Whoever ships first will more then likely get a flood of new orders. Thus being first has advantages and not easily given up.

I'm guessing there is a decent amount of orders at stake for the first shipper of ASICs. And even more at stake who gets the supply chain in order and can minimize wait time post-order.

Also based upon Tom and Josh's feuds, I think it is relatively unlikely that they struck up a deal. But I guess stranger things have happened...
