Er sendet euch die assembleten Boards und das wars. Es ist nicht sein Verschulden, dass die Käufer nicht ihren Vertragsbestandteil (liefern der Chips) erfüllen können.

irgendwie hab ich das gefühl, dass es mit der umfrage noch ewig dauert bis eine entscheidung da ist. ich hoffe die fehlenden user fällen hier bald eine entscheidung. generell wär ich dafür, wenn >50% der chips eines batches refundet werden sollen, dann wird es durchgeführt. glauben jene die behalten wollen wirklich, dass die chips in naher zukunft da sind, wenn man sich die bisherige liefermenge ansieht?

burnin is 100% legal! He could deliver your assembled boards (excl. avalon chips) and thats it. He even do not have to refund the costs for assembling of the avalon chips if he already paid for an assembling slot or bought machines for e.g. Everything he refunds is because he is a nice guy. Think about that!

Burnin ist rechtlich gesehen vollkommen auf der sicheren Seite. Bei Produkten die auf Kundenwunsch gefertigt werden, sieht es beim Rückgaberecht ganz anders aus. Es ist genauso wie er schreibt, es ist vielmehr ein entgegenkommen einen Teil zu erstatten. Da darf ihm niemand etwas vorwerfen, ganz im Gegenteil! Informiert euch doch bitte bevor ihr auf ihn losgeht!

Naja steht ja drinne das es eine vorbestellung ist. Ziemlich verzwickte angelegenheit zurückzahlen, fertig. die käufer werdens dir bei den evtl. noch ausständigen weiteren verzögerungen danken. wie gesagt, vielleicht kann man 1 batch mit allen jenen die nicht refundet werden möchten offen lassen. meine 95 aus batch 1 sind für 0.086 zu haben. +1 Refund aber bitte nicht ewig herumwarten.

You stated 2 things at the same time, both are part of the contract: FAQ "wasn't shipped yet" and "All sales are final" That means (or could mean): Refunds possible till it is shipped and when it's already shipped then we have a final sale and no return/refund is possible because the device was made on customers demand. Then everything is legal! But if you mean "All sales are final" has a different meaning to your FAQ "wasn't shipped yet" then the TOS are not clear and it is always to the advantage of the private customer. + FAQ "wasn't shipped yet" is a much more clearer statement than "All sales are final" (see above). It would be hard for the customers to get a full refund if you hadn't stated "wasn't shipped yet" in your FAQ. Mr. Anselmi sent me a message -> everything ok with the refund. @Big Time Coin Well, important things should be read be everyone. I think there is nothing against my statements and within 168 posts it should be ok to post 2 big fat red ones.
