The list of things 15-year-olds are not legally allowed to do in Oregon is long: Drive, smoke, donate blood, get a tattoo -- even go to a tanning bed.

But, under a first-in-the-nation policy quietly enacted in January that many parents are only now finding out about, 15-year-olds are now allowed to get a sex-change operation. Many residents are stunned to learn they can do it without parental notification -- and the state will even pay for it through its Medicaid program, the Oregon Health Plan.

"It is trespassing on the hearts, the minds, the bodies of our children," said Lori Porter of Parents' Rights in Education. "They're our children. And for a decision, a life-altering decision like that to be done unbeknownst to a parent or guardian, it's mindboggling."

In a statement, Oregon Health Authority spokeswoman Susan Wickstrom explained it this way: "Age of medical consent varies by state. Oregon law -- which applies to both Medicaid and non-Medicaid Oregonians -- states that the age of medical consent is 15."

While 15 is the medical age of consent in the state, the decision to cover sex-change operations specifically was made by the Health Evidence Review Commission (HERC).

Members are appointed by the governor and paid by the state of Oregon. With no public debate, HERC changed its policy to include cross-sex hormone therapy, puberty-suppressing drugs and gender-reassignment surgery as covered treatments for people with gender dysphoria, formally known as gender identity disorder.

HERC officials refused repeated requests by Fox News for an interview and even gave Fox News inaccurate information about the medical director's work schedule.

Oregon Health Authority officials directed Fox News to their website. It shows transgender policy was discussed at four meetings in 2014. It was passed without any opposition or even discussion about teenagers' new access to undergoing a sex change.

Gender dysphoria is classified by the American Psychiatric Association as a mental disorder in which a person identifies as the sex opposite of his or her birth. It is rare, affecting one out of every 20,000 males and one out of every 50,000 females.

According to a 2008 study published in the Journal of the American Academy of Child and Adolescent Psychiatry, "most children with gender dysphoria will not remain gender dysphoric after puberty."

Dr. Paul McHugh, who led the Johns Hopkins Psychiatry Department and still practices, said Oregon's policy amounts to child abuse. "We have a very radical and even mutilating treatment being offered to children without any evidence that the long-term outcome of this would be good," McHugh said.

Dr. Jack Drescher, a member of the APA who worked on the Sexual and Gender Identity Disorders Work Group, says treatment for gender dysphoria has received a lot more attention in recent years. He said this year New York changed its policy to cover cross-sex hormone drugs and sex-reassignment surgery for Medicaid recipients who are at least 18 years old. He thinks Oregon is offering the treatment too early.

"Children age 15 may not fully understand all the consequences of the procedures they are undergoing," he said.

Jenn Burleton disagrees. She underwent a sex-reassignment surgery and started the Portland non-profit group TransActive. She said requiring parental consent would lead to more suffering and teen suicide attempts.

"Parents may not be supportive," Burleton said. "They may not be in an environment where they feel the parent will affirm their identity, this may have been going on for years."

The science is unsettled. A 2010 Murad study concluded "very low quality evidence suggests sex reassignment ... improves gender dysphoria and overall quality of life." The authors admitted the evidence was "sparse and inconclusive."

Lisa Maloney, a parent and Scappoose, Ore., School Board member, is outraged.

"To know that taxpayers are now on the hook for that, that a child can do that without their parent's knowledge or information or consent, parents have absolutely no say, that's appalling," Maloney said.

The Oregon Health Authority could not say how many Medicaid recipients have been treated for gender dysphoria since the new policy took effect in January. Oregon has 935,000 people enrolled in the Oregon Health Plan. HERC assumes between 14 and 112 of them may be gender dysphoric. It estimates the total cost of adding cross-sex hormone therapy, puberty-suppressing drugs and sex reassignment surgeries to the coverage will be no more than $150,000 per year.

But HERC also believes the state will save money due to fewer suicide attempts. It estimates there will be one less suicide attempt per year. The Centers for Disease Control and Prevention estimates the average cost per suicide attempt in the U.S. is $7,234.

But Dr. McHugh says a sex-change operation, especially for young people with gender dysphoria, is never appropriate.

"We can help them if we begin to explore with them and their families what they're fearing about development, what they're fearing about being a young boy, a young adolescent appropriate to themselves."

The age of consent for actually having sex is still 18 right? Meaning they aren't allowed to even have sexual relations or if an adult would have sex with them, it would be rape correct?

If that's true, the child cannot decide to have sex legally, but they can decide that they're the wrong gender and make drastic changes to their body before they know legally when to enter into sexual relations?

Even if someone believes they should be able to make this decision, it sounds totally hypocritical.

Is getting a tattoo treating a issue that causes almost half of the people that have it to attempt suicide at some point?  

