Order was granted to continue to stay Homero's SEC case. But look how short it is.

Now what does that mean? Was his lawyer begging the  judge "just a couple more weeks please" or did she ask for 30 days, 60 days and the judge is pissed off now and only gave them 2 weeks? If she requested this short period what does she know about the Shinner's case? Either she begged for this short time in order not to piss him off, with the intention in two weeks to beg again if necessary, or the judge has had enough. Not much use to Homero if that is the case.  Cheesy

This fraud was made possible by the cash and the references he made to being backed by Fraser.  If Fraser was not in the picture he would not have pulled it off.  He barely pulled it off with his help.  I'm guessing he had an allowance for being Fraser's sex toy.  The business advice was just offered as a part of the friendship.

You're a victim of Homero Graza (court case #) and have been monitoring your (the SEC) case religiously since day one and note now that since a second case (Shinner's Civil Suit) recently came about, that you (the SEC) seem to be continually accepting Homero Garza's requests for extensions. There are many of us who anxiously await justice but cannot help worrying whether you will ever prosecute him. Are these two case related? These continuous delays and extensions seem to appear related to this civil lawsuit currently underway. Is this the normal course of action for the SEC, to accommodate a defendant in a private lawsuit while thousands of victims sit awaiting justice from you on our behalf?

Something like that Cool ...basically what the fuck are you people doing, thousands of us lost thousands of dollars and we were relying on you to do your jobs representing us in seeking justice, yet it appears nothing is going on and you're blindly accepting his bullshit lies and keep giving him an extension everytime he asks for one.

I am a victim of Homero Garza 3:15-cv-01760.  I lost $1500 in the hashlet scam orchestrated by Homero Garza, Stuart Fraser and Gaw Miners.  I have been monitoring the SEC case since day one and have noticed that there are continuous extensions in this case that coincide with extensions in the civil lawsuit brought by Allen Shinners and his attorneys.  I may be wrong, but this appears to be the case.  There are many more victims besides myself that would like to see justice in this case.  Is it normal to delay a SEC action to in order to ascertain the outcome of a civil case?  I am just confused by all this and would like to see my money returned as soon as possible.  Any information you can provide would be appreciated.


Like I've said before.  These things can take 4 to 5 years sometimes.  I heard the Obama administration did things to speed these cases up and prosecute more cases but it doesn't appear to have helped in this case.  I doubt the SEC is going to show me their hand, but it is probably good to at least let them know I exist.

Family friend did a very similar scam about 15 years ago.  Google 'nutrition super stores.'  It got him a slap on the wrist and a $100,000 fine.  I just don't have much confidence any money will be returned, but that would be the ultimate satisfaction for most people.  Nobody probably cares if he sits in prison for 5 years.

If there is punishment I don't see him ever paying back even $100,000.  If he had any cash he has socked it away somehow in bitcoin or with his relatives accounts.  His buddy Stewart might cough it up if he doesn't somehow get sucked into the SEC investigation.  The best punishment for Homero probably is prison time since he has already spent all of the stolen funds.  If he had the ability to pay back I think that would be a better punishment and outcome for everyone.

I don’t know, finding a middle way to pay people back would be a better way. We have seen this big scamming at mt.gox where they “accidentally” found 200k bitcoin under the couch or somewhere Cheesy If courts just send him to jail that means the investors lost their Money and josh stays in jail for 5 years and get away with millions of dollars.

I am almost sure that he must have some cash saved up somewhere after this much scamming. Where did all that money go? I think scaring him with a bigger deal and than make him accept paying back would be better.

Agreed!

There won't be any funds returned, even if Garbanzo pays a huge fine, which he'll spend the rest of his life avoiding.

5+ years in prison would be a good start, IMHO.

Got My Response

Dear Mr. xxxxxx –
 
I can assure you that the SEC case was not delayed by or because of a civil case brought by Mr. Shinners.  The reasons for the delay in the SEC’s case against Mr. Garza are confidential, but that delay is at an end.  Yesterday, Mr. Garza answered the SEC’s complaint and asserted his 5th Amendment right against self-incrimination as a result of a criminal investigation by the US Attorney’s Office in the District of  Connecticut.  The next step in the SEC’s case against Mr. Garza is that the court will hold a scheduling conference and the parties will conduct discovery.
 
The SEC has also filed a motion with the court seeking a judgment against the two companies we sued, Gaw Miners and Zen Miner, in the amount of about $10.3 million.  We are waiting for a decision from the court on that motion.  If we obtain the judgment we have requested, we will attempt to execute on that judgment and find assets that still belong to the companies to distribute to the investors.  At the moment, we are not aware of substantial assets to return.

Nice personal reply from her. Was expecting, if there was going to be a reply at all, some canned response.  Good you got your name in with her, can check in once in a while to see what is going on. She surely must be aware Shinner's is ahead on getting a default judgement against Gaw and Zen, posted the court notice a few posts back.

Wasn't expecting Homero's response at all, though what the hell can he respond with against tall those claims from them. Is the AG a new thing? We knew all the alphabets were interested. Does this encompass that? When did the AG start their investigation is the big question. This shits been going on since 2014, they have to have started in the same time frame as the SEC or not? If so it must wrap up soon. Someone I got a bad feeling they started real late for some reason. How much more time do they need to investigate, SEC wrapped up their investigation ages ago. So why Homero's delaying then if he was going to pull the 5th all along. Maybe working out a plea with the AG?? Double sealed extensions, can't be family matters which I originally thought or as we know now not to be correct, related to Shinners. That is good to know it is not influencing there case.

Strangest thing out of it all, this would probably kill someone, 3 prong legal attack. But Homero's such a fuck up he's probably relishing all the attention. Monster SEC been breathing down his neck for years now, and now knowing, an even worse one in the AG and criminal charges, then Shinner's prior to switching side. Great pity he's so dense the pressure of it all simply seems to roll of his back. Even if he does go to jail he'll still think he is a success "look ma I made it" Bernie style.  Roll Eyes  Problem is now we are stuck, how the hell do we follow the AG's investigation.  Maybe in a reply thanking her you can ask her, if the AG started their investigation at or around the same time as hers, or is it fairly recent like with a year or so.  It can take even longer if fairly recent but go to think it had to have started around the beginning of it all. Not sure. I wonder if that original lawsuit kicked it off those 2 or 3 other guys who sued very early on (or what that Florida). So what happens to the SEC case if he pleads the 5th now? Seems to continue if the next step is discovery.

One thing is for sure now, Homero still got coin 100% for sure. 3 legal proceedings going on and that super high profile lawyer at his beck and call. Where the fuck is the money coming from for that.

Finally some good news. I like the sound of "criminal investigation". And yes maildir, the criminal thing is new, at least I was not aware of that.

Edit: since it's an investigation (not yet a court case) it wouldn't be public. So Garza pleading the 5th is probably the first time this could have been revealed.

Edit2: all these delays just to plead the 5th... it's almost as if Garza waited for a criminal investigation to start :-)
