Burnin fertigt Produkte auf Kundenwunsch. In jeder 0815 AGB ist in solchen Fällen Rückgabe ausgeschlossen und das ist vollkommen legal.
Wenn er möchte, muss er garnichts abziehen. Er sendet euch die assembleten Boards und das wars. Es ist nicht sein Verschulden, dass die Käufer nicht ihren Vertragsbestandteil (liefern der Chips) erfüllen können.

irgendwie hab ich das gefühl, dass es mit der umfrage noch ewig dauert bis eine entscheidung da ist. ich hoffe die fehlenden user fällen hier bald eine entscheidung.
generell wär ich dafür, wenn >50% der chips eines batches refundet werden sollen, dann wird es durchgeführt.
glauben jene die behalten wollen wirklich, dass die chips in naher zukunft da sind, wenn man sich die bisherige liefermenge ansieht?

Wäre eigentlich korrekt, ja.

Jene, die bei PayPal einen Fall gemeldet haben: Viel Spaß, an burnins Stelle würde ich euch die fertigen Boards exkl. Avalon Chips senden und das wars. Sein Vertragsbestandteil ist damit erfüllt.

burnin is 100% legal! He could deliver your assembled boards (excl. avalon chips) and thats it. He even do not have to refund the costs for assembling of the avalon chips if he already paid for an assembling slot or bought machines for e.g. Everything he refunds is because he is a nice guy. Think about that!

Burnin ist rechtlich gesehen vollkommen auf der sicheren Seite. Bei Produkten die auf Kundenwunsch gefertigt werden, sieht es beim Rückgaberecht ganz anders aus. Es ist genauso wie er schreibt, es ist vielmehr ein entgegenkommen einen Teil zu erstatten. Da darf ihm niemand etwas vorwerfen, ganz im Gegenteil! Informiert euch doch bitte bevor ihr auf ihn losgeht!

die käufer werdens dir bei den evtl. noch ausständigen weiteren verzögerungen danken.
wie gesagt, vielleicht kann man 1 batch mit allen jenen die nicht refundet werden möchten offen lassen. meine 95 aus batch 1 sind für 0.086 zu haben.

wer aus späteren batches unbedingt welche möchte, soll sich jene aus batch 1 holen dann muss dieser oder weitere (je nach menge) nicht storniert werden. gibt wohl genug die zum einkaufspreis verkaufen.
in SebastianJus haut möchte ich wegen des aufwands allerdings nicht stecken.

BTW: Schengen is NOT the same as customs union! For everything from Switzerland (with a -declared- value higher than 22 € for parcels/ I think 130 € when crossing the border by car,train,... and 430 € if you travel by plane) you have to pay VAT.

For miners from Bitmine VAT has to be paid too (19% in Germany).

The good thing here: There is a law enforcement treaty between EU and Switzerland.

BTW: I asked Mr. Anselmi before your "production" status message applied. He asked me if I would change my mind when he offers me an "twince an avalon bitfury upgrade" and gave me time for the decision + I won't loose my right for refund. I decided for refund 1 week ago and I still got no confirmation.

I'm pretty sure, that link mentioned above is valid at least for EU based customers. as already mentioned, it is not B2B sales and standart customer rules are applied here.

ProfMac is wright, I already described it. -> There is a difference with on customers demand made products.

You can argue that you make your products on customers demand. I'm wright with you that the law is a bit different in this case (-> @ProfMac).

You stated 2 things at the same time, both are part of the contract:
FAQ "wasn't shipped yet" and "All sales are final"
That means (or could mean): Refunds possible till it is shipped and when it's already shipped then we have a final sale and no return/refund is possible because the device was made on customers demand. Then everything is legal!

But if you mean "All sales are final" has a different meaning to your FAQ "wasn't shipped yet" then the TOS are not clear and it is always to the advantage of the private customer. + FAQ "wasn't shipped yet" is a much more clearer statement than "All sales are final" (see above).

It would be hard for the customers to get a full refund if you hadn't stated "wasn't shipped yet" in your FAQ.

Mr. Anselmi sent me a message -> everything ok with the refund.

Bitmine hasn't offloaded their risks?

Bitmine changed the terms of sale without asking their customers.

They changed all 3 batches to "production" to avoid refunds. This is cleary an onesided breach of the contract. I asked them for refund, if they won't refund me I will file a case because of commercial fraud at my local police station. I recommend everyone to do the same if they won't refund. I already saved their old FAQ page for evidence. Just send me a PM if you need it too.

Do not take their upgrading offer. Twice the hashrate of an avalon means 200 GH/s in October! They have their bitfury chips in an october batch! Compare Bitmines price to a Bitfury Full Kit from bitfurystrikesback for e.g.
