I just stopped into this forum to see if you people have done anything, but wow, the lack of awareness you are displaying is phenomenal. Please read the topic. This is about the Polish legal entity that owns the bank account that people used for SEPA payments to MtGox. If you didn't use SEPA, this topic is not relevant to you. |

MtGox.com makes it possible to check your account balances in BTC, USD and EUR now.
The amounts fit with the content of the dabase dump a while ago.
If you sent money (via SEPA) to the Polish entity MtGox Poland, and that money is not in your MtGox.com account, there is a possibility it is still on the account of the Polish entity MtGox Poland.

OMG my bank refuse that. The money is arrived and bank wash his hands..
You need to file a complaint with local law enforcement in your country. Depending on the priorities they have (it will definitely help if more people are in a similar situation file a complaint) they will contact the Polish bank (probably with the help of Polish law enforcement). I did the same in my home country (I could file a complaint online - no followup yet). Chances however are that the account you sent your SEPA transfer to is empty. |

De Fraudehelpdesk... die kende ik nog niet. Ik heb net in ieder geval melding gedaan.. hoop dat er meer mensen melding zullen doen. Bedankt voor de tip iig!! : de taak van de fraudehelpdesk blijkt er eerder één te zijn van preventie en voorlichting - en dan nog alleen binnen Nederland. Een eigenlijk klacht indienen moet via https://www.mijnpolitie.nl/if.shtml Opmerking: als je kiest voor oplichting via een handelssite (keuze die het meest toepasselijk is) gaat het formulier ervan uit je bent opgelicht door een tegenpartij op een handelssite à la Marktplaats. Je kan kwijt in de toelichting dat de tegenpartij de site zelf is. NB: ik snap de (terechte) cynische commentaren. Nogmaals: ik post dit hier om aan te geven wat je mogelijkheden zijn tgo de Poolse Bank waarheen je misschien recent geld gestort hebt. Als je verhaal wil halen zal dat moeten via een klacht. Hoe meer mensen klacht indienen, hoe groter de kans dat dit door de opsporingsdiensten wordt opgepikt. Die proberen uiteraard hun tijd en middelen zo effectief mogelijk in te zetten en daarin wegen ze de grootte van de zaak mee (en hun kans op slagen). |

MtGox was absoluut geen "officiele bank". Het was een Bitcoin exchange en dat heeft helemaal niets met een bank te maken. Alle beschermingsmechanismes die banken hebben zijn daarom niet van toepassing.
Maar wel een bedrijf dat een dienst verleent en op incompetente manier gehandeld heeft MtGox bood virtuele goederen aan (bitcoin) die ze uiteindelijk niet konden leveren (withdrawal requests lukten niet). In mails van de helpdesk werden klanten ervan verzekerd dat ze niet op fractional reserve draaiden, nu blijkt dat dat wel zo is. Een eerste makkelijke stap om klacht in te dienen is een melding te doen bij de fraudehelpdesk: http://www.fraudehelpdesk.nl/vraag-en-meldformulierVoor wie de laatste jaren via SEPA geld heeft overgemaakt naar MtGox, vermeld vooral dat je geld hebt overgemaakt naar het Pools bedrijf Mt.Gox Poland met een Poolse bankrekening (zie de gegevens op https://bitcointalk.org/index.php?topic=488553.msg5383180#msg5383180 ). Die Poolse bank zal geen informatie geven aan klagers, maar is wel verplicht mee te werken bij een onderzoek, zie: https://bitcointalk.org/index.php?topic=488883.msg5435354#msg5435354 Als voldoende mensen een melding doen via de fraudehelpdesk, kan dat een aanleiding zijn om een onderzoek te starten vanuit Nederland. |

mt.gox accepted fiat deposits automatically and processed fiat withdrawals manually
Hi st4nl3y, What is your source of information on the WBK account? Your posting seems to suggest that there is no money in the account and that money sent to the MtGox Poland account at WBK was either sent to an account of the Japanese Mt.Gox mother company, or used immediately to pay waiting withdrawals (you said the same thing in a PM which I did not respond to yet - bcs the issue is relevant for everyone I am asking the question in a public post). Okay, sure. But how does someone prove fraud or misleading ,since the bank is "just holding" these customer accounts for gox ?
In case of "freshly deposited" money, it is easy to argue they are no longer providing the promised service (since MtGox stopped trading) so the payment needs to be reversed. |

... as a prokurent (a type of a representative) of Mt.Gox in case you're interested: Yes, saw that as well. As far as I could google, this is the person that ran bitomat.pl, that was "bailed out" by Mtgox back in the day right ( https://en.bitcoin.it/wiki/Bitomat)? However it doesn't really matter who is representing MtGox in Poland, and I also do not blame him for anything that went wrong BTW. edit: btw, this is a sp. z o.o. (a Polish equivalent of LLC) with a minimum capital require by law, so you you will only be able to recover 5000 zł from them (that's about ~1650 USD at current exchange rates). If you want to recover more than that, then you will need to go after MT.GOX CO.LTD.
Interesting, thanks for the info. Still if there is more money on that bank account, and it is possible to freeze it via legal way, it should be possible to recuperate more than (a fraction of) that minimum capital that is (I assume) set away on some blocked bank account? |

First of all: sorry for not being able to post in Polish. Yet I am looking for tips from Polish users, so I hope this post will not be moderated away. Mtgox used a company registered in Poland, MT.GOX POLAND INC. SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, that received SEPA payments for MtGox. Question: I need a legal representative in Poland to file a complaint against Mt.Gox Poland for not delivering services as advertised on its website. My goal is to recuperate at least part of the payments I have done to MTGOX Poland (some of it was so recent that it never was credited to my actual MtGox account). Preferably a small (one-person) law firm, knowledgeable about Bitcoin or online services. Willing to take legal services for a percentage of the money. Since I am not the only MtGox customer using SEPA via this Polish company, this could become an interesting assignment. Thank you in advance!

EUR and PLN transfer are less than a week but limited to Europe or country processing SEPA transactions (swiss, Norway,...).

This is nonsense and I think the posted email text is fake. SEPA transfers take at least a month too. I am still waiting for 3 SEPA withdrawal requests (status: confirmed) to be processed, the oldest dating from 2013/07/29. |
