Depends on the jurisdiction of the site and its customers. I think they are trying to play safe.

Did they ever had any problem with India ? To accept bitcoin, country is immaterial. And to accept USD, user could ask for a cash out in INR through PayPal from the BitPay site balance. Please correct me if I am wrong.

Maybe someone could buy into online digital coins in an online wallet through bitpay where that site can be affiliated with a gambling site, and then those digital currencies can be converted to bitcoins and be sent to those gambling sites. Would Bitpay still pose problems for this?
