Our organization as an incorporated company is gathering informations in order to make a legal class-action against Cryptopia on behalf of Gunbot users that have lost their funds at Cryptopia. I will post on our forum detailed instructions. The service is totally free for Gunbot users , if any not Gunbot users wanna join (assuming we are talking about serious cases with proofs of lost funds) you are welcome to message me or one of our staff.

Doesnt worth as much imo since funds are already gone but still Cryptopia owners are a legal entity and if any kind of responsibility is proven by a court, they are liable.

Forming a class action would be a great initiative, especially to those who are affected. Even though it would be hard to recover the lost funds, they should be at fault, and Cryptopia needs to be responsible for that. I am also posting in here to see further development about this topic.

Update: we got availability from some NZ Gunbot users to file our class action and put our lawyers in contact with a local firm. It is important to collect cases from you all as the sooner we file the sooner our cases would be part of the official police investigations.

Thank you, I wish "luck" helped all those users indeed

I dont think justice will prevail as funds in crypto are even less recoverable than stolen fiat funds but I think we need to start to actively fight idiots that come in cryptolandia thinking this is Mayberry and they can just plan an exit scam at anytime. Maybe this is not the case of topia owners but still I consider them liable for the lack of responsability in securing their environment. The robbery continued for many days and even after a police report and an investigation was going on, they still continued to leak coins from those servers. This is something we cant condone.

We received a form from the local police to fill as an attachment to our report. As a personal observation: this is not the kind of form you can compile anonymously, they ask for real names, addresses, phone numbers, amount of stolen funds and such. Please take the more harmless decision for you between your anonymity and the possibility to recover funds and PM me if you are still interested. There is the possibility to submit the form directly to NZ police without having to pass me your personal informations and still being a part of the class action. I'll provide more info in PM if requested.

Have you contacted Cryptopia first? Coinbase is insured against theft/loss of bitcoins so it wouldn't be unimaginable that Cryptopia is insured as well. Could save you a lot of hassle.

My thoughts if I may is Gunbot 's legal representatives would have to establish if Cryptopia were trading while insolvent last year after the 100 51% attacks. That would then guide who (the company or the directors) is ultimately accountable for damages or costs Incurred.

It may be worth reaching out to any other class actions who have similar desired outcomes.

Cryptocurrency users try to reclaim funds from hacked exchange

https://www.radionz.co.nz/news/national/380264/cryptocurrency-users-try-to-reclaim-funds-from-hacked-exchange - (Archive)

7:21 pm on 16 January 2019 Matthew Theunissen, Reporter matthew.theunissen@radionz.co.nz

Quote
About 40 people have come forward to try and reclaim their investments with the New Zealand cryptocurrency exchange Cryptopia, which crashed this week after being hacked.

Police have started investigating after millions of dollars of digital money disappeared from the online exchange, but people who made sizeable investments during the Bitcoin bubble fear their money may be gone for good.

On 13 January, $US3.6 million ($NZ5.3m) was transferred from Cryptopia to an unknown digital wallet.

The following day its website was down and concerned investors left in the dark, except for a brief statement that said there had been a security breach.

It is not the first time digital currency investors have been anxious about money they were keeping with Cryptopia, which is similar to the way money is stored with banks.

Christchurch lawyer Clive Cousins was approached early last year by investors who didn't know what was going on with their funds.

"We were contacted initially by about three people, including a South African lawyer, who were complaining that they were having trouble transacting using their wallets and couldn't withdraw funds."

Mr Cousins said a further 40 or so people have since approached him with an eye to launching a joint lawsuit.

He said Cryptopia's success may have contributed to delays in processing transactions.

In 2017 the company claimed to have 30,000 users around the world. This increased to 1.4 million by January last year.

The lawsuit has stalled due to a lack of funding, but Mr Cousins said his clients still wanted to know what was happened to their money.

Cryptocurrency consultant Josiah Spackman said one of the problems with Cryptopia was its focus on lesser known digital currencies, which meant not as many eyes were monitoring transactions as with currencies like Bitcoin.

"Because they were often the exchange that people would go to for these lesser-known currencies - these up-and-comers - they got a bit of a reputation for that and they did in fact grow quite significantly from that.

"Unfortunately, as a result they've had these other coins disabled. So once you purchase them you basically can't get them off the exchange."

Mr Spackman said it could difficult to track down those responsible for the hack.

"It is effectively like a bank holding the funds for thousands, tens of thousands, hundreds of thousands of users. And they are basically tasked with keeping it safe.

"The problem is it's easier to hack a computer than to physically walk into a bank and take gold and silver."

Police were today seen at Cryptopia's offices on Colombo St in the Christchurch suburb of Sydenham but no-one from the company could be reached for comment.

Adrian Przelozny, from Sydney-based cryptocurrency exchange the Independent Reserve, said crypto exchanges were natural targets for hackers but attacks were becoming less frequent.

"Smaller companies grew very quickly and they perhaps didn't have the controls in place to manage the amount of client funds they were holding."

A Christchurch-based investigation team is being established and includes specialist police staff with expertise in this area.

Police said they were liaising with relevant partner agencies in New Zealand and overseas.

By next week, Cryptopia claims to give us access again in read mode. What does it means:
1.- you can check your actual balances
2.- you can compare those balances with your latest Gunbot's json file (if you dont know how to do that, you can contact your reseller or one of the our support staff members at Telegram)
3.- you can have the exact situation

Once you have done this, please PM me: our lawyers gave us a form to fill and send them to collect the most details we could. The collapse of Cryptopia has severely damaged investors, especially investors who hold Electroneum (ETN). Previously, ETN's main Cryptopia is exchange.

We are now able to login at Cryptopia again. Please compare balances you see there with your latest state.json file saved in Gunbot json folder:

1.- open ANY pair state.json file with a normal text editor and search for "balances": you will find the list of your balances at 14 of January 2019
2.- compare what Gunbot says with your actual Cryptopia balances
3.- Write down any difference expressed in the given coin (Example ETH: 0.12, TRX: 15.99, etc)
4.- Save your transaction history from Cryptopia website, included deposit/withdrawals
5.- If you have open orders, export that too
6.- Export your wallet addresses from Cryptopia website

All of the above evidences would be important informations to submit to our lawyers.

Also to add: speaking with our lawyers they think there is actually nearly zero possibilities to recover any fund....

That's definitely looking more and more likely as each day that goes by without any news.
