The Bitcoin name and logo has been trademarked in Spain with the Spanish Patent and Trademark Office. This process was completed by Ignacio Rubio Menéndez, a compliance expert and lawyer specializing in business law.

Do you think he can use this maliciously since now basically  "Bitcoin" is his brand trademark in Spain?? I'm thinking of scenarios of him suing for example restaurants that accept Bitcoins and display the logo in their physical location if he thinks that it's a wrong use of the brand, is that possible?

The title is wrong - it was trademarked, not patented.

At least in the US, you have to specify the area where the trademark applies.  E.g. I could trademark "Apple lawn care" without impacting Apple Inc's trademark for electronics.  I presume it is similar in Spain.

@Aveatrex. This will create a disadvantageous situation for the bitcoin community in Spain. The person will have the legal right to demand a cease and desist order on anyone that uses the brand.

In the article, it seems like he is a hero. He said that if ever someone uses the logo or the name for a scam, he will try and defend the title of Bitcoin. From my Google search about scams relating to Bitcoin in Spain, it seems there were a lot of people that were affected by this.

The writer may have not known the difference between the two just because of the title. Additionally, the author might have confused it since the office that granted the Trademark is called "Spanish Patent and Trademark Office"