Being able to do this without parental consent does seem like an issue, but to play devil's advocate, it could also be preventing some teens from ordering hormones online and playing Russian Roulette with their bodies (it's surprisingly easy to do).

How does that work?

Actually the total cost is nowhere near that.  Getting your sex reassigned can run anywhere from $7,000 to $17,000 paying out of pocket, and insurance companies (or the government) could certainly get that down much lower like they do for everything else.

This kind of nonscientific logic is what is causing people to kill themselves. They seek medical help, and all they get is treated like a guinea pig in a sick social experiment.

I agree with you on the part that the depression mostly comes from how they are treated.  If we lived in a world where after SRS they were just treated as their new gender there would probably be much less suicides.  However, there is some emerging science that shows there are brain differences between transgender individuals and those that are not.  (Source)

Post-op suicide rate according to the famous "20x higher" swedish study is 2.7/1,000 person years, or about 21.5%.  However, a recent study out of Canada shows that prompt transition resources being available for trans people could reduce this rate by ~17%.  It also confirms the idea that the less hatred the experience, the less suicides there are by up to 66%.  (Source)

You are clearly too busy seeking confirmation bias to even read my comment. I argued that their depression DOES NOT ONLY come from how society treats them, and many people with gender identity issues often have hormonal imbalances which very clearly can cause severe depression. My very argument is that you are ignoring biological causes for suicides and completely assuming that their treatment by society is to blame and not their unbalanced biochemistry.

As far as your studies, there is no way to control for, or tell the difference between people who committed suicide because of biological factors resulting in suicidal depression, or if it was a result of how people treated them, so your assumption on the matter being mostly a societal factor is completely out of line and not scientific. It could have just as easily been that the gender reassignment ITSELF was the trauma that caused depression. There is no way to know for sure.

Furthermore none of this data supports the idea of non-consensual gender reassignment, or imposing gender neutrality for children who are not of the age of consent. If adult individuals feel they want to have gender reassignment and surgery that is up to them, but no one has any business playing games with untested social experiments using children as test subjects.

What happen if they change their mind before the age of 18? Back to the operating room again? What if they die during surgery. Is the state responsible or the parents?

The law is not consistent. Either you are still a child, teen at 15 or not. If you are then the parents are still the legal guardians. If not then the child belongs to the state.

If you think 15 is too old... Try younger...


We moved from Indiana to New Hampshire when Lia was 4. She was still wearing boys’ clothes and playing with trucks through preschool, but she really wanted girl things. We started buying her Barbie dolls and girl’s costumes.

For awhile, Lia was happy wearing pink dress shirts outside and princess costumes at home. Family and friends were curious, but no one made us feel judged. However, It was when she started kindergarten, that we saw the dysphoria start, the depression and anger. It was clear she couldn’t be comfortable anymore.

Lia is the most mild-mannered, peaceful warrior, a deep thinking, soul-searching child. The minute she begins talking, it’s just pure love. But we could see the frustration building in her.

She would say desperately, “Why can’t I just be a girl, Mommy?” At just 5 years old, she would look in the mirror in the bathroom and say, “I am a girl in my head and heart.”


The parents of this prepubescent ten year old boy have found a doctor willing to work with them and are about to chemically alter his body to halt the onset of puberty.

I agree with that if they move the age of consent to 15 then it would be fine otherwise this is a hypocritical decision.
No sex to 18 but Sex changes at 15 ...
They could meet at 16 and that would be fine but either the age moves up to 18 for Subsidized sex operations or they should move the consent down to match other legal rights like driving drinking smoking gambling sex etc.

It does raise a strange question kids are vulnerable so we need to make sure their at least 18 before but sex changes are fine.

This made me loose a tad bit more faith in humanity. How in the world are they going to allow children with under developed minds make a huge life altering WITHOUT parental consent or notice? Of course parents won't be supportive, this is because what these kids think is a great idea now may turn out to haunt them for the rest of their lives. Not only that but the tax payers are paying for it, the fucking tax payers. I can guarantee that a VERY small amount of the population in Oregon would not be ok with paying for a random kids gender changing surgery. It is mind boggling to me as to how this got passed.

A 15 year old guy ,is maybe mature enough to know where he wants to be and what exactly he wants from his life. And if he's going for sex change ,and the state is subsidizing the operation, it's a noble thing to do .

Why should the tax payers sponsor these obscenities? If the Sodomites want to have sex change, then they should do that at their own expense. Why should the normal people spend their hard earned money on this? Western nations are going down the drain. They refuse to give treatment to cancer patients, saying that cancer drugs are too expensive. And at the same time, they don't have any problem with these sex change surgeries.
