Sie müssen normal die Konten als Treuhandkonten kennzeichnen, damit der Insolvenzverwalter dies berücksichtigen kann. Trotzdem wird ein solcher Insolvenzverwalter genau anschauen welche beträge dort liegen und wo sie hingehen. Nicht das da Gelder aus der Konkursmasse widerrechtlich abgezogen werden.
Wenn das japanische Recht ähnlich ist(wovon ich ausgehe) wird es zwar grundsätzliche Prüfungen geben, aber das geld zur Auszahlung kommen. Vorausgesetzt natürlich MtGox hält alle vorgaben korrekt ein und benutzt diese Konten nicht als billige Liquiditätskredite. Vieleicht verstehe ich das falsch, habe mich noch nicht so intensiv mit mtgox beschäftigt. Aber ich dachte sie sind nur eine Handelsplattform und das kaufen/verkaufen findet zwischen den Spekulanten statt. Folglich muss der Handelsplatz über kein eigenes Geld verfügen(ausser den Betriebskosten aus Transaktionsgebühren finanziert).
Wenn ich aber diese Tatsache zugrunde lege, ist es egal, ob ich mein Geld nach dem verkaufen sofort abziehe oder dort belasse. Es liegt dort nur treuhändisch. Natürlich könnte MtGox Pleite gehen, immerhin dürften sie inzwischen eine größere Anzahl an Mitarbeitern haben und wenn nach einem Crash keine Betriebskosten mehr reinkommen, dürfte das ende schneller kommen als man kündigen kann. MtGox ist auch in Japan, also bzgl Rechtssicherheit sehe ich da auch keine größeren Probleme.

Ich würde auch Guthaben bei Mt.Gox belassen um später wieder günstig einzukaufen. Nur... wie viel Bares vertrae ich Mt.Gox oder auch bitcoin-24.com an? Und evtl. auch über längere Zeit?
das kannst nur Du allein entscheiden. Bei mir waren es 6 oder 7 Monate (gefühlt das doppelte) in 2011 inkl. dem kompletten Hack, Crash und Claimprozess. Da war 7 bis 10 Tage die Seite weg. War ein 4 stelliger Betrag am Anfang. Ging alles glatt. Ich persönlich traue mtgox sehr, sie verdienen einfach zu gut am traden und haben einige male Dinge gemacht die mein Vertrauen in Marks (der Chef) langfristigen Horizont bestärkt haben (zb. bitomat.pl https://mtgox.com/press_release_20110811.html das waren 17.000 bitcoins um die ihn keiner gebeten hat). Trotzdem lasse ich nur solange was dort liegen wie unbedingt nötig. Und natürlich yubikey 2 factor Sicherheit. Ohne das stellt sich die Frage sowieso nicht.
