Folks, the SEC does not care one iota about GAW's trademark applications or corporate formalities or lack thereof.

The SEC is concerned with ONLY one thing: selling and offering to sell unregistered securities by unregistered brokers and dealers.  PERIOD.

A security means an interest in profits that is gained through the purchase of a right to the profit (as opposed to profits gained through work, participation in venture, etc. which are NOT securities).

So the "securities" that the SEC is most likely interested in would be:

(1) Paycoin,

(2) Hashtakers,

(3) Zen and Prime Hashlets,

(4) Other Hashlets

The first 3 of these are clearly securities under established laws (GAW might try to argue that the novel nature of cryptocurrency justifies an exception to existing law; but that does not change the fact that existing law would have these classified as securities without a doubt).  Other hashlets are very likely securities.

When talking the SEC, what they want to hear is **evidence** about the offering or selling of these items, and **evidence** that these items represent profits interests.  No more, no less.  The SEC will listen to you all day long, but if you want them to really hear you you need to speak their language.  Otherwise, you will be written off.

I can confirm that the employee working on GAW's case is interested in all of Gaw's info even unrelated to the SEC.
I'm sure they work with other government agencies.

Alright. Today’s (yesterday’s) summary of developments.

1. I called and had a nice chat with a US Patent and Trademark Office agent¹ who was very open about the status of Mr. Garza’s claimed PayCoin and the following was disclosed:
    A. Mr. Garza nor any of his business entities have been issued a trademark (tm) for the “PayCoin” name, term, likeness, and/or its commercial use protection.
    B. The application to trademark the word was received last month by a third-party web service (like legal-zoom) who mills out these type of applications every day and was likely hired by GAW to submit the initial application.
    C. The “serial number” associated with the listing (86444905) is simply an application submission reference number and nothing more.
    D. The application has not yet even been assigned to an internal USPTO agent/attorney to vet the paperwork and determine if the PayCoin word is available to be tm’d. This process typically takes 3-4 months at a minimum and as long as 12-18 months.
    E. It was determined GAW and/or this service they hired falsified the application where the applicant had to certify the date of the word’s and/or term’s first use within the public domain.² (a note regarding this observation was added by the agent to the application file)
    F. At this time, 12/12/2014, PayCoin is still within the open public domain with the first right of refusal going to its original (PYC) developers and/or the community who financially staked it.
    G. GAW/Zen have no exclusive right or protection to restrict the use of PayCoin or to control others who wish to use it. In fact, any relevant parties can issue a legal C&D communication to GAW and demand they stop harming/interfering with the activity of the existing owners.
    H. It is likely a letter of suspension stating the application is denied or “miss-assigned” will be forwarded to GAW once the USPTO agent/attorney investigates the circumstances of the misinformation submitted on the application along with the marketing activities taking place as I write this.

 2. A little research in to the corporate formation/structure of GAW Miners, L.L.C. in Delaware³ shows:
    A. All the other DBA’s used by Mr. Garza and his businesses are likely not registered – at least in all the states the principles reside in.
    B. GAW Miners, L.L.C. was also registered online using a third party incorporation mill. No attorneys were involved.
    C. There was only 1 page filed in the initial Members list and no financial or shares data was given.
    D. Like many other states that allow the formation of a single member L.L.C., the correct terms to who is running the organization must be stipulated, which was/is not done in this case.

Many people do not realize an L.L.C. is a limited liability partnership comprised of members – or managing members; not a traditional corporate hierarchy like that of an INC. What does this mean?
Mr. Garza is not and cannot be a “CEO”.
Mr. Garza is not and cannot be a “President”.
There is not and cannot be any ITO’s. CFO’s, COO’s. O-O-O’s or Cheerios…

Therefore, if anyone attempts to contact you using any of these ill-gotten titles while trying to protect you from yourself, tell them to pi$$ off and stop playing a game they know nothing about. PERIOD™.

Every church I've attended ALWAYS wants a BIGGER church,not to help the less fortunate in the community!!!!! Sure they may do a little something around the holidays or pick a few folks at random,but the theory behind ALL churches is to grow.

As far as I'm concerned,you don't need a church to talk to god,just talk to him.

I help anyone anytime I can,I work for free if folks are broke & need something fixed ASAP (I'm a handyman-A/C,electrician,plumber,pool repair,home water systems,sprinkler systems,drywall/painting,carpenter,roofing,mobile auto repair,PC builder/repair,etc....).

Most churchgoers are hypocrite's,they talk a good game,but in the end they're selfish.......  Roll Eyes

Also,I'm a recovering alky & drug user,18 1/2 yrs clean & sober,I help other folks in AA a lot,by listening & giving advice & fixing stuff to save em a buck.

Congrats on being sober for so long!
I find being sober is a better 'buzz' than drinking =)

Well here in about another month or so everyone will know whether this is a money making opportunity or not.  I'm personally leaning towards staying in it.. I got all my primes when they were under $20 and I've more than made my money back.

