It seems you assume your customers are guilty until we the customer submit proof that we are not doing what you suspect.

Wrong, we do not assume anything, we are just sticking to the fact we have in possession. Each countries as its own set of rules and being in Japan we are obliged to follow them. Remember Japanese Law are really different from Thai or US Ones.

Is a long waiting period for international withdrawal (I'm waiting from June 1) is due to large number of cases of AML?

It is explained somewhere on this forum that 5% of our International Wire are also "touched". This said June 1 is old and I would like to check what's going on with this withdrawal. Could you please give me either a ticket number of or your Reference number of your Withdraw (Sent by email).

That doesn't explain one damn thing. Bitcoin is nothing to banks. Mtgox isn't even a gnat in the financial world. It's a microbe.

What about wire transfers? What's your excuse there? I wire huge amounts of money all over the world with far far more AML regs and yet they don't take more than 15 minutes to do a wire and receive a confirmation of reception. Yet mtgox takes a week to even start it.

Let's face it gox has extremely poor liquidity and that's usually the red flag that any financial institution is about to go under.

You all should be prepping your resumes rather than running the PR bullshiat here. None of us are buying it.

Did you open a ticket? And what is the Ticket number to check what's going on. I am not telling this is your case, but we see many mistakes made by users when filling the withdrawal process that in some case will make the overall process very long.

I can't speak for him but ...

In my case this is the 4th wire.  All exactly the same.  Same bank, same instructions, same account, same AML docs.
The first two went fast, third one took over two weeks before you even submitted it (and when submitted it cleared quickly in 5 days).
The fourth one hasn't been submitted yet.  

I am not sure if you know this but ... a bank wire can't be transferred if you don't give it to your bank.  That is kinda step #1.  

So the question is why are you intentionally NOT sending the wire instructions to your bank?

Dwolla?  AML/KYC?  Wrong instructions?  I say bullshit!  Hell they aren't even good lies.

I am not sure if you understand the process here. You are requesting us to send money to you from Japan to the US via an usual Wire transfer. If your first two one went just fine it was because they were below 10,000 USD or not reaching in total 10,000USD, but! Requesting more and more withdrawals made you reach this 10,000 USD limit within a certain laps of time and you know that, regardless of whoever you are, the 10,000 USD limit trigger some more "investigation" from Banks and other authorities which explain the some delays and this of course is totally out of our control. An US to US Transfer is much easier... But a JP to US transfer is slightly more complicated and trigger many alarms when it reach 10,000 USD within a certain period of time.

Yes and Yes and Yes and Yes... We are working on fixing this Dwolla situation and working on other alternative to make sure that something like today's Dwolla Situation will not reproduce itself. and PLEASE remember that we are STILL WAITING Dwolla's reply on whether or not they are willing to continue to work with Bitcoin and Mt.Gox in generla... It is now around 15 days that we have no news from them.

Remember what Bitcoin is and how Bitcoin is perceived by Banks and Institutions around the world. At one point we had to Stop SEPA and Euro deposit/withdrawal became difficult while everything went smoothly with USD, now, like 2weiX underline it, the situation is solved for EUR and we will solve the Dwolla situation as well.

I hate to say it, but look at the Trading Discussion forum. It looks like MtGox isn't doing so well, were are you located? Maybe it'd be better to do some local trading, or trading with a exchange that is more responsive.

We are doing just fine thank you very much!

On the MtGox GBP deposit page there is a polite notice stating that,

Does this mean that they no longer accept cash deposits or is it just a warning that if you lodge cash there is a higher chance of error? I've deposited cash in the past and it all went smoothly. If you tell the cashier to input the transaction message I can't see what could go wrong.

As for GBP Cash Deposit, we have a small technical issue lately and that put us and our customers into a very delicate situation.  The problem is simple some users either completely ignore the fact that their name is needed or they do not write correctly their Mt.Gox account number on the deposit slip, making it extremely difficult for us to know where the money is coming from.
The many mistakes we see is regarded users Mt.Gox account number that MUST BE WRITTEN as follow in CAPITAL LETTERS ONLY :

MTG[ACCOUNT NUMBER]X

Now even if we still process some cash deposit we would like you to be very careful when doing so and would prefer you guys to use other methods until we sort this matter out.

I have never cashed Bitcoins out for fiat, but now that I can't it makes me wary. I withdrew my Dwolla cash since I cannot deposit it at MtGox. I get credit card applications for nothing more than a credit check. Why is this becoming such a hassle? I hope this gets cleared up soon.

In an ideal world we would love to kill all these intermediaries (Banks and equivalent) that are in fact making things more complicated and more expensive... But until then we do not have much choice.

I would still like to understand your policy related to when you call the police on your customers. The OP seems to make it sound like you need proof, but to me in the explanation it sounds like you jut need to suspect it.

As you said I was not involved in money laundering and I am glad you no longer suspect it. Sending you my marriage certificate and a bunch of other personal stuff convinced you. However what do I need to do to get you to give me information about this for all I know ongoing terrorist/money laundering watch list investigation? I have had no response from Mt. Gox and I am to the point where I am ready to get lawyers involved.  

