12 TH/s, at least, thanks to ASICMiner.

They are currently deploying 12 TH/s and possibly more, with around 6 TH/s already mining at BTCGuild. 50 TH/s additional is currently being produced.

In addition to ASICMINER's deployment, Avalon has delivered two confirmed units, one to Jeff Garzik, a Bitcoin developer and one to the Bitcoin Foundation.

ASIC technology as a whole is not a scam.  Individual vendors have the potential to be scams.

There are supposedly 2 Avalon Asics prototypes around.
Butterfly Labs has 6000 chips, which should give approximately 6 THs, in a bumping facility to contact chips to the boards or so. Looks like a homecraft-in-my-garage-operation. No news since Feb 14. I doubt they will ship anything before late summer.

Avalon is very very slow to roll out. I wonder if they will end up shipping all of their orders?
