 The KNC folk are ambitious people. Lets hope all their hard work pays off when these chips become a reality.

Reason?  Is mining dead unless you can be king of the hill in hardware? For $1,000 I could get 35-40 Gh/s. But may take 4-6 months to get...

1) It could be argued America's Favorite Bitcoin ASIC Company does not deserve the support of this community.
2) Do you believe they are going to get through the last twelve months of order backlog in the next 60 days according to their announced intentions ?
3) Does their pattern of behavior over the last thirteen months inspire confidence in their enterprise ?
4) Has their shipping/production schedule since April 1st, 2013 inspired confidence in their enterprise ?
5) Evidence suggests 4-6 months from now, the mining landscape will have second gen ASIC's available for purchase, while America's Favorite Bitcoin ASIC Company will presumably be still struggling to ship out their first gen orders.
6) Mining is quickly becoming a game of diminishing returns.

 IANAL. Can't answer that question for you. However, I have to trust that my extremely knowledgeable (and justifiably expensive) council knows what they are talking about and how they are advising me.

You could really benefit from some positive customer service skills.

 They evidently don't care - seemingly live in their own arrogant reality distortion bubble where they can do no wrong, we should not complain about their "mistakes", and their customers are yapping animals who have the honor and privilege of being allowed to purchase their fine, American-made Bitcoin products.

 If they fire and refund you, whereby breaching your contract with them to receive product you have paid for, they will threaten to countersue you for slander and defamation should you start legal proceedings. Even if you have a defensible case and can rebut your "slander and defamation" systematically with facts and evidence to support your statements.

 In my opinion, such enterprises should not be rewarded with customer patronage on basic principle. Life is just too short.

 Absolute power corrupts absolutely, and it would appear we are watching such a scenario play out with America's favorite Bitcoin company on both these forums and their own, with certain personalities running amok and unchecked.

For you, nothing but concrete terms matter.  Why even bother until you can press ship me now?   Go to ASICminer and pay the premium to not swim in these waters

 My acrimonious dealings with Butterfly Labs have completely turned me off of pre-ordering products in Bitcoin space entirely. It's worth it to me to pay the premium to have ASICMiner products in-hand in a reasonable time-frame, rather than placing pre-orders for cheaper products and be at the mercy of whatever developer shenanigans they decide to pull on their patient customers during the development process.

 I'm sincerely wishing KNC, BitFury, and the others good luck with their projects, and hoping their delivery issues won't be as bad as Butterfly Labs' or Avalons.

 It would be wonderful for Bitcoin miners to be able to go to any of the vendors' websites and have product shipped out within 72 hours, but I really don't see that happening before the New Year with anyone other than ASICMiner.

I am cheering on all those vested in DIY projects that your chips arrive soon and are quickly married to boards. The game is on.

 I can almost taste my K16's...

 It's been absolutely incredible and inspiring watching community projects develop around the Avalon chips so far.

I'm just getting a little sick of everyone and their dog playing lawyer and trying to apply random regulations to things that they don't actually apply to.

 I hope you can appreciate there are some that are sick of production problems over the last 300+ some-odd days that have created the current acrimonious environment.
