Center for Medical Progress May Win Abortion-Related Prior Restraint Fight In Los Angeles


StemExpress’ initial success now appears unlikely to continue. CMP has filed a well-drafted anti-SLAPP motion attacking the StemExpress complaint. I’ve explained how anti-SLAPP motions work before. If you’re being sued for speech, and you believe the speech is protected, you can file the motion, lay the factual framework for the speech being protected, and force the plaintiff to come forward with admissible evidence showing it could plausibly succeed on its claims. Moreover, an anti-SLAPP motion halts discovery absent a special order of the court.

StemExpress had demanded early expedited discovery into the case; that request was thwarted by CMP’s anti-SLAPP motion. So they appealed to the court under part of the anti-SLAPP statute for special discovery — an exception to the general rule that discovery is stayed when the motion is filed. They wanted, for instance, to gather evidence that would help them transform their brief temporary restraining order into a longer-lived preliminary injunction, which requires more proof.

The L.A. County Superior Court’s decision does not bode well for their project. In what appears to be a tentative ruling, the court refuses their special discovery request, saying they have not shown adequate cause. More specifically, the court suggests there’s no need for discovery in support of a preliminary injunction the court is not inclined to award:

Plaintiff does not persuade the Court that the discovery it seeks is necessary to obtain the preliminary injunction. That is because it appears unlikely that the Court is going to grant the preliminary injunction. The injunction Plaintiff seeks would prevent Defendants from disseminating the videotapes. First, this proposed injunction would constitute a prior restraint on the Defendants’ rights under the First Amendment and the parallel protections under the California Constitution. US Const. Amend. I; Cal. Const. Art. 1, § 2. Therefore, it is unlikely that the preliminary injunction will ultimately be granted.

Yes, it appears that the court has been awakened to the prior restraint implications of prohibiting distribution of a video.

If Hillary’s Server Was ‘Blank,’ Why Was It Kept At A Data Center In New Jersey?






The new revelation that Hillary Clinton’s private server was made “blank” in June 2013 — but nonetheless stored at a data center in New Jersey — raises a slew of new questions about the former secretary of state’s handling of her emails.

The attorney for Platte River Networks, the Denver-based cybersecurity company Clinton hired shortly after leaving office to handle the server, says that she does not know why the hardware would have been stored in a New Jersey data center if it was “blank.”

“The server that was turned over to the FBI voluntarily yesterday to our knowledge has no information on it,” the attorney, Barbara Wells, told The Daily Caller in a brief phone interview.

On Wednesday, after Platte River Networks gave the server to the FBI, Wells told The Washington Post that the information from it “had been migrated over to a different server for purposes of transition” in June 2013.

To my knowledge the data on the old server is not available now on any servers or devices in Platte River Network’s control,” Wells told the paper.

That revelation is significant because until now, most observers have assumed that Clinton wiped her server clean sometime after October, when the State Department sent a letter requesting that she hand over all of her emails. Clinton’s attorney, David Kendall, informed the House Select Committee on Benghazi in late March that the server had been wiped clean.

But the new claim that the server has been useless for more than two years indicates that when Clinton finally did produce her emails in December — 55,000 pages worth — they were drawn from a different device.

Kendall recently gave the FBI three thumb drives that held Clinton’s emails, but Wells said she had no information on whether the data from Clinton’s old server was transferred directly to lawyer’s thumb drives. Neither the Clinton campaign nor Kendall responded to questions from TheDC.

Asked why the server would have been stored in New Jersey if it did not have any useful information on it, Wells said, “I have no information on that.”

Asked if Clinton or anyone associated with her campaign is still paying Platte River Networks for its services, Wells said, “I can’t comment on that.”

Clinton hired Platte River Networks to handle her server shortly after she left the State Department in Feb. 2013. Prior to that, the server resided in the basement of Clinton’s Chappaqua, N.Y. home. When Hillary Clinton was tapped to head the State Department, she hired one of her presidential campaign’s IT department staffers to beef up the system so she could use it in an unprecedented manner at the agency.

Clinton’s hiring of Platte River Networks came around the time that the Romanian hacker Guccifer hacked the email account of Clinton’s longtime friend, Sidney Blumenthal. The hack revealed Clinton’s private email address, HDR22@clintonemail.com. At the time it was not known that that was the email account Clinton used to send all work-related and personal emails as secretary of state, a violation of federal regulations.

Clinton has mostly avoided publicly discussing the email server arrangement. In her lone press conference on the matter in March, the Democratic presidential candidate said that the server was never compromised and was maintained on property guarded by Secret Service. She did not then nor has she ever said anything about Platte River Networks or the server’s placement in the New Jersey server farm.

The FBI visited Platte River Networks last week. Though Wells maintains that the server was handed over voluntarily, the FBI clearly sought it out.

The agency’s interest most likely stems from the recent revelation that the Intelligence Community inspector general has reviewed some of the emails and determined that two that moved through Clinton’s server may have contained information which was “Top Secret” at the time they were sent.

