You are absolutely correct on this. If there's someone that needs to take action on such situations then it is the investor himself.
These influencers don't care whether their followers are getting scammed and losing their money or not.
All they care is about their reputation and. the money they get for this. We can't take away their money but we can surely harm their reputation.

All we need to do is spread negative comments about that influencer with proof about him being involved in promoting a scam campaign.
The internet will do the rest and that influencer will lose his reputation and will think twice about promoting a scam campaign ever again.
Just like what happened with Akshay Kumar when he promoted Vimal pan masala.

The weird thing about social media is, even the negative publicity can be useful for them, People will talk bad about them for short term but these fame will help them to reach more places so they won't really care if someone tried to expose and it went viral. Legal action is the best case to deal them, atleast a few of them getting punishment will be a wakeup call for the millions of influencers. Getting paid and promoting anything should be a crime too.

We have already seen so many incidents of famous people on social media getting their reputation damaged due to their misbehaviour.
Akshay Kumar was wise enough to acknowledge the damage and did a damage control by immediately calling off the contract and asking for public apology.
Yes, taking legal action is also a good option but then we will also have to take the trouble of going through the legal process.

Big celebrities' cases can be a little different but influencers with less than million followers may get more positives even with negative PR and the most common thing found among the people is they just forget everything over few months so they will just get back to them with another scheme or try other ways and can go on forever. That is why some kind of punishment or even losing their social media accounts can be appropriate if they are found to be involved in that part.
