I have noticed, that the judicial system of the developed world is inefficient.

How can one judge decide who is right and wrong? Based on their mood?

I went to court today to listen to a few cases. The judge is not fair. The judge is not unbiased. They give judgment which isn't even the focus of the actual case.

Today I heard that someone accused another person of stealing his property. Then with all the evidence, it is clear the claimant was should have won. But the judge said that because the way the claimant handled the case, even though his property was stolen by the defendant. He decides that the defendant have won.

I mean WTF??? Shouldn't the case focus on the handling of the property. And not how the case was handled. If the claimant is a lawyer than he will handled things differently. But how can the judge say that the defendant won, even though without a reason of a doubt the defendant stole the property, and he still win??

Should we design a new system which judicial system can be more fair? Like how we are changing the way of transferring money, like bitcoin?

The system is inefficient by design.

"It is better that ten guilty persons escape than that one innocent suffer" - http://en.wikipedia.org/wiki/Blackstone%27s_formulation

It's painful if you see the bad guys get away but its the price we pay for freedom.

The alternative is one where credible educated people can get you thrown in jail by going to court and lying.  The requirement that guilt be proved beyond all reasonable doubt is that there be overwhelming evidence. People really do lie.  The system is designed to deal with that fact.