The State Department has disputed that characterization but says that it is cooperating with the inspector general on the matter.

State had also allowed Kendall to keep possession of his thumb drives. But the FBI overrode that decision and seized control of them.

While Platte River is not the target of an investigation, Senate Homeland Security Committee chairman Ron Johnson sent the company a letter on Wednesday inquiring about what security measures the company used to handle Clinton’s server.

Tissue Company Breaks Ties with Planned Parenthood After Harvesting Videos







StemExpress, one of the tissue companies that works with Planned Parenthood, is cutting its ties with the women’s health organization after a series of sting videos that have prompted congressional inquiries, sources tell POLITICO.

The small biomedical tissue procurement company is distancing itself from Planned Parenthood after finding itself tangentially linked to what abortion opponents allege is Planned Parenthood’s illegal trafficking of fetal tissue and organs.

Both StemExpress and Planned Parenthood have denied doing anything illegal or improper. They say that they only facilitated the donation of tissue for medical research with a patient’s consent.

StemExpress, a five-year-old company based in Placerville, Calif., notified Planned Parenthood and Congress Friday of its decision to end the relationship, the source said. The House Energy and Commerce and the Senate Judiciary committees had asked StemExpress to explain its relationship with Planned Parenthood.

StemExpress worked inside several Northern California Planned Parenthood clinics. Typically, after a patient told a Planned Parenthood physician that she was going to have an abortion, a StemExpress technician would ask for consent to obtain the fetal tissue. If consent was granted, the technician would then facilitate and process the donation of the tissue for StemExpress.

In two of the six videos released to date, former StemExpress technician Holly O’Donnell claims that she once saw another technician appear to obtain fetal tissue without a patient’s consent. StemExpress “unequivocally” denied the claim.

In July, a court at StemExpress’s request issued a temporary restraining order prohibiting the Center for Medical Research, the anti-abortion group that made the videos, from releasing any secretly recorded video of the company’s employees. StemExpress lawyers said the group violated California’s anti-wiretapping laws.

StemExpress worked with Planned Parenthood only in Northern California. The undercover videos also showed people discussing what it alleges are illegal tissue sales practices by Planned Parenthood in other locations.

The furor that erupted when the first video was released last month shows no sign of abating. The Center for Medical Progress’s David Daleiden has said that he has enough videotape material to release about 12 films in total. Republicans on Capitol Hill have suggested that they want to hold hearings, and more congressional attempts to defund Planned Parenthood are likely after the August recess. The 2016 Republican presidential field has voiced strong support for defunding, too.

Planned Parenthood did not immediately respond to a request for comment Friday afternoon.

Donald Trump a HUGE FAVORITE with Small Business Owners


Donald Trump continues to enjoy a lead in several national polls, and it looks like his popularity surge continues among the small-business crowd.

As the campaign trail heats up on the road to the 2016 presidential election, candidates are beginning to vie for the small-business vote. According to a new poll from Manta, a small-business networking platform, Trump is the top choice among small-business owners for president with close to 38 percent of respondents selecting him. That comes even even after his performance in the recent GOP debate and tussle with Fox News moderator Megyn Kelly.

Democrat Hillary Clinton came in second with 17 percent of the vote, with Republicans Jeb Bush and Marco Rubio in a virtual tie for third place with nearly 6 percent of the vote each. Manta surveyed 815 small-business owners.

Even Trump’s GOP competition, including Ohio Gov. John Kasich, have acknowledged he has “struck a nerve” among some voters. This seems to be the case on Main Street as well, said Jack Mozloom, director of media and communications at the National Federation of Independent Business, a conservative lobbying group.

well for a country big as the United States of America it is not weird to have that many Spanish-speaking people. There are around 320 million people in the United States of America so 41 million people is around 15%. I am from Macedonia, it is a country with around 2 million people and 25% of them are Albanian. That is a larger percentage than the one in United States, right? And also, it should be weird that there are so many people from Mexico everybody is looking for a way to make more money and to have a better living.


25% of your population are illegals that get free social services from your government? Ok maybe not all. 20? 15? 10%? You must be living in a rich country.

CNN’s Cuomo Asks Whether ISIS Sex Slave Story Feeds Negative Stereotypes












During a segment on the recent New York Times piece detailing the systematic and ideological slavery and rape perpetuated on thousands of young girls by ISIS soldiers, CNN host Chris Cuomo wondered whether the story might feed negative stereotypes about Islam.

“Let’s finish this part of the discussion on a point that you feel often needs to be made,” Cuomo said to Muslim woman’s rights activist Qanta Ahmed. “This feeds the impression that these Muslims are animals, savages and their faith makes them that way.”

“And it feeds an impression of what Islam is,” he continued. “What is your response to that?”

Ahmed didn’t seem overly concerned about the point Cuomo raised, and instead strongly critiqued radical Islam. “This is Islamism at work,” she said. “We’ve talked a lot about this on this show. Islamism is totalitarianism… totalitarianism, that means absolute domination of the self.”
