Why no USA? Forks and airdrops are perfectly legal in USA.

No airdrop. Too many conflicting laws and regulations in USA. Until courts / congress formally declare clearly, we will not assume that they are legal in USA. SAFT contracts, once thought safe, are currently questioned and repackaged into security tokens in USA. Yes, there are many regulating agencies in USA: CFTC, SEC, IRS, FINRA, NFA, FinCEN, States. If the issuer gains something of value (marketing, better exposure etc) by forking, ICO, faucet or Airdrop involving USA entities, it is subject to laws of USA. We cannot afford to assume something is legal just because others have done it. At the same time, we can't afford to hire an army of lawyers in USA.
 
Cryptos are not completely legal in USA. In fact, only two things are absolutely safe for USA persons:

• Dealing in cryptos on licensed crypto Exchanges in USA for personal use
• Earning cryptos as inheritance or compensation for work done

Why no USA? Forks and airdrops are perfectly legal in USA.

below was the information from the whitepaper:---

A. Claiming Bitcoin RM coins
1. All users, except those subject to the jurisdiction of United States of America, who hold at least 0.001 BTC in their wallet are eligible to apply to receive forked coins (Bitcoin RM coins) on a 1 to 1 basis. User must have a wallet that supports signing messages with his/her private key. Users subject to the jurisdiction of United States of America are not eligible, regardless of the amount BTC he/she holds.
2. The user must provide his/her valid email address. It may take upto 7 days to review and approve claim application. The team will review and approve claim applications but reserve the right to refuse any claim application for any reason. Optionally, the team reserves the right to request additional information before approving application for certain claimants.
3. The team will provide a window of at least 60 days to allow all eligible Bitcoin users to file a claim to receive forked coins.
4. The approximate date of snapshot of Bitcoin blockchain is August 20th. Bitcoin RM smart fork will go live after 7-10 days of the snapshot date.

• After claim deadline passes, left over coins in the Claims Fund will go to the team. The team will then use those for furthering its mission (roadmap), paying for Devs etc.
• It is likely that we won't be able to stop USA persons from circumventing our eligibility rule by using proxies or other techniques. We will be on the right side of the law and cannot be charged in all such cases of fraud or circumvention
• We will explore all options available to us, that are reasonable and do not infringe on privacy of others, to see how we can prevent fraud or circumvention. We all really need to collaborate and discuss what we can do to better protect from such fraud or circumvention. What do you suggest?
• When a USA entity circumvents or otherwise tricks our system and obtains BCRM coins, that is theft. Those coins would have gone to Retail Merchants and those planning to launch startups in USA itself.

If the claimant is subject to the jurisdiction of USA, we will not approve that claim, no matter how many bitcoins the claimant holds in his/her wallet. If the claimant has any presence or residency in USA, then he/she is subject to the jurisdiction of USA. A significant number of Retail Merchants and startups will be from USA. So, we are not really isolating it! USA is a very important market for us.

If the claimant is not subject to the jurisdiction of USA, then he/she must have at least 0.001BTC to be able to file a claim. About half of all BTC addresses hold below 0.001 BTC, yet all such balances add up to only 0.01% of total bitcoins!

The last piece we look at is whether the claimant provided a valid email address or not. A valid email address is required to consider any claim.

Bitcoin RM is the first smart fork and it is really uncharted territory if we have to commit to a narrow processing window for each claim. We may need to request additional info if we suspect fraud or unusual activity, or we may need to pause claims for an hour or two to verify that all of our systems are secure or we may need to slow down claim processing if mining is too slow. This is why we are giving ourselves a wide processing window of 7 days.

We will not arbitrarily harass, deny or delay any valid claim. Doing so without proper justification goes against our goal of connecting with community and furthering our mission. So, please do not be discouraged by all the crazy sounding rules... those are there to protect all of us, the Bitcoin RM team and its community of users and merchants. We want to be transparent, honest and involve the community as much as possible. That is why we started this Pre-ANN, rather just final ANN on the day of forking
