According to a business lawyer friend of mine, the FTC can request that a Chinese company's funds be frozen while litigation takes place. He also said that U.S. companies and consumers sue Chinese companies often, and that they have decent success.
 
I personally haven't considered it yet, but if someone is willing to organize a class action suit, I'm sure plenty of people would be willing to join.
 
I wish BA understood that all they need to do is tell everyone what is going on, and agree to a good compensation plan. I'm positive this would make many customers happy and willing to wait a bit longer. ( The compensation would need to be at least 3x at minimum, but they have the equipment.)
 
If they don't act soon I'm sure we'll see legal action begin. I just hope BA isn't waiting for that to happen before they start delivering.

If they were going to boost compensation, they would have done so long ago. It's just a stall tactic to keep people placated.

The minion products are a total loss at this point. All customers have been screwed. It's time for BA to own up to that fact.

BA has upgraded their customer post deletion bot; it now scans the thread several times a second looking for customer posts to delete.
 
At least they're efficient at that.

That's something else they have in common with BFL, along with the criminal past of the company founders.

When will this be completed?  When will my orders be sent?  It's been almost a year now. How did you expect this to have come together in February?  Are we getting some 14nm chips in these for compensation?
The 14nm chips are merely a figment of someone's imagination at this point.

I just sent my report to the HK Police - it took all of 5 minutes. I didn't report to UK Action Fraud because I'm an early customer and wired my money directly to a HK bank. As the BFL smackdown shows, if enough people complain, the authorities have to respond at some point.

If you're a BA victim, you don't have anything to lose anyway, because they are refusing refunds and only slowly ship now-worthless (or even exploding) mining equipment.

That's not going to happen because of the gag orders they're all subject to.

But given Josh's proclivities to give everyone a quarter and invite them to buy a clue at the slightest sign of unjustified criticism, don't you think he'd be out on every board, barrels blazing, denying the "rumors" if they weren't true?

Instead, all that is offered is a promise to check the "very persistent" rumors, followed by Schlock locking the thread. As I stated in another thread, that is anything but a denial.

I just received in the mail the Prospero X-1 that I requested a refund on several times over the last several months. It showed up and I said to myself, "Son of a bitch, it's here. I may as well cut my loses and use it." So I took it inside and plugged it in. After plugging it in and setting it to the right pool/worker I noticed it was running very hot. I examined the outside of the box and noticed that the fan was not spinning. I figured, maybe it was being obstructed by something, so I disconnected it and used a paper clip to manually give the fan a little push. It spun around fine, so I figured it must be a fluke and that I should try it again. So I plugged it back in and was immediately greeted by a loud pop and a shower of sparks. I'm repackaging the device now and taking it back to UPS to refuse delivery and have it shipped back to minersource. You now owe me a full refund plus the cost of shipping it back to you. Just be thankful I'm not trying to sue you for personal endangerment.
That's just the kind of quality control we've come to expect from BA through their warm and cuddly X3 line. Nice to see they're consistent, at least.

I saw the website but did not enter my information. More scam concerned than anything; never received a tracking number and my store account still says "processed".

Who did you order from? If you ordered directly from China or from the UK, you have to expect to pay customs duties.

All the same, in your place, I would neither pay nor accept the shipment, because it's tacit acceptance of their delivery. Their miners are already obsolete before you even plug them in. No sense in throwing good money after bad.

Did you try to downclock it? It can work at 0.5w GH. at 40 GH/S total Consumption about 25w, if you remove fan and LCD as well place smaller fan like 20 x 20 mm it will be even less. Best i got was 19 W per 40 GH, and it worked without fan. Just don't forget that you can ruin PSU without any cooling applied.

Guess some people never heard about remote access. You can access X-1 remotely and don't need to have it on hand. Figure the rest if you are so good at assigning titles.

They claim they have no money to issue refunds, because they spent all the funds on parts for the purchased miners, and those exploding power supplies don't come cheap.

Yet if you request a refund, they offer to send you minion (ASIC) chips instead. Makes you wonder what they're going to do with all those parts they bought if everyone elects to get minion chips. Knowing BA, the chips will probably explode, too.

BA promised to refund people in April. They haven't and have stated that they won't.
BA promised to ship miners that don't explode. They do.

I received my X-1 today. And now the fan doesn't spin up.  Angry

After several months of waiting the only thing I can do with it is playing some Android games.  Undecided

I saw on their forum that sometimes the fan connectors are installed backward.  try flipping it.


Tried it already. But it didn't work. The fan is definitely broken. I connected a CPU fan to the connector on the X-1 and it spinned up. Then I connected the X-1 fan (some Cooler Master 200mm fan) to a motherboard as chassis fan and nothing happened.

You should complain! The unit is obviously faulty!

Let us know how that RMA goes.

I think the only way I will get anything back is by selling it on ebay. Even then it will be a loss. As energy costs are quite high here in Germany it will produce even more losses when switching it on.

40GH earns you $2.18 per week at the current difficulty. You pay just over half of that in electricity at current German prices. So not making a loss, correct, but no chance to break even either. A couple more difficulty increases will kill even that meager profit margin.

Thanks to BA's eternal delays, not a single customer will ever have a chance at breaking even on their purchase price, unless the price of BTC skyrockets again.

Their manual upgrade virtually guarantees that the miners will no longer explode, in line with their promise.

They never promised the miners wouldn't short out.
