They would have to allow for shipping address changes. What if people moved?

I have a counter offer. You can have your unit shipped to me, and I will set it up with my other miners. I'll keep 10% of the coins mined, and you keep 90%. I'll send them regulatily while you're wherever you are at. Once you're back, I'll ship it to you overnight.

Thanks for the offer. I've committed to selling for now, but if my buyers fail to come through, I'll definitely consider it.

If that is true, why would BFL refuse to confirm it here using their official account?  Sounds fishy to me.

It's possible that they're making an exception for me. I told them I won't be around to receive the order because of their delay in shipping dates, and asked if I could get it shipped to someone else instead. Brian from BFL replied and said this wouldn't be a problem.

We will use an escrow for this transaction, so worst case scenario: BFL refuses, your money gets refunded, and I'll just have to cancel my order with BFL.

PH deserves a scammer label for investing customers money into pirate and claiming it was backed by his own funds which turns out to be patently false in the case of Kraken fund at least. He deserves one as much as NcKrazze and others who did exactly the same bait and switch.

Of course, where is the evidence which indicates that?

The Kraken fund was supposed to be 100% backed by his personal funds. (Note to self: Why would an investment ever promise 100% backing of losses and still send you profits? What's in it for them?)

Well, as it turns out, there's no such thing as a free lunch.

An email was sent by PatrickHarnett two days ago to fund investors that the 100% backing didn't really exist. Since a large percentage of the fund was put into pirate debt, Kraken is now officially in default. The higher of 100 BTC or half the pending balance of each account has already been paid back, from liquidation of personal assets. This allegedly adds up to 75% of the entire fund value. There is still a promise that the remaining 25% will be paid back, if ever recovered from the "toxic" and illiquid assets held.

I'm not sure if the above email should be made public, but any of the Kraken investors can attest to the above. Even if the Starfish BCB issue is ignored entirely, I believe a scammer tag is appropriate purely on the basis of misrepresentation of the Kraken fund.

You should contact BFL and ask them when they're going to ship. I was told that the little singles were not going to be shipping in the first batch. I then tried to upgrade my order to a 1299$ unit, and they refused to allow me to upgrade it. So now I've got an early order that won't be shipping. I'm fairly pissed. Unless they changed this since I spoke with them a few weeks ago.

See this post. Little single upgrades will keep their place in line.

I have possession of one of the very first pre-orders (paid in BTC): #1693 (see list of pre-order numbers here). This will pretty much be in one of the first shipments going out from BFL. Due to BFL changing shipment dates, I won't be around to receive the shipment, and will end up wasting the most lucrative first 2-3 weeks of mining.

This was initially an order for 4 Jalapenos, but was converted to a 30GH/s Little Single SC. It's expected to ship by the end of November. US priority shipping has already been paid for. Conversion to international shipping can be done for an extra $54 (in BTC) over the sale price.

I'm now putting this up for auction. I've already checked with BFL if the shipping address on the order could be changed and they were fine with it. Minimum bid is 70 BTC. Auction closes at 23:00 PST on Tuesday, Nov 13, 2012. Please post bids publicly in this thread. Minimum bid increment: 0.1 BTC. I now accept bids in PM.

We can use a mutually agreeable escrow from this list. Once the funds are in escrow, I will email BFL with the request to modify the shipping address (with you and the escrow in cc). Escrow must be released when BFL confirms that the order modification is complete.

This is unacceptable. I received a duplicate payment, a trivial amount, and I will return it. But not based on a forum post, and not to a common BTC address. Please send an email to the email address that was submitted for claims, with an individual BTC return address for each account, so that I can prove that I returned the excess coins. Statements of how much BTC and assets I actually held at GLBSE would be nice too.

No it does not, but the only thing the API can do is buy/sell and get your account details.

I can think of all kinds of nefarious uses (no pun intended) of the ability to buy/sell on many other people's accounts. I'm just worried about your blatant endorsement of a third-party app on the front page without any kind of review. I assume you do not want to be held liable for anything that might happen if the app happens to go rogue some day. You should probably put in at least a disclaimer about this.

(Unless LWCoder works for GLBSE, in which case I'm just spewing garbage here and I'll shut up about it).

GLBSE and MPEx. That would be far more useful to me than MtGox.

MPEx is especially painful because of the manual approval process for deposits. Unfortunately their API doesn't seem to have account-to-account BTC transfers either.

Actually, today I've sent 0.5319BTC per unit on all the 56 units that have been paid as the first week returned 25BTC.  This is explained in the newsletter that has been emailed to fund members.  If you did not receive a copy, that is probably because you didn't provide an email address.

Received, thanks! The newsletter was great too - I'd invest in this fund just to get access to that.

Well that is the problem.  Pirate knows Goat doesn't have that data and likely can't get that data, not for every holder.  Some bondholders (who purchased the bonds in private) will not be willing to give up the info.  Hell every bondholder may not even login or know they need to give info before Pirate's arbitrary deadline he pulled out of his ass.

It is just a way to fuck over the victims a little bit more.  To "erase" (at least in his mind) some of the liabilities.  

Seems like Goat's lawyer's solution is reasonable. As far as pirate is concerned, his liability should be only to Goat, not to some random bondholders, as there were no sub-accounts created with BTCST either as far as I understand.

Yeah, looks like he wants to play with lawyers...

Seems like it would be the only way out for him to avoid legal or other trouble at this stage. He has hinted at having a "legal team" from the time he originally announced the default.

What problems do you see with giving him the data? (i.e. assuming you can somehow get the data in the first place)

by closing this asset you'll prevent people who wish to get out and the ones who wish to acquire this debt at wholesale price.  if you close trading to it and then if pirate makes it right what will happen with this bond?
you motivation wanting this debt to equal 0 is understandable, but let people figure out for themselves if they want to keep it or sell it at discount

He's already said that he won't close trading:

I will not ask nefario to lock trading of the bonds.
