I've heard mixed opinions in this area. Any educated opinions on the subject would be appreciated.

If it isn't legal, how are other sites operating without problem?

I think it does require registration.  retailers who sell moneypak cards are required to be registered with fincen and these retailers have standards they follow for kyc and aml.  moneypak is a stored value card and as such trading them in certain jurisdictions requires registration.  anyone selling moneypak for btc who has not registered with fincen is probably breaking the law.

why are they not caught? nobody has noticed them.  In time there will be more regulation and less wild west trading in the bitcoin world.  if you are seeking a registered and legal bitcoin -> moneypak solution check the website I built at:

I was noticing that you can sell gift cards for cash.  Isn't this the same as selling Bitcoin for cash?  Is FinCen coming down on these guys like they are on Bitcoin?

yes.  in America selling "money value transfer" cards requires registration with fincen and state agencies.  This is why drug stores limit the number and amount of "gift cards" you can buy per visit.

I already admitted just like the USB miners I don't have them in my possession ok. It was stupid of me to lie about that. I was going to use the money to buy the stuff and make a little myself on the difference.

In this thread the OP says NOTHING about these machines not being legit.  He "tried" to sell me one avalon in Austin Texas but refused to meet face to face in a bank or use JohnK for escrow.

I appreciate your offer but I think we are too far apart.  I've decided my buy it now price for an Avalon today is $15,000 USD. 

I am just not convinced they can pay for themselves at any higher price with the glut of asics hitting the market in the next 60 days.  What made 4 btc per 24 hours just a month ago can only make 2.2 btc today. 

The difficulty is going straight up.

I applaud new services.  I made one myself (in my signature).   But the anonimity of such exchanges is history.  The future of exchanges is embracing the anon-anonimity.  Exchanges must be registered and regulated as Mt Gox is learning, else you support terrorism.
