Dein Vergleich ist zwar lustig, hinkt aber sehr. Bei grünen Ampeln weiß jedes Kind, dass man rüber darf. Ob man steuerfreie Einnahmen aus dem An- und Verkauf von Bitcoins dem Finanzamt zur Überprüfung der Steuerfreiheit gesetzlich melden muss oder bloß freiwillig melden kann, weiß hier hingegen offensichtlich niemand mit absoluter Sicherheit! ich habe das ganze nur sehr zugespitzt formuliert das Ergebnis ist aber das gleiche du musst nur das anzeigen was zu versteuern ist dazu bist du als steuerpflichtiger verpflichtet edit: kommst du der Anzeigepflicht bei zu versteuerndem Einkommen nicht nach und das FA beweist dir anderes machst du dich natürlich sofort der Steuerhinterziehung strafbar |

D.h., der Fiskus muss die Besteuerungsgrundlagen feststellen. Das kann er aber nicht ohne die Mithilfe des Steuerpflichtigen. Und wenn der Steuerpflichtige seine Pflicht zur Mithilfe verletzt, dann wirkt das im Ergebnis oft so, als wäre er beweispflichtig.
