Someone speculated that the post where Garza talked about the github being compromised might have been the result of him hiring hackers and not being informed of their failure yet.

I laughed that off. It seemed too convoluted.

Turns out that's exactly what happened. Again. I never flippin' learn. In this story, the worst possible speculation, no matter how far-fetched, ends up being the truth.

He later retracted those statements.

Oddly enough just hours after the PayCoin declaration of Independence was posted a PayCoin Foundation email was hacked and the attacker attempted to reset the github account....

Someone alleged that Josh may have hired out hackers to take over the github repo and maybe they did not communicate their failure in time....  This would explain Garza's rash statements about the hack and his later retraction and flip flop on the issue.

Pretty sure Stu actually has a job and can prove he wasn't around... but, I bet Stu is paying for the attorney because it's his bum that's also on the line as 41% owner of that hell hole.

OH... NO... these statements are great.. it goes to the 'piercing the corporate veil' concept... so people can recover from Homero Joshua Garza personally. If he's not careful, he's also going to get Stuart Fraser, Cantor Fitzgerald Vice Chairman and Partner's butt on the line too. I can't believe that an attorney hasn't wrapped him in duct tape and thrown him into a closet.

This has shady written all over it and sounds like a reconnaissance mission to me.

Spread the word guys. As much as I'd like to see a collaborated effort, one scam won't end another. (example: ZenCloud converting over to PayBase)

Anyone interested in something like this should be talking to @Allen1980s. He's a trusted member of the community and already has the ball rolling with a lot of fire power.

Basically who ever is running that website ( gawlawsuit[dot]com ) is not being advised by an attorney, just one look at the form they're asking you to fill out shows that is someone with an ax to grind (no shortage of them), but not someone working with an attorney. Anyone who gives them info is likely to just end up with an emotional leech to deal with --or worse.



The spelling mistakes look almost like it may be Josh honeypotting disgruntled customers. LOL

He doesn't run with a particularly bright crowd, so I'm still willing to bet that the original guy is putting it up... just another example why his email should be forward to the GSA because his company is providing encryption technology for government contracts and he can't even seem to discern a fundamental money scam.... imagine how well he'd do against an actual intelligence agent.

That's why I keep asking him to post the specifics:
- When/where was it registered
- When was the IRS application submitted (and who are the three board members)
- Make finances public on a monthly basis since they're made public on an annual basis anyway.

If they can do at least the first two immediately, then this "XPYTrust" probably doesn't exist, so it can't own anything... that means that Joe is the defacto owner of the five prime controllers if no one else is willing to come forward. Even in their foundation video conference, they said that FOUR prime controllers were donated, so that still leaves one prime controller that appears to be owned by Joe independently of everything else.

I get it, if Adam Matlack really lost $500k on this scamcoin to Josh, then I understand why he wants to wrestle control of it and perpetuate it.  If Joe wasn't paid by Josh, I get why he may have asked for compensation in any form.  

The thing I don't get is why the scam has to continue in virtually the same form and why the head scammer Josh has any stake in it whatsoever?
Don't worry, when all the prime controllers come up for auction in june, josh will just get uncle stu to buy them back for him and it will be as if Jan-May never happened... well, except for that little SEC thingy.

I was offered Prime Controllers that didn't belong to him. This was not my idea (as you can see from the email), although at the time I did consider the deal. Of course (if you read further in the email thread) I couldn't move forward with the deal as I was not comfortable with the situation of someone offering someone else's property as payment. Additionally I declined any future business relationship with Garza in the same thread.

Again, I have been a part (and even led) a business that I have many regrets of and welcome criticism for my actions. It's important to state that I'm not proud of this by any means. During my last couple of months at GAW I became someone I wasn't proud of and considered performing actions that I would have never considered before. This feeling is what led to my exit along with the decision to attempt to rebuild professional relationships with local businesses that were not compensated by GAW for their work during my time at GAW.

Given the opportunity by XPY Dev and the Paycoin Foundation to become a volunteer for XPYTrust was the least I could do to help the community and be a part of building the currency as originally intended. I thought I could begin to help those that lost so much during my time at GAW. My proposal to the Foundation and XPYDev will consist of a large coin burn along with ending the hyperinflation (which is not exactly what the white paper describes Paycoin to be but I feel it is necessary at this point).

Regarding XPYTrust:
- Where and when was it incorporated. (An imaginary organization cannot 'own' anything, let alone prime controllers)
- When was the IRS application submitted?
- Who are the board of directors?
- Given the GAW history, will you guys post monthly financials to show that you are committed to transparency? After all, there are plenty of 501c3 that do nothing but funnel funds to the companies of closely associated individuals. So, the whole 'non-profit' angle is highly suspect, in and of itself, without any of the XPY background.

As a non-profit, you guys will be required to raise funds from the public or loose your 501c3 status, so it seems like this is the minimum that XPYTrust can do to (a) prove that it even exists beyond emails and forum messages, and (b) begin to have even a shred of credibility.  If the board of XPYTrust cannot do this THIS WEEK, actually even TODAY... then it's just another con game and there are individuals who own the prime controllers, not this imaginary XPYTrust organization that you 'volunteer' for.

