I heard BitcoinASIC never converted their coins into USD.

BitPay may not be letting Tom getting the full amount, and only let him withdraw at the current USD rate.

Source?  I highly doubt that BitPay is still in control of any of the bASIC pre-order BTC.

If the BTC crash continues then no.
Paranoid much? Over the past 4 days, the value has risen ~10%, and then dropped ~10%. Go look at the MtGox 30 day timeline - it's a pretty consistent upward trend. I don't consider that a crash.

I thought it was a foregone conclusion that Tom maintain(s/ed) at least one main wallet containing BTC, and it's from there that earlier refunds stemmed from.

We payout all merchants daily regardless of what currency they choose to be paid in (in the cases of USD or other national currencies, we payout as the banking system allows...which means we can't payout on weekends or holidays).  We do not hold funds on behalf of merchants, BitcoinASIC is no exception.
