No, wrong.  You don't have the right to cancel an order before the guaranteed delivery date you agreed to in the ToS.

Since when do random ToS trump FTC regulations?

Don't believe the FUD; the ToS are not in conflict with FTC regulations.

HashFast paid lawyers specializing in that sort of thing to write their ToS in accordance with all applicable laws, rules, regulations, etc.

There is no "right to cancel an order before the guaranteed delivery date" nor is there any FTC regulation creating one ex nihilo.

Oh goody, now I can purchase hosting for a chip that hasn't even been completely designed and won't physically exist for at least 60-90 days.
It was possible earlier to purchase a hosting for a machine with a yet non-existing chip: at KnC (in June-August), at BFL (Monarch), at Black Arrow (Minion)...
If it is completely designed and how long it will take to produce, is another matter.

A chip passes through several stages on its way from conception to hashing.

HashFast, KnC, BFL, and BlackArrow have taped-out their chips, so they actually exist on paper and somewhat/partially exist in the physical world.

Conterra has still not yet taped-out, so their chip design is not complete and thus their vaporware cannot be said to exist even on paper (much less the real world).

The only reasons for a month-long delay between mock and actual tape-out are

1) when put into physical simulation Conterra's chip didn't perform at the desired 'wishful thinking' spec of [HashFast + 1] and had to be re-designed to fix that

2) Conterra didn't raise enough money to pay for the rest of the NRE and some wafers

3) Conterra didn't raise enough money to pay for fixing the broken initial design and a second tape-out

4) some combination or all of the above

Yes and it is against U.S. law to deny a refund if you haven't shipped an item when there are no guaranteed delivery dates.

That's nice.  Good thing there are guaranteed delivery dates, such as Dec 31 for Batch One.

The windows for THE ANTICIPATED BEGINNING OF shipping was October 20th-30th.

This isn't rocket science; you just want to manufacture an artificial legalistic-sounding reason to complain. 

No reasonable person expected Batch One to be done shipping 10 days after the earliest possible date.

What's clear from your last post is that you have a some weird politics going on there. It really doesn't matter to you if people are scamming or not, if they make money or not, if it's legal or not. We need to persuade Yochdog to do anything with the BMC distribution besides use it to reward Diablo's scamming.

Diablo knew our BMC shares are worth a lot, and has been scheming to screw us out of them for months.

Well, we got 2 options.

1. Wait and accept that our money is lost possibly receiving our miners in the future with a very high negative ROI.
2. Stand together, complain to the FTC, lawyer up, and hold them accountable for not keeping their promises.

Number Two isn't an option until after Dec 31, the guaranteed delivery date, and only if HashFast then refuses to issue refunds.

I don't know why this simple fact is so difficult for so many to grasp.  The Dec 31 date might be in so-called fine print but it's written in plain English, not Greek or Klingon.

Option Three:  Stop whining and come to terms with the fact that there is no reward without risk.  Watch the price of Bitcoin go to the moon and look forward to a healthy ROI in fiat, if not BTC.
