If you have ordered from Butterfly Labs (BFL) and have not yet received your product, you are entitled to a refund whenever you request one (per FTC rules).

First ask Butterfly Labs (BFL) for one, they will probably say no but you might get lucky.
If you ordered via PayPal you can file a complaint with them even if you are outside the 45 day window. One customer has already gotten a refund from PayPal that was outside the 45 days.

If you ordered via BTC or Bank wire, you can fill out a complaint with the FTC and they will advocate for you with Butterfly Labs (BFL) to get your refund. You can also contact the office of the Kansas Attorney General and inform them that you have had your money taken with no product delivered for months, just more promises.

To play devils advocate for just a moment:
If BFL just does a reference board + firmware and only resells the chips they pay their contractors to design and the fab to produce, then this product might not be the epic trainwrecks of their previous products.

 Speaking directly to this point, it's a strategy that has worked very well for AMD and NVidia. BFL would be wise to take a page from their playbook.

ROFL so when everyone transfers their order they will magically catch up on all pre-order shipping by september.  Also notice no more credit card option.

 Given their well-documented sordid history, I can't imagine a credit card processor that would be willing to take the risk with Butterfly Labs.

 I pity any soul that chooses to purchase a product from Butterfly Labs given their sordid history, as documented on these very forums and their own official forums.

 They do not deserve the support the greater Bitcoin community given their well-established contempt for it.

In all honesty, from their standpoint, it's not a bad way to clear some of the disgruntled backlog and avert the rest of the discontent from delayed products a few months.

 I'm curious, and apologies for sounding confrontational, but are you high right now ?

 This assumes that the world can trust Butterfly Labs to keep their word that they will ship on their stated schedule.

 History has clearly shown, repeatedly, that accurate scheduling is not one of Butterfly Labs' favorable qualities.

All I want is the truth.  But that seems difficult for Josh atm, leaving Jody to cope with all the questions from customers.
It was mainly this fact that put me on this crusade. If he was civil, I wouldn't be here, but Josh dictated the path.

 I'm right there with you. I used to be a happy customer of Butterfly Labs.

 And then Josh Zerlan came along and took a big 'ole dookie on the entire company image and community goodwill they had just managed to salvage after delays on their FPGA launch.

 I feel bad for the troops on the ground at Butterfly Labs who are just trying to do their jobs without having to deal with all this public backlash brought on from their figurehead.

 A sad state of affairs to be sure.

I wish there wasn't so much hostility on the board between the community and Josh. We might be able to get more information about why things are taking so long without turning the discussion into personal attacks.

 You must be relatively new here; unaware of the history of Butterfly Labs up until this point...

 I might recommend against going down that rabbit hole entirely.

You can never underestimate the dirtyness of Avalon team. I have got a very reliable offer, Avalon chips arrive at 10th Sep,100RMB each. The seller has already supplied tens of thousands chips on a very private market. Some of Avlaon clone manufactur, such as ccmbc on this forum, is the buyer of the seller. By delaying the normal order shipping, Avalon team successfully created another market: expensive Avalon chip with trustworth ETA.

 Absolutely intriguing insight you have into the situation. Thanks for your anecdotes.

 Very unfortunate to see the Avalon group acting so unscrupulously.
