Isn't fraud committed if a US citizens uses a VPN to get into ICO?

I see no reason to circumvent the rules of the ICO. The ban of the us government you can work around it. It is your right. I think that such demands violate the rights of citizens and cannot be taken into action. But if the company does not accept users from America, it is their right. Why risk? You can stay without your investments at any time.
