After long thought and suffering from what I think is a heat stroke cause its hot as hell in Panama today and I do not use an AC cause it will screw with my vocal cords and as an interpreter I need my vocal cords at their best. (AC units tend to remove humidity and for some reason I get a soar throught).
Ive decided to think about history without quoting anything, people can post their own quote, Its to warm to spend extra energy searching for that.

Micon accuses BFL acting like a Ponzi since they first sold products to gain trust, they created a new line of product that could be traded in and they took preorders and accepted payments for such preorders and have had their preorder delivery dates delayed several times whilst increasing online presence by purchasing ads.

BFL has always since they begun their ASIC venture said, they did not want to give an unfair advantage to early adopters, so they had the 1/3 order distribution to provide a lottery like system for delivery of their product and allowing everyone to have an equal chance. That is a very mature decision that was based on helping the stability of bitcoins rather than their own pockets.

Now from what I see BFL has honored refunds to a certain extent, not too sure if I should considered a product pegged to a currency and the refund is done in another should be handled, but so far I see people angry that they were partially refunded and others happy that BFL was due diligent...

As for legal fee, customs and delivery dates, those skyrocket so I am not entirely sure that BFL has an adamantium thumb drive and then there is the assembly line, did they choose to assemble products locally or elswhere. This as a whole is a huge coordination process. Regardless of assembly they have to test product before they can launch the assembly line and mass produce. All this has a cost and it increases as preorder refund request increase.

Now if they run they scam. If they don't run but don't deliver then their business model was flawed. If they deliver then they are just another business and everyone will forget about the fuss but they will regain trust.

On a side note, guess BFL shouldve thought about testing to procuring parts to assembly, testing assembly facility finished device; securing this through a loan to get a delivery of the smaller devices which most people wouldve purchase before moving on the the larger ones to then establish preorders and continue their business model.

I think you could use a humidifier in addition to the AC, so you could be comfortable and protect your vocal cords.

Only those who placed orders between June 23 and July 23 2012 are included in the "lottery".  The 1/3 shipping plan wasn't developed until after that time so it neither encouraged nor discouraged sales.

All I can say is that this is Bitcoin. I don't believe it until I see six confirmations.
