Why would you need to create the casino with the same name of  "Missouri Belle " ? You can create the casino with any other name and have no fear of trademarks etc.

Secondly do you have funds to open a casino ? Marketing can be done cheaply and effectively if you hire good marketing manager.

Well, that is a bad idea. Never do that thing, even here in the forum we had strictly follow the rules of not to do copy/pasting and you should always aware of the copyright law that might OP facing when he/she got trouble. I think there will be a problem since you wanted to create an online casino with the same name as the casino you mentioned unless you have their permission to create one under your management. The problem is they might ask for a percentage of the profit you earn. Well, you can create same as missouribelle tupe but different name.

Running legally, you will face several issues.

Running unlicensed, just for fun, you won't.

But I don't see why would a gambler will use your service if it is not complying with the common and usual gambling terms. Basically, a waste of time building a site as I'm sure no one will use it. There are also chances that your site will be reported and it can detect you. If you truly believed that it's not an issue, you are free to do what you want.

I guess you would at least tell missouribelle that you would name your online casino same as theirs and also if you do make marketing then be
sure that you should at least put a disclaimer that you arent the same or connected with missourabelle that they have known physically because
we wont know if there are people who would have thought that they are just the same or connected to each other.

In terms of legal aspects, i dont see a problem on here.

1. Missouri Belle is a fictional casino, a subplot in the newly-released season 3 of the fictional TV series Ozark.
2. OP is asking if it's legally OK to use the name of a fictional casino.

I don't know, but I suspect all you need to do is to check if the name is trademarked. Otherwise, I don't see how anyone could sue you for using a name of a place that doesn't even exist. It'll be like making a Slytherin school.

If you are planning to go for an online casino, then what domain name would you select ?  As missouribelle.com is already in use, you cannot use this one.
Its better to open up your own brand name, rather than copying someone else brand name.

Usually fonts, color combinations in logo, graphics can be subject to copyright.
The options I see are:
1. ask them if they allow you do this
2. do it and be prepared to pay if they find out/ask/start a lawsuit
3. make your own from scratch with proper designer and such and make your own advertising

You have to have quite some funds for any of the cases and the only advantage I see for your idea of copying is to target the audience of that series as customers for you. I would not be so sure that many of them would come to your casino just because of this and this could cause you troubles [see #2] quite early.

no he didnt say he will copy everything or copying the exact name but he said he wants a simillar one  . i assume he  was referring to the promotion which was aired on tv and on youtube  . about the funds , yes he have a fund because he was planning to create a casino but his funds could be limited only  . no problems can be experience as long as he dont copy the overall site but to be aired on tv's isnt easy and not cheap  however youtube is free but will be tough too to get attention if he dont have a proper gambling channel  or simply dont have a big user base

I think it is better if he is aware about the copyright. Even though he will not copy the name of the fictional casino, still he want to copy the features of it. There will be a conflict especially if he created similar to Missouri Belle Casino. And also how do say that he has enough money about creating a online casino? There are many expenses in creating online gambling so it costs huge amount of money. 1-10 btc is not enough especially if the goal of the creator is to be part of the top gambling casinos.

Not really copy the features, I actually don't have any idea about features of the fictional Missouri belle casino besides the game slot and poker.  I did talk to someone I tried to make partners with about it. I can only promote the casino myself so I'm trying to come up with a good concept of marketing and this one just Ozark casino came. 

Creating a casino could be just easy actually since its just a script to be installed in the server, I think its the marketing and security that is hard to maintain. I could be wrong, I have no experience yet so I'll just leave this thread open so see more of the suggestions.

You can come up with the marketing but taking and absorbing the idea of any enterprise that's register, you'll commit such violations and I think you are aware of that because you are asking this.

Compare the example of those copyrighted music & videos that didn't actually look like the original which they've based their content. But still, they violated copyright infringement because of the registered trademark and content similar to what they did.

Maybe you will not face a problem at the beginning but if you site grow, you will surely get notice and your business future will be at risk.
I guess the right thing to do is just to start on your own brand, I am sure you are familiar with the forum and how to advertise here, so maybe you can start here.

It takes a lot to open a casino per se.If you go and copy some name of some other company you can risk to face legal consequences and trials.Better to stay away from that name and if you are decided to open a casino read through this section here in the forum as there have been other threads which addresses the issues you may encounter when you open a casino.

No matter, how much the marketing is done, when you create a new casino, you will need customers and require marketing for that. If he think only the brand name will work without any marketing, then he is wrong. Only the name is not the success of any project. You need to work hard constantly to make it successful.