So I can
a) sell my primes and get more money back (this is tempting it would be about $30k)
b) or wait and see if this model works (I don't think it's a scam but the model may not be sustainable) in which case at a pay rate of .0075/per prime/day I stand to make about $16k in the next 6mos.... I could also sell my excess paycoin that I can't stake to offset the risk on this

It comes down to how much risk I'm willing to take..

Do I think zencloud will go offline anytime soon -  no I don't believe that is a risk so I'm not factoring it in (might be dumb but thats how I feel).

Coin not having a valuation of $20 - yes this is the main risk I am considering.. whether I'll be able to consistently sell at a minimum of $20/coin.. I feel like there's a definite risk here, and this is ultimately what will make my decision for me

The SEC is taking GREAT interest in Gawminers right now.. I'd watch out, especially after my huge report.

I am a church-goer too.  In case you never heard it (I am sure many have, apologies to those who haven't) my minister used to tell a story about a deeply faithful man living in a low-lying region prone to flooding.  The National Weather Service issued a hurricane evacuation warning, telling all of the residents in that area to get out immediately.  The man told his friends: "I trust in God to protect me, I will not leave my home."

As the storm came closer and a direct hit on the city was a virtual certainty, the Sheriff came by his house and knocked on his door.  The man answered the door, and the Sheriff begged the man to leave, offering to take his possessions in the Sheriff's vehicle and to help him move out anything of sentimental value.  But the man said: "I trust in God to protect me, I will not leave my home."

When the storm surge hit, flood forced the man to move into the second story of his home.  The entire first floor became flooded, but the man was unperturbed.  He simply moved to the second floor of his home and gave thanks go Jesus for his sturdy two-story home and his safety.

Later that day, rescuers came by in motorboats and tried to save the man.  He refused to leave his home, saying: "My faith in God is complete.  God will make me safe.  Move along, I am staying put in my house with God at my side."

As the storm surge continued and winds increased, boats could no longer navigate the rising water and the man was forced to move onto his roof.  He held on to the chimney to keep from being blown into the water.  A Coast Guard helicopter appeared, and a daring rescue was attempted.  The rescuer lowered himself in 50 mph winds to the man's roof and reached his hand out to the man.  But the man again refused, saying: "God has provided a roof and a chimney to keep me safe.  I will trust in God to protect me."  And the helicopter was forced to leave without the man.

I dont know - the first time I actually knew anything about it was when it was posted on the board, moderators don't get told anything most of the time, we are there to moderate and nothing else, the decisions are taken by GAW staff, and we are NOT GAW Staff.

How do you feel about moderating a forum for a well known scam company? Don't you worry about what may happen to you once they get raided for illegal activities?

I am not going to get into an argument about what is a scam company or not - who is to say that LTCGear, PBMining, ZeusHash, Genesis-Mining, Hashie, etc are all not scams (most, if not all of them aren't, but we don't have proof for all of them - and yes, I have mining in ALL of those as well), that being said, I am not going to give anyone any excuses around it as that's not my responsibility - I am a moderator and nothing more, not management, not a formal decision maker.

With regards to getting Raided and what would happen to me, I am not in the United States so I cant comment on what would happen as I have never been raided, however, I do hope they use gentle gloves on me as I am allergic to Latex Smiley

I would like to point out that though I do look at whats posted (not only GAW stuff but other stuff as well, as its not all about Hashlets - theres other currencies out there), I dont mark anyone for banning, its your call what you do on a different site, and I dont (wouldnt want to) moderate this one.

Also - there isnt a magical "notes" field in the Moderator View that we can attach notes, so we dont note anything down there either Smiley

Josh takes advantage of the weak minded, like some of those 'crazy' churches you might see on TV or in some Movies.

Unfortunately, he recruited a fair share of uneducated morons to praise anything he says. It works to his advantage because if someone is new to Gawminers and doesn't know about bitcointalk/litecointalk/reddit/ltcgeartalk or any other forum then the person is instantly brain washed into thinking that Gaw is a great investment and that they should empty their wallets.

Truth is, Gaw is a company that consists of scammers, liars, fraudsters, morons and just simply people that honestly don't give a fuck about you, all they care about is how much money they can con out of you.

I'm hoping someone will help educate these fools before Gaw gets raided by the FBI/SEC/FCC as they will only see a small portion of their money back once Josh goes to jail.

PBMining for example, just got caught because they couldn't sustain the ponzi anymore.. if he would of created a coin and got people to dish out all their invested BTC and invest it in a PBMining coin staker wallet, he would be fine financially... At least gaw figured out a way to get out of his ponzi without going to jail.. too bad he left a HUGE paper trail that has been reported to various government agencies.

I would get out now while you still can, PBMining just got caught... Gaw is next.
