No, first deposit always starts earning as soon as gets confirmed, because there must be a minimum of 1 investment earning.

The "5% of total value" rules is to add new investments to earning status, as an example:

1. First deposit of 1 shares starts earning.
2. Then, 20 next deposits are confirmed with a total value of only 0.5 shares. Because "5% of total deposits rule", at least 1 of 20 should start investing, but because "max 5% of total value rule", no new investment will start earning, until 1st investment ends or until new deposit go into the game to have more total shares active.

Looks difficult, but all is very logicall.