Consider this:  If instead of hard forking, the same folks get together and create a new coin called Paycoin Redux (PAX).  They do an ICO in which any holder of XPY can obtain equivalent value pro rata percentage of PAX coin by exhanging their XPY for PAX; except Josh and any person or entity that can be identified with Josh as an affiliate or family member is banned from ICO participation.  The XPY exchanged is destroyed.  The result of this would be exactly the same as a hard fork, but you cannot possibly claim anything morally, ethically or legally wrong with that.

This I completely agree with. The issue with forking out addresses on the same coin, without regard for if it can be legally enforced as theft or anything else, sets up a bad idea within crypto-currency as a technology. Imagine if the governments had said "fork out all silk-road coins" and "fork out all mt-gox coins"... then they decide to regulate coins so that to launch a coin you need to be able to put a freeze on any address at the drop of a hat if the court orders it.  

It is much cleaner to make a new coin and throw up an exchange where any coin that's over (days-since-announcement-of-new-coin) can exchange 1:1 into the new coin. That means all staked coins die in their original chain and only those holding coins at the point of the announcement can exchange, so no arbitrage crap.

Most likely (Day) Traders / Tradingbots and not "investors". Investing in a total messy coin - risky investment, there are many other coins.

PS: Have fun with my 625 PayCon! (only few people who have their btc and con adresses in signature, sadly)  Was my only Immortal i did hit in PayCon staking week ^^ But staked a few Primelets Smiley

I'm new to it and trying to figure it out, so much grats on the immortal (i'm sure I'll be even more grateful once I know what that is), this and Qora are my first venture into altcoins... for me, i've only used bitcoin to get paid and buy stuff. this paycoin thread had me really squeamish about altcoins all together, so am being very careful about what I deal with.

I pushed a lot of buttons and levers. I also take responsibility for my actions. I will continue truthfully answering questions asked by 3 letter agencies even if it means an undesirable outcome for myself. I enjoy working in this industry and I stay closely in touch with Eric and Jonah. Like Eric, when I became very uncomfortable working in the environment, I stepped down from my role.

I can take a forum beating and completely understand the justification to do so.

I may have not stepped down from my role quick enough in order to properly display my character and integrity as a business leader, and that is something I regret. Hopefully time will heal and mend some of the professional and personal relationships I have built over the last few years. I'm also willing to help out where I can and be more available to do so.

A start would be making ALL of the financials on your non-profit FULLY available on a monthly basis. And, I say monthly because part of Josh's recommended expatriation scheme was to use a state-side non-profit to funnel money over seas to him. So, if you release monthly, then they match your annual... that will go a long way in showing that you're not the non-profit fulfilling that role.

First, prove to me that GAW owns Paycoin. Tell me how much, and where it is stored and why you believe it belongs to them, and then explain  why taking property from a corporation is different than taking it from an individual. Secondly, explain why you think it is ok to take property away from either GAW or Josh Garza. What is the EXACT criteria by which you conclude that it is fair, just and legal, to take property from someone else. You either respect property rights or you don't.

I don't think anyone is proposing taking property away from anyone. What is being proposed is a fork of the coin which is identical other than that certain coins don't exist in the fork; the current coin (XPY) continues to exist, and a new coin (XPY2) is created which is functionally identical, only without the GAW coins. Is that theft? I don't see how.

As an existing holder of N XPY, I would also have N XPY2 (unless presumably I was GAW). I could choose to trade my XPY2 for "real" XPY, or vice versa, depending on which of the two I wanted to hold. They would both be listed on exchanges, and their prices would move independently of each other.

If there's general agreement that the fork is a good idea people would sell their XPY, pushing the price towards 0, while buying more XPY2, increasing the price. GAW still have their millions of XPY, nothing has been stolen, but the free market has set a more appropriate price for their out-of-thin-air gains and decided that they value a coin without the pre-mine (or whatever it is - I've not been paying attention) more highly.

XPY2 would cut at least 50% of the coin and all hyperinflation.

EDIT: Cut all prime controllers and their coins + any remaining premine which is not in the hands of customers.

  • If an address held by dooglus is identified as a GAW address, then that would be okay because it's for the greater good? Even if that address is valued at $2k at the time it's excised from the blockchain?
  • What if Rashabh is owner of 3 of the prime controllers? He's put up a lot of money for them and is as much a victim of GAW as anyone else. Should his prime controllers and their existing coins be wiped out?

And, everyone is okay with setting this precedent... so, maybe in the future a coin could decide to just wipe out all addresses associated with Southern Hemisphere IP addresses... or maybe dump all addresses associated with EU wallets... hey, they could set up a kiddy-porn honeypot and drop all those wallets, that would certainly be for the greater good...

Everyone is comfortable with a crypto-currency suddenly becoming judge and jury in accordance with the current holders' ideals? That is essentially what you will be doing when you take a $1000 or $10,000 or $1mm worth of addresses and cut them out.

I'm not sure how you clean up XPY, but if the prime controllers survive till June, then who knows who will own (technically rent) them... as it stands now, the PC tenants seem to hold a lot of power over the future of the coin. What if they decide they want to go for the big-bang and focus on setting up silk-road5 or they decide to cut out all wallets holding less than 100k coins to increase scarcity because they're just muggles anyway, right?

I'm genuinely interested in your conversation, but don't want to jump in on it in this thread because it's sort of semi-tangent-ish.  (But I can understand why you two continue your discussion here)... would you consider starting a different thread where lesser voices could participate w/out overly extending this thread? Also, this seems like a good 'general purpose' crypto-currency community topic that would be served better to not be buried in this thread.
