those 380 the difficulty will rise so much that you'll have to shut the machine off because the cost of electricity is more than you make.  So in other words.  There is a 0% chance of us making our money back if the delivery date is Sept.

multipool owners constantly add new coins that are very profitable.......diff does not go up in a multipool

Oh now that's silly, that's sensible and took a thought process to determine. Stop doing that.. it ruins folks' reality and expectations.

Because difficulty of multicoin pools will never skyrocket with 9-20 petahashes coming online globally within this quarter...

Let me guess, increased hash rate/cloud hashing, possibly partial refunds if you choose to leave. Another ploy to squeeze out more money. Some suckers will fall for it but personally I wouldn't trust Alpha as far as I could throw them. They've already proven themselves to be a bunch of liars and thieves. It's not likely they've suddenly changed overnight.

By unbanning them it makes them look like the good guys doing everyone a favour, and curries gratitude from some of those they unban.

I like their use of unprecedented in that post. What was unprecedented was how many of their own customers they were banning from their website.

It's a sign that they're feeling the pressure. The threats of legal action, the potential backlash, while they're afforded more time. What makes these promises any more guaranteed than their last promises?

You, as customers, should be demanding that shipping date in their T&Cs, and if they don't comply, then be able to be refunded. Empty promises are just that. Words.

Alpha Tech just posted a new announcement and have unbanned everyone that was banned.

This happened less than 24 hours after I pointed out to them that they were breaching a contract. Here was my email:

Dear Alpha Technology,

I notice that I have been banned from your forums (DRCR), and for this I want to thank you, since after consultation with my attorney, I have now been informed that since you have broken your contractual obligation, that means I am due a full refund of all payments to you.

Perhaps you didn’t understand that we had a contract, (an offer, acceptance and consideration) but let me give you an analogy to explain.

Suppose you owned a Toyota dealership and a customer came in and paid one-third deposit on a car, do you think you could legally tell him not to come back to your dealership or to speak with your staff or other customers? You couldn’t, not unless you severed your contractual obligations by returning the deposit in full, whereby you would be free to do whatever you wished.

Your forum is your dealership, it is one of the only means of communication that your customers have with you, your employees and other customers, you had a contractual obligation to me, you can’t therefore treat me any different from any other customer, because that is discrimination. If you just had an open forum on any subject, but did not take payment for any goods you would be free to ban anyone you wanted, but unfortunately you are selling a product and after taking payment you have contractual obligations and these were broken by you.

Therefore, within 48 hours I am expecting a full refund of all deposits paid to you, which is 405 British Pounds. If my deposit is not returned to me in full they I will be forced to proceed with this matter.
