I remember a while ago someone on here saying how they were persuing 2 separate claims. One against alpha the company, and another claim against the individual, Akram. Whoever it was, did they successfully win the judgement against Akram individually? I've heard of the cases of Alpha losing but not paying up, but not of any cases of Akram losing. It would seem to me to be more likely to get your money back if you have a judgement against the individual rather than the business as the business can just wind down and dissapear. The person cannot as easily dissapear, and if he comes back to Britain, may be more easily traceable by debt collectors.

I was thinking a month ago about taking Alpha to court but it seems pointless if they are not going to pay and are untraceable, a claim against the individual would seem to have higher chance of success, if they are individually liable? Also can you claim the court costs that you have to pay to start the case, back from the court when you win judgement?... or do you only get that back if/when Akram/Alpha pay up too? If it is the former, then there is much less to loose. But if not, I don't fancy wasting another £70 to go to court if i'm almost certainly going to lose that too along with the rest of the money! What do others think on this? And who was the person who said they were suing Akram directly? Anyone remember? Did they win? What was their username? Please let us know what happened if it was you and you're reading this! Thanks.

I am now processing to enter a judgment by specifying my claim is against both company and individual (director Akram). This is required by the court as Alpha is a limited company. In other words, one's claim against a limited company cannot be registered to request judgment in court. I don't know what the court will say in its judgment and when it will issue. Once I get the judgment, I will make it public in this forum. As I am not familiar with legal affairs, I will welcome suggestions and comments so that I will take further steps to get money back.

I've won my claim against these guys, the court has now granted my judgement.

It cost's £70 to get the court to enforce this judgement, which will involve them sending bailiffs to the head office. Seeing as how that office has already been reported to be empty, is there any other address anyone knows of I can send the bailiffs to seize goods?

The head office in this case (if the store front from the pictures is locked up) would be Mubashar mother fucker's house.

Please find out the residential address of this criminal and send the bailiff there.

I will personally reward $20 USD to whomever finds this criminal's residential address... in part because my victory will be coming up shortly and I will also need the fucker's address. Hopefully others will add on to the reward $.

This is probably your best place to start. Children tend to live at home longer in Asian families. I would think if this is the family home, it's where you'll find Mubasher.

I just got a letter from a court correspondence that said as the company I claim against is limited, I must specify this claim is against both company and individual. Otherwise, the court cannot enter judgment. If I will do this way, I will need to provide the director's home address. Can I use this address for his home address? Your response is highly appreciated.

Small claim court will take a long time to proceed especially when we need desk help. It will response to our inquiring emails with two or three working days. I am now working to upload supporting materials. In addition, I ask my bank to investigate Alpha Tech as a fraud.

FFS. I really do give up. You can lead a horse to water......... It's becoming increasingly clear to me how Alpha got way with this in the first place. Some people just do not listen Roll Eyes

No, we don't want to give up and let Alpha go away. Most of victims are doing the best to get their money back.

I'll take a loss of 70% when the only other option appears to be 100%

No reply from Alpha regarding my request. You know, transactions are just kind of random when you're not expecting it and there isn't any message in the transaction or notification through other means. Seems like a problem that will only get worse as more people use crypto more often.

 It still boggles my mind why some people haven't started a small claim to get ALL of their money back. I know of two successful cases so far. One has already been paid in full (Chopsbit) the other person is away on business so hasn't followed it up yet. Alpha cannot win in small claims. In 4 days their last surviving defence will be dead. There is more than enough information on in this thread and it has been posted many times on how to go about it. PM me if you need advice.

Why wait? Get your claims in and get paid, it's pretty simple really. Once you have a CCJ against Alpha you can do some pretty heinous shit to them so they will pay up pretty quickly. And yes it will still work if you paid with bitcoin, rupees or your favourite cousin Roll Eyes

This piece of news shows the power of customer complaints. If we all engage in a movement of writing our complaints against Alpha Tech as an internet fraud, the today's close of BL is the perspective of tomorrow's Alpha Tech. I have filed a complaint in US 3c website last week against Alpha Tech. I will go ahead to send a complaint in UK as well.

I thought I would post an update as I think it is relevant to a lot of people here. I won my court case against Alpha, and had then also won a judgement against them forcing them to pay (I assumed the chance of them paying was actually 100%).

My claim was for 30% of the smaller Viper, which was £405. Out of the blue on Friday I had an email saying I had been refunded in full including the court fees, again slightly skeptical as it said it would take upto 5 working days.

Today, boom there is my full refund in my bank account including court fees!

Some reason I think they might have paid:

1) It was only £405
2) I focused my entire court claim on power usage and how it was now 6 times more, nothing about delivery dates as technically the TOS did mention end of Q3 (although this is obviously going to be missed)
3) I live 10 miles from Manchester, so if they did challenge my court case I would have been more than willing to go to the local court in Manchester (smalls claims are handled near to the defendant)

To be honest I've taken my refund and bought more shares in LTCGear, no more of this preorder rubbish these are paying out already LTC mined on SCRYPT ASICs

I have already reported to Texas iC3 for international internet fraud about Alpha Tech which is an law enforcement agent in connection with FBI. Don't wait! File a report online and then get a record to ask your bank and CC to reopen your case.

I'd have to wonder about this refund and what the strings are.

obviously there is a delay announcement coming and I also wonder how many people still owe the balance of their original order.

does getting this refund negate the ability to sue or going for a chargeback?  will they expect the balance, less this "refund"?  does this mean you now agree to their terms, whatever the hell they are, now, such as 'you are business'?

there just aren't enough details in the e-mail.

"respond to this and we'll send you something."  wuzza-huzzah?  did I win a feckin door prize or some sweepstakes or something? 

this is weird shit.

The turning point is May 22nd when Alpha Tech started to deceive its customers and became completely distrustful. As it knew it would not deliver in July, it deceived its customers that it would. Since that date, it has been an internet fraud and owed us refunds at least.

If the failure was found before May 22nd or June, it is definitely an internet scam and a fraudulent criminal.

It would be a key piece of evidence to know exactly when Alpha-T found out about the ASIC problems, IF there ever was a plan to produce an ASIC. Soliciting payments and reassuring potential customers that everything was ok and on schedule after this discovery would not look good.

Eric Gunn, VP of ASIC development and supply chain management would know for sure.

He would be a key witness in any legal proceeding.

I will appreciate if you can provide Eric's contact. As the last email in June that still told us that everything is on track and the delivery will be in July shows they were in completing assembly process and shipment as the TOC said, it was impossible for them to discover a technical failure that should happen in early development stages.

The main fear that Alpha Tech are threatened by is that it cannot deliver products by the end of this month. As long as it can deliver, it will ship its shits to us no matter whether we need. It does not want to survive but wants to defend incoming law suits against it. Our victims must be united together to grasp its deceptive evidences to defeat it. For this purpose, I strongly recommend to read fightalpha.net and provide your opinions against them.

Its main problem in my opinion is its deceptive marketing strategy which is one of main internet fraudulent strategies. The key is it made the announcement in May 22nd when it did know it cannot ship in July as its tapout failed. It purposefully intended to collect our money and in June still assured us to ship in time. I hope people with engineering background in chip and ASIC products will provide us with evidences to explain what can be done within last 8-10 weeks and when it detected its technical failure. If the failure was found before May 22nd or June, it is definitely an internet scam and a fraudulent criminal. Once it's criminal behavior is proven, we will know how to deal with an animal with whatever animals should be treated. This is because other solutions do not work for them.
