A friend of mine wants to know. What if her non-citizen spouse cashes out the BTC in a territory with no capital gains tax and then buys something like a house on behalf of them both or in his name only? Can the IRS cause any problems in this scenario?

Tax evasion is a serious crime. This is a common ploy by someone whose spouse isn't a US citizen - but if an IRS audits you, it can mean trouble.

Tell her to stop trying to be clever and try to find tax deductions instead.

Best to ask somebody who answers these types of questions for a living instead of random people who can only speculate
