Okay, I understand now. Thank you for explaining everything from a different perspective and angle. Yes, I did mention SRIJ and the specific online gambling license required in Portugal. As I stated, I don't have concrete evidence, and I won't fabricate any. This occurred during a chat conversation, and I can assure you that I repeatedly requested they thoroughly investigate the legality of betting in Portugal on Housebets. I asked them to have a specialist to review the information, and that I would only place bets after confirmation. Some time later, I received the email in question.

I have repeatedly requested both my complete betting history and chat logs, but all my emails and chat inquiries have been consistently ignored. I hereby authorize you to request any and all information related to my account that you deem relevant, including chat logs and betting history. As previously mentioned, I can provide you with access to my email address or Housebets credentials if you find it useful. I have nothing to hide and, unlike Housebets, I am not avoiding any questions. It is indefensible to support a casino that engages in such practices. They have misrepresented my account balance, falsely claimed ignorance of my location, and provided fabricated reasons for closing my account (Richard Hoggs), citing non-existent terms and conditions. I believe this situation arose from errors related to incorrect odds or similar issues. Would you be willing to propose a 50% settlement to them? If they refuse, we should demand the aforementioned evidence. I am exhausted by this matter and deeply appreciate your continued assistance.

I'm a bit confused. Weren't you earlier managed to get to your account? That withdrawing 10 EUR and pending for 24 hours situation? Were you not able to access them now? If you still can, wouldn't the chat session is neatly stored in your chatting history?

About account balance, again, it is already 0 due to you burning it out through wagering them. They are not "misrepresent" your account balance. It was 0 --at least fro what they explained here and to me-- the fund that you had in your account when you logged back in, was from bonus. And the term [2.1.1. is not non existent, it's there, I've read it soon after we had a talk about it being clause of "gender or color of skin" thing].

I've inquired, and they stand firm with their initial statement, what's eligible to you is what on your account. Thus, safe to say they refuse. Though it'll be "I" [you] instead of "we" that could demand for the evidence. I have no power over it, and on the high likelihood of chance, even with the authorization you gave me, it still won't work.

I contend that Housebets's actions directly violate Curaçao Gaming Control Board (GCB) regulations and principles of fair play. My arguments are as follows:

  • Unequivocal Licensee Responsibility: The GCB regulations place the sole responsibility for the conduct of sports betting operations on the licensee. "3. Operation of the sports betting activities" explicitly states: "The licensee is at all times solely responsible for the fulfillment of all obligations, be it financial or other, resulting from or regarding the sports betting activities at the casino operating under his license...". Housebets cannot deflect responsibility for ensuring the legality of their operations onto the player.
  • Illegality of Transactions: If my participation was illegal due to my location, Housebets acted improperly by accepting my deposits. This contravenes responsible gaming conduct and potentially violates GCB regulations. The acceptance of funds, in this case, should be deemed the sole responsibility of the casino, as stated in the regulations.
  • Unjust Enrichment: Housebets has been unjustly enriched by retaining funds they should not have accepted. I am entitled to a full refund of these deposits under the principle of unjust enrichment.
  • Contradictory and Misleading Conduct: Housebets's acceptance of my deposits and allowing me to play, with full knowledge of my location since February 28th, demonstrates a disregard for responsible gaming principles and constitutes misleading conduct. While term 2.1.1 places an obligation on the player to ensure they are legally allowed to play, it does not absolve Housebets of their responsibility to act responsibly and ensure they are not facilitating illegal activity.
  • GCB's Expectation of Fair Play: While not explicitly defined, the GCB's emphasis on licensee responsibility and the "Guideline Responsible Gaming" implies an expectation of fair and responsible conduct. Actions that go against this guideline, such as Housebets's, may be seen as non-compliant, and the "Non compliance with these guidelines may be subject to disciplinary action by the Gaming Control Board.".


To compound the issue, Housebets is completely ignoring my attempts to resolve this. This lack of direct communication from the casino is unacceptable.

What are my options for filing a formal complaint or taking legal action? I might be wrong, but the "guideline responsible gaming" is most likely about "Responsible Gaming Act", of which actually about gambling for fun and not to get too involved, know the limits and [from the casino side] jump to intervene upon sign of problematic gambling. The "responsible" here does not talking about responsible like in duty and rights and obligation, it's like... "drink responsibly", if you ever heard that writing [usually Mr. Walker is nearby that sign] in places that serves alcohol.

And no, I can't provide a detailed overview of your next step. Formal complaint and legal action is not my forte [in a manner of speaking]. I focus on deescalation of matters, not dragging people to court.

About court, though, I think I should inform you that as part of their final words that refuse any further step to meet you in the middle, they also tell me that they're going to file a legal action against you. Just so you know.

The case is not-resolved and not-unresolved, as it seems you both will try a lawsuit; you for what you deemed as an unjust confiscation and... what's described here. Them for defamation and slander.

Can't, no matter how much I want to, because I don't know. They don't share much details with me. I just think that it'll only be fair and you'd much prefer if I tell you in advance so you can be prepared, instead of just let it be and you got it sprung in front of you, suppose they'll really do it and it's not just an idle threat.

If I have to venture a guess though, probably it's something like above, insisting that they held your fund hostage while you actually gambled them away.
