Others have suggested that the hacker can't be liable as they only did what the contract allowed. It's an interesting argument but, simply stated, code vulnerability doesn't equal consent.
As a defense, it’s pretty weak tea. Theft is theft, off chain or on.In fact the hacker, if caught, would not only lose his gains, but be liable for the losses of many ETH owners. He is heading for bankruptcy and jailtime. Assuming that we ignore the contract that the " hacker" agreed to which shows that he merely was a DAO client. There is almost no chance the "hacker" will get caught. You understand that even if there was only 1 person shorting ETH , it is simply circumstantial evidence. In this case there may be several people they can believe to be suspects , and that is when they will hit a dead end. If it's down to 500 devs then look for the one suddenly taken early retirement. |

Will every Smart Contract to come be surrounded by legal jargon saying that - if you do something 'we' didn't think of - it's illegal !? .. there is more at stake here than just DAO.
Dont be childish.  Luckily there is Common law. Contracts are all about consent; abusing a gap/hole/vulnerability in a contract is obviously non-consentual and thus illegal. Without such a legal framework, no contract in the world could exist. Why not fix the code, create DAO2.0, and move on? BTC has hard forked before, it is a learning experience. Why do people say ETH is dead? ETH was not even hacked. BTC was hacked before and survived!! Until he signs something with the "attacker's" key, I assume 'daoattacker' is some Bitcoin Maximalist or ETH short (who piled on short on the deadcat bounce) who is seizing the opportunity to drive ETH down.

I think Ethereum will be no more among us after this attack, the issues to it will be fixed sooner but i don't think that it will survive for longer , it will die in this year.
Vitalik Buterin did the mistake of his life by pannicking about people panic selling and demanding that exchanges froze the ETH markets... I mean what the FUCK? Think about this for a moment. This is terrible and sets a scary precedent. This would never happen with BTC because everyone knows it would be a disaster. Wasn't there a bitcoin snafu where it went to 1c briefly because there was a major code problem in early days, like 2011 or 2012? Yes and this is consistently overlooked by Spoetniktards. |

Definitely agree with this statement. Could be the result of so few hands still controlling majority of ETH plus a large percentage being tied up in the DAO. Maybe people still believe the Ethereum will survive this crisis like bitcoin did in the past. Bitcoin has forked many times. Exactly. At the moment it's all about cryptotribalism. People can't seem to see the wider effect of this on the entire industry.
So now crypto is known for Drugs (silk road), and scamhacking (MtGox/DAO hack).
Don't bother telling me that the hacker got those funds legitimately and it's not a hack/scam, tell it to the man down the street who you want to start using the coins those you're holding. See what he says.

i always prefer earning bitcoin. becasue ethereum is just like any other altcoin, it is unstable and when it is dumped it is getting dumped real hard. so i don't want to lose precious money, eth is only good to be traded. buy low and dump high kind of thing Has anyone heard about the recent hack of ETH. I have read few posts about it in different threads. If this is the case than surely bitcoins is the only coin for long term investment. ETH wasn't hacked. FFS. |