I believe it has already been made clear and that you understand the situation. But here it is again for you to read. Also please understand that I cannot give all the details on what have been done here on this forum since we would like to keep your personal information as private as possible.

1) We can't explain all the details on how do we "Flag" people or how our process work. If we do so publicly we will then offer a unique opportunity for "Bad" elements to bypass or security. So I am sorry but you will never have a clear answer on how our security features works on this matter. Please understand we are doing so in order to protect people assets including yours and our system integrity.

2) What you did is a text book case of money laundering for us based in Japan (Remember we are in Japan). I am not saying you were trying to do something bad, and you have been cleared for this. But Check all Best Practice on this matter and you will see immediately what went wrong. To give you an example, I am French, Living in Japan I own an account in France and Japan with Visa Cards attached to them. Every single time I am sending money from France to Japan, the Japanese Bank call me to check WHY ON EARTH I am sending money to myself? They won't clear the transfer if I won't give them the reasons. Things are even more complicated when I receive money from other people or companies. So in your case you can understand that some flagged has been raised.

3) What you did is against our TOS, TOS that you agreed upon. TOS that has been written by our Law Firm in compliance with Japanese Law.

4) You refused to comply with basic AML/KYC. Sorry but it is how things work, once again what you did is text book case for basic money laundering and we have strict instructions on this matter and are ask by our bank to follow them if we want to use their service. Being reluctant to submit "Proof" and proper documentations did not help your case and increased potential problems with our Bank and Japanese authorities.

5) Not being capable to verify your identity and the clear connection with the person whom you wanted to send the fund give us no other choice to report this matter to the police here in Japan. We are not the law and only the Law can decide what can be done until things are cleared. Also failing to report any suspicious activity to Japanese Law can put us in trouble and ultimately force us to stop our activity temporarily or indefinitely.
Without much solutions in our hands and your continuous refusal we had to move forward. As for today you gave us all necessary documentation and "proof" to clear your name on this matter and the case is closed. The Japanese Police has no involvement in this matter at this point.

Conclusion:
1) You do not have to worry for this matter as far as Mt.Gox is concerned.
2) You do not have to worry about the Japanese Police for this matter. Case Cleared and Close.
3) We cannot communicate any information regarding pending case, ongoing case, past case unless we are requested by law to do so. Failing to this basic duty will be heavily sanctioned here in Japan.
4) We cannot give you the details on how things works when it comes to Money Laundering for example since it will help "Bad" elements to by pass our security measures.

I sincerely hope that this post will put an end to this matter and clear your mind.

Weird.  Gox stated the delays were only for Dwolla and US wires.

International wires in non-USD currencies and SEPA withdrawals are not affected, they are operating normally. Please note that roughly 5% of our USD wire transfers are affected, but by and large are being processed normally.


But I agree that I omit to precise that this also included OKPAY. OKPAY is very small compare to the rest and I added it with the rest. Sorry for this confusion.

People have to understand one thing, we, and this will apply to any other Exchange at some point, have to follow government and banks rules. Do we like these rules? Not always. Do we enjoy enforcing them? Hell no! Do we have a choice? Not at ALL!

Unless all of you start mining BTC, uses these Bitcoins to pay stuff in Bitcoins and never ever cash out or buy Bitcoins, we will have to follow these rules, coz at ANY GIVEN TIME, if we are not capable to give the proper documentation that a Bank for example need for a deposit or a withdraw they will use this opportunity to shut us down from using their service again. And I am not talking about huge amounts there but if they want to be a pain in the XXX they will and this even for $10.

Banks rules are different from one Bank to another and they totally control us since we NEED them to help you to cash in or out. They are totally closed and will never give you any reasons or details on why a wire is blocked or why they start investigating a certain transfer. And with their Terror list, if you are unfortunate enough to bear the same name as a person in this watch list, hell will fall over us.

At the beginning they did not really care about us, so we could do pretty much everything we wanted, opening an account there, offering such service, but since :
1) We grew and started to handle a lot of money
2) The popularity of Bitcoin and the Risk for them

Banks are scrutinizing our every move.

Now sure you can go to another exchange and we totally understand that, but if tomorrow XYZ Exchange start handling as much as we are handling, they will face the same problems as we do and they will become as "unpopular" as we are.

So at this point there are not many solutions. And our goal is to make sure that we are as CLEAN as possible in the eyes of these people in order to continue to help Bitcoin to move forward. Sometimes we are rather "aggressive" on these aspects and ask more than what an average bank may ask or need clearer documents, but this is in NO WAY to bother you but just to tell Governments and Banks that we are doing things by the books and that we are in no way criminals!

We know that there are many things that need to improve, and we are working on it, unfortunately and since we are working at an international level there are many things that need to be done at the same time which is slowing us down. Things take time and time is something that with Internet and IT Success have radically change in the eyes of many people where things are moving at Light speed, but when it comes to Banks and Government, time is set on another scale that frustrate all of us. The best example I have for you, and I cannot go too much in details, is when we explain to a Government entity what is Bitcoin and what would be the perfect set of rules that we must follow to make sure that we can continue our business in peace. After our lawyer gave them all documentation, met them at several occasions, we asked, when can you give us an answer? They replied : We cannot commit to any time on this matter and it will take as much time as needed to get back to you...

So yes we understand your frustration, yes we are working on improving this Process, Yes we have some solution in mind to help you, but remember that we do not do that to bother you, but we do that in order to protect everyone's assets here and make sure that the service is running smoothly. And more Bitcoin will become popular more things will get complicated. After all if any Government or Banks does not need to make Bitcoin illegal to stop it, they can easily do it by forcing Exchange out of the equation and making impossible for people to cash in or cash out.

I (and I'm sure a lot of people too) am in no way taking the risk of using your exchange because I suspect you use a dark tainted coin list and a tracking blockchain software to follow them. Is it any way that we, the customers, can gain acces to this software-database before the bitcoin transfer or will the use of your service continue being an act of faith?



I believe that this has been made clear already on the forum, but the short answer is : we are not going to do anything to this coins unless we are asked to. Basically if an exchange need our help and want us follow these coins we will do what we can to help.

So you are going to hold funds on request from other exchanges? Only exchanges no one else? Will you be telling the victim which exchange froze their funds?

Thanks for the announcement. I heard these rumors and guessed it had to do with Dwolla, since I've had no trouble with SEPA, and I wasn't particularly worried about your solvency... but I think you guys deserve a lot of credit for stepping out in front of the rumors and giving everyone these clear, intelligible answers. I sure wish some other business owners would do that...

This community tends toward conspiracy theory, probably just because of the nature of Bitcoin, and there's no shortage of people itching to get publicly abusive and angry just to have their jollies in a forum. And ultimately if they're not just trolling, it's their money, and their right to do so; but not every business handles criticism very well, let alone the sheer volume and unwarranted intensity of abuse you guys are subjected to. You've shown again that you're a class act. My hat's off to you.

Payroll's a very specific purpose, though, and you have a specific relationship with the recipients and probably have more than enough identifying information on your employees to satisfy KYC requirements.  It's not the same for AML purposes as sending large amounts of money by wire to people in various locations throughout the world whom you're not paying for goods or services and about whom you have limited information.  Banks can and do impose transaction limits on accounts, especially when your business and/or your customers are seen as "high risk".

If you look at the cases where banks and money transmitters have received large fines for non-compliance with AML/KYC requirements, they've always involved large volumes of wire transfers to and from overseas jurisdictions and inadequate verification of identity, origin of funds and destination of funds.

This is pretty much it. There are also some withdrawals which for various reasons need to be handled manually by us before being sent out, and there are only so many transactions that can be carried out by our staff in a given day.

Can you explain?  I am trying to imagine it.

I'm trying to put myself in the seat of someone who doesn't have the luxury of sending an Excel spreadsheet to the bank and saying "please wire all this money", but nevertheles has all the information of the money he'd like to wire on my screen in front of him.

What does the bank want to be satisfied that I know who my customer is?  Why couldn't I take that same spreadsheet, print it out, and then print copies of all the passports, driver's licenses, and all the other stuff they would want as proof I know who I'm sending my wire to.  Then on each sheet of ID documentation, I would hand-write which wire it belongs to, for easy cross referencing.  I would take it to the bank and say - here ya go - please let me know if any of this isn't enough.

I would imagine this would be limited mainly by how quickly I could sit and print people's documentation, but I can't imagine it would take me weeks where, for example, someone trying to pull $10k would have to wait a month.

And meanwhile, I would be able to safely report to my customer, "Yep, we submitted the wire request to the bank on <date> and that's where it's at!"... if the bank takes 8 months to deliver the wire, that's the customer's problem with the bank, no longer MtGox's problem, as MtGox will have performed as instructed.

Now, if the banks dislike Gox's wire activity or something, that would be understandable... but this was not stated in the OP, which discusses problems with Dwolla.

We are talking about international wire here, remember we are in Japan, so whatever you are used to in the US, does not necessarily apply for us, also Banks in Japan are everything but flexible especially when it comes to receiving and sending money from overseas, they are really picky, way more than ones in Europe or the US.

I'd really love to see mtgox submit to regular independent audits to insure they have the fiat and coin balances to cover their accounts. Quarterly would be nice. It's one of the reasons I dont leave large balances there.

We will love this too, however in our case this is not as easy as some want to believe. We contacted several companies for that, and all came with some rather impressive cost estimation, something that is far beyond what we are currently paying for our law firm (Details in our last transparency doc). This would also involve us paying  for their travel expenses in six different countries and stay there as long as they feel it is necessary to complete the audit.

We are not against the audit, hell we would love to get this done and not only for us but for any anyone, but this will come to a cost that will have an impact on how our customers are using Mt.Gox today.
